  3. Hi all, I sent a letter to BPF on the day I received the letter about Computeach. My letter was short and to the point basically stating I would be taking a 28 day period in which to assess Computeach myself before committing to anything. I also said that I would expect my account to be frozen and DD canceled as per letters from them. I also asked for them to provide me with all options available to me if I choose to reject Computeach as I had previously been approached by them prior to signing with Advent.... I am still awaiting a reply, but will let you know the outcome.

  6. They are asking us contact Computeach directly and to carry on paying as per our agreement..... Computeach will be able to answer all questions we may have apparently....
  7. the contract most of us have has no info on our cancellation rights only "you have a short time in which to cancel", does this count for anything?
  8. With you all the way Mustard, there is a moral fight on here as well as a legal one..... We signed with Advent, not Computeach and most of us did research course providers prior to taking the plunge, I want what I signed for from the provider I chose. As Martin pointed out earlier, BPF have chosen Computeach as it fits their agenda not ours.....
  9. Fuzzbutt, has your complaint with the FO reached 8 weeks yet? Or for that matter has anyone else's??? If so what is the outcome so far?
  10. I understand where you are coming from Fuzzbutt, but essentially we have had our course stopped for 2 months now, which has to count for something with regards to the issue brought up above.... How can we complete part of a course with no provider, no exams and course material? Again we are at the mercy of others...
  11. Thanks for the link Fuzzbutt, reading the stories on this group is giving is some real ammunition to dispute Computeach as our new provider. What we all need to be asking when the letters arrive are 1, What is the pass rate required in Mock exams to be put forward for the final exam, 2, If we fail the exam will Computeach pay for us to re-sit the exam as Advent guaranteed, 3, Do they provide a dedicated team to help find it's syudents work as Advent boasted, 4, Will the course be up to date with current certifications as we are now in the now about MCSE becoming redundant this July, 5, What will be the time limit on our course as many Computeach students have been asked for further money to continue their course after a specific time limit has elapsed and finally, why should we even entertain such a company which has got such a reputation that their students and ex-students are taking legal action against them while they are still trading. It is our right to refuse and I implore each and every one of you to do so... This company is far worse than Advent and that is saying something, if anyone would like to add to my list then please do so.   12. Not at all..... We have never seen a copy of the Hitatchi contract, we can only deal with what we have, for all we know the Hitatchi contract could be drastically different to the BPF one. Sorry David.

Just another quick note, just checked all my correspondence from BPF and the first letter notifying me of Advent ceasing trading was dated 28/01/10, that means by next Thursday (25/03/10) BPF will have had 8 weeks in which to source a new provider, if we are no nearer a answer from them by this date I believe we can all claim breach of contract due to the time elapsed without a provider.
  14. Did anyone ever get told the amount of time you had to cancel the agreement? I have just been looking over my paper work again and I am sure I never received anything in writing with regards to canceling the agreement. All it says on the contract paperwork is "you will have for a short time the right to cancel"..... Just how long exactly is never stated..... Could this add to our argument? After all this is very unclear....
  15. The physical financial agreement with BPF does not mention Advent, basically they will try and say it is just a lump sum (loan) that they have paid and now require back. They (BPF) are trying to honor the financial package and as Advent aren't mentioned in the agreement, then they have a very strong case which would need to go to court to get a decision.... If you get negative feed back from latest letter (the one they have given you a date that they will reply by) then I suggest looking into any other loan, credit or insurance agreements you may have as some/most of us should be covered in these packages for legal help, it's kind of a safety net for if you get into trouble they can help so that they get their money back. There will be a limit (maximum amount they will spend in such circumstances as you making a claim), but it is a fall back point.... I am watching what is going on on here.. Waiting for someone to get a reply with regards to the free legal advice letter, if that comes back negative I will be looking into getting legal help through one of the above mentioned. BPF wont just walk away from this, it's not in their interest to, and I think the whole FO thing may take too long to get sorted which leaves us all in a sticky situation. Their is strength in numbers, but we would all need to be singing from the same hymn sheet and all be doing the exact same thing, maybe one solicitor to represent all???? I understand some peoples circumstances are different, and as you and I aren't claiming money back it would need several of us to take the plunge with a solicitor to gain any weight behind our claim and doing this would cancel any previous complaint made to the FO as you would alternative legal representation.   17. One further piece of info that will help...... If you have a loan or insurance (car, home), even a credit card, please check your policies or call the relevant parties, you may have legal cover on your insurance..... This will cover you getting a solicitor to deal with this issue.
  18. Ok, had a free 30 mins with a solicitor this morning and we may have a case against BPF. The solicitor stated that the best route financially is through the FO and that any other legal representation via a solicitor would automatically stop the case with the FO as you would already have a legal representative. Legal aid applies to people claiming money back (but I may still be able to get legal representation free) and is offset against the amount you are claiming back against the amount required to represent you. The solicitor did state that BPF will fight this all the way and that having looked at the the enrolment form, loan agreement, terms and pre-contract details there was little to link Advent to the actual finance (not good).... There is a possibility of a breach of contract due to the the length of time it is taking BPF to source a new provider, but there is no case for being mis-sold the course if you were given alternative ways in which to pay as there is no written guarantee of work placement within the contract or enrolment details. All is not lost though, 1 way to advance would be to get together in groups and applying for legal aid together, as I am not claiming money back from BPF and I just wish to cancel the agreement, having several people join together for a claim may well grant us the certification to gain legal aid and take the fight to BPF, but as stated previously, this would stop your claim through the FO. In a nut shell we DO have a case and the longer BPF take the better position we are in and if we can join forces against them we would have a much stronger case and could get free legal representation through a solicitor of which I am trying to source as we speak. I will be looking for another free 30 min consultation with someone who does a lot of legal aid cases to see exactly what the best course of action is, hopefully before the end of the week.   19. Think the legal aid part is getting a solicitor to deal with the issue for free, send letters and try to get it resolved out of court.

I believe it is based on individual circumstances Fuzzbutt, i.e. your financial income, me being unemployed at the moment means I can get legal aid, but I do believe if you are on a low income you can claim it also.. I would call them get a local solicitor's details and ask them.... All the solicitor asked me was how much the loan was for, the next question asked of me after that was "can you come in to see us tomorrow morning"... I had mentioned I was unemployed but surely there will be an avenue for all who need it. Hope this helps.
