  1. Yes, it says "if you do not make payment by the above date we will commence court action to recover what you owe".
  2. Hi all I've just received a letter from Premier Park headed "notice of intended legal action - supreme court decison" referring me to the Beavis decision stating that if I o not pay up they will commence court action. Any thoughts on next steps?

  4. Many thanks for taking the time to send me replies, it is much appreciated. Although I sent the ticket back I hve retained clear scans of both sides that I sent to POPLA with my appeal. I will ask Premier Park to return my ticket. Would it be worth reappealing to POPLA emphasising that I paid and PP have suffered no loss or is a further appeal not allowed?
  5. that I paid (enclosed the ticket) but that I put in wrong reg (they have photos) that this was an error, exact wording "You will see that the ticket bears the registration xxx as unfortunately I inadvertently typed in the registration of my usual car, instead of the xxx that I was actually driving that day. xxxx was my usual car which I had had for a number of years and had parked at xxxx several times over the last few months. Unfortunately the car had to be taken off the road and disposed of following an MOT failure the previous week and I had borrowed xxx, my relative's car. At the time I paid for parking I had just finished a stressful all-day examination at the end of a residential course and was packing up the car to leave xxxx for the final time to return home. I can only think that I was distracted and stressed at the time and that this is the reason why I entered the wrong registration number. "
  6. Hi I wonder if anyone could help. I had been parking at a Premier Park in Southampton from time to time during the summer whilst on a residential course. Unfortunately my car failed the MOT durng this time and I borrowed a car from a relative. The first time I parked this car in the car park I received a ticket as I mistakenly entered the reg number of my old car (you needed to enter the reg number into the machine when buying the ticket). I appealed to Premier explaining the circumstances (it happened on the day of my final exam when I was also packing up to leave my accommodation and I think I must have been distracted, I paid for parking and provided the ticket etc) but was declined, I then appealed to POPLA who also declined my appeal. I have now received a £100 demand from Premier with a threat to pass to their solicitors. I'd apprecite advice on whether I should just pay up or are there any further avenues I can explore.   7. Hi could you link me to the in dispute letter. 1st Credit have already confirmed in writing that no legal action will be taken and that the debt is currently unenforceable, so do I still need to send this letter?
  8. They said they "sought to obtain a copy" and that they have "since been advised that they are unable to assist" so suspect they tried to get in touch and realised company didn't exist.
  9. Sorry, it was a request for a copy of the original loan agreement. I am assuming that 1st Credit own the debt cos I picked up from another post on here that Cetelem went into liquidation. Not sure why nothing is on my credit reports, but I have checked all 3. Thanks for replying!
  10. Hello there I'm looking for some advice re debt with 1st Credit on behalf of Halifax Cetelem. This is approx £2,000 and dates back to 2001. I don't have any statements or agreements so I sent a SAR to which 1st Credit replied "we sought to request a copy ... from Cetelem ... we have since been advised that they are unable to assist at this time and therefore we are unable to provide you with a copy of the agreement". I have been paying £5 a month for years with interest frozen and from time to time get letters from them offering to discount up to 60% for payment in full. However, this debt does not appear on either my Experian, Callcredit or Equifax credit reports. I am desperately paying off my debts and am on track to pay them all off in the next 2 years. I don't want this to come back and bite me in the future as I am trying to clean up my credit history, but need some advice whether to go for a settlement, or stop paying in the hope that they will not enforce. many thanks
  11. Hello there I'd welcome some advice as a newbie re: DLC / Hillesden Securities formerly HFC Bank (although I also have some correspondence to suggest Beneficial Finance are also involved). I am acting on behalf of a friend via POA and DLC are dealing with me directly. I don't know exactly what type of account is involved nor do I have an original agreement or any statements so no idea whether any PPI or credit card charges to reclaim. I wrote in Oct 2010 asking for CCA and received timely response stating it was current account with overdraft facility (some of the posts on here suggest that this may actually be a credit account - but DLC say it is exempt from CCA as current account) but that they have made a request to HFC for a statement of account. I receive regular letters saying this has not yet been received but will be forwarded as soon as it is. They also draw my attention to McGuffick v RBS on enforcement and say "whilst we may not be able to enforce the account until documentation is provided, the monies remain outstanding and the underlying obligation to pay remains intact". I am currently sending £20 PCM as agreed, but have recently received an account closure notice subject to payment of half the outstanding balance, just over £200. Any advice would be gratefully received. thanks
