  2. Hi, I have a default for missing payments with Home Retail Group through Argos. The account has been payed off and settled through a debt collection agency. Can I ask to get the default removed? Me and my family are trying to get a mortgage and this is hindering our chances. Thank you, Rob

  4. Hey Guys, Just a quick update about the things happening to me. I had a letter from Barclays saying they were passing my details onto "Sanclare Financial". Which I thought was odd as most of you had Mercers. That was 20th August. I yesterday had a business card posted through from a company called "Resolvecall ltd." It was posted in a brown envelope with my name and "URGENT.DO NOT IGNORE" written on. So they had been to my house. On the business card, it says " I called today for the 1st time regarding your account(s). Please contact (name) on (tel no.) or our office qouting reference Barclays Partner Finance." This was all in handwriting. Including the envelope. Who are these companies and has anybody else had to deal with them? I also thought they couldn't come to your house and pressurise you. Or was that they just couldnt come in. What shall I do now? Just send the letter saying that the account is in dispute? Is it worth mentioning the outlines that they cannot harass me as mentioned on the website? Cheers Guys P.S I've just had a look at the number (0844 257) and it costs 4p per minute not including connection charges. I dont have a house phone so this would cost more i guess from my mobile. Not that i'm going to call them but, would this fall under the unfair practise of 'asking or instructing debtors to make contact on premium rate telephone numbers' or is 4p not premium. I'm really not sure. lol.
  5. Heys Guys. I brought a car from a local dealer about 4 months ago. Driving around yesterday and the back box of the exhaust falls off. Looking at it, it looks like the pipe was corroded. It is not a clean cut. The tail pipe was also not in good condition. Its a '98 Ford Escort and needs atleast half of the exhaust replacing from what I can see. But i'm no expert Can I take this back to the dealer for him to sort out or am I left to do it on my own? I have the receipt and haven't yet checked for any advisories which I know I should of done before purchase Thanks in advance for any help, Rob

  7. I've contacted Barclays Partner Finance twice and they have NOT let me freeze my account!?! Anyone else had this problem?
  8. Surely just stopping your direct debits is a breach in our contracts? In which case could leave you with nothing, or end up paying back more? To be honest, I don't really want to mess with the bank until I have a good enough backing for doing so.
  9. Hey Guys. Another fellow EX-student here. Been trying to do some research of my own. I think I may have found some valid points through the contracts and law, but not sure, so i'm posting here to see if people know more about them or already have information about them. As some people are paying through Clydesdale, I have found that I dont have an actual contract WITH barclays, only Clydesdale. There is no mention on this contract about providing alternative goods or services. (Taken from the Equal Liability link a few pages eariler). "Under the Consumer Credit Act 1974, the credit grantor (whoever provides the credit) normally becomes equally responsible for any breach of contract or misrepresentation by the supplier." In this case, on the Terms & Conditions on the back of the Enrollment Form, Section 10 - Termination. Section 10.1.1 "In the event that we make any voluntray arrangements with our creditors or become subject to an administration order, or go into liquidation (except for the purposes of amalgamation or reconstruction and in such a manner that the company resulting there from effectively agrees to be bound by or assume the obligations impossed on that other party under this agreement)." Does this mean that this applys to Barclays and the contract could therefore be terminated? On the Clydesdale contract, by the Consumer Credit Act 1974, "If you received unsatisfactory goods or services paid for under this agreement, you may have the right to sue us, the supplier, or both". "If the contract is not fulfilled, perhaps the supplier has gone out of business, you may still be able to sue us." I know point 4 has been brought up in other posts, but seen no light shed on the matter, as with most information we get hold of, and to me is looking quite bleek. All this kind of stuff is complete gobble-de-gook to me, but just trying to help out as much as I can. I'm going to the CAB tomorrow/today to find out more about these points and anything else we may be able to do. Rob Stoke-on-Trent
