  1. You are lucky! I am also self emplyed and tesco have just refused my claim for PPI on their credit card i had with them!
  2. Thanks for the replies, I have an update! Well, I called the helpdesk back and was told they still had not received my acceptance form, I pointed out again that Barclays had signed for it so obviously they had lost it, after I asked what can I do now she said they would post out another acceptance form which she followed up with..."you should send it back by normal mail and NOT recorded as it goes to a different department when it has to be signed for!" . My reply was along the lines of "your joking right?" I mean what proof would i have of it ever getting there!?, anyway, she said I could try calling them again during this week just incase the form finds its way to the right place (yeah right). So, Thursday of this week I call them back again only to be told the same "we havn't received your acceptance form yet", I then asked when the new forms would arrive only to be told that the admin department was running a week behind, I then informed her I wasn't prepared to wait so i would photocopy the photocopy I had and mail 2 copies, 1 via normal mail and the 2nd via recorded delivery, I mean...one of them should get there right? So, Friday at work I get a call on my cell phone from Barclays regarding my PPI complaint and the fact they have not received my acceptance forms, to which I informed the caller I sent them..Barclays lose them! The caller then tells me they can take my verbal notice over the phone that i want the PPI cancelled! I'm a little taken aback by this as it was meant to have been cancelled months ago when they took another payment for it AFTER they had agreed to repay it! Apparently, the reason my acceptance forms had not made it to the right place was due to the fact the reference number on it was different to the complaint file (it isn't i checked) the caller finished off by informing me they had authorised the repayment direct in to my account instantly and would also put it in writing the original amount plus the extra payments taken to confirm, as soon as i got home I checked my account and the money was there!

Well, as I have not received any paperwork from either the court, Restons or the Land Registry I can summise that MBNA or Restons acting on their behalf have not applied to the court to have the Charging Order changed to have it changed to benefit MFS. I will keep paying Restons untill the new year, then I will write to MFS with an offer of a settlement figure and see what happens!

My business account with Barclays had an overdraft which had PPI attached to it, I put in a claim to reclaim the charges and Barclays found in MY favour and gave me a settlement figure + the stat 8%. I posted off the acceptance form via recorded/signed for which, after 3-4 weeks had still not been delivered, I phoned up Barclays and explained the situation and they sent out another accepotance form. I posted that back to them via recorded/signed for and that was delivered/signed for on the 10th of this month. As i have yet to receive a cheque from them i called them earlier today to be told..."oh it isn't showing as received on our system yet!" I managed to keep calm as the call centre lady told me she will 'put a note on the system' for someone dealing with th case can look in to it, and then tells me to call back at the end of the week! To say I'm a little bit is an understatment. Anyone else having problems with Barclays and reclaiming PPI?
  5. I have had no phone calls. I sent a letter to Restons with an updated income/expenditure sheet and informed them my monthly payments would be dropping due to the interest rise on my mortgage. I received a letter back saying... We write to confirm the terms of the repayment scheme agreed on the above account. Your first payment of £xx must be made so as to be cleared through our bank no later than xxxyyy zzzz. IMPORTANT-This programme is not a formal variation of your contract with MFS and may be varied or reviewed by us at any time in our diecretion an relies on the complete and accurate disclosure by you of your current financial circumstances.We may ask you at any time for an up to date financial statement for the purpose of reviwing the instalment plan. I will be phoning the Court manager to see if anything has been changed with my CCJ, I'm guessing that as they have said nothing or informed me of anything, it is still listed as MBNA on it!
  6. Indeed! Well today I have finally received a letter from MFS Portfolio, it reads...... This letter is notification that we , MFS Portfolio LTD have had assigned to us all right, title, interest and benefit in the debts due in relation to the above account ,previously owed to MBNA. This means that we are now entitled to all sums owed under the account and the benefit of any actions taken by or on behalf of MBNA prior to the assignment. We have appointed Marlin Financial Services (Marlin) as our managing agent, though your account will continue to be managed by Restons unless or until you are told that anyone else will manage your account. It is important you continue to make payments to Restons to reduce the balance on your account. Anyone know who or what department I would need to speak with at the court where my CCJ was issued so I can find out if it has been transfered?
  7. Formal as in agreed on between MBNA/Restons and myself without a court order for how much to pay then yes. As I mentioned earlier all the court did was issue me with a CCJ there was no order from the court on how much I should pay each month, I made an offer to Restons of £xx amount per month, they accepted my offer on the condition the court agreed a Charging Order on my property (with reviews).
  8. Ever since the CCJ obtained by MBNA my payments have been made to Restons, there was/is no court order on how much to pay, as in an earlier post the amount I offered each month was accepted by Restons/MBNA on account they obtained a Charging Order against my property.

I think what I will do is send a letter with my updated income/expenditure form, and inform them that due to the 1% increase in my mortgage payments I will be reducing the amount I pay each month, I will however point out that it will still be more than the initial agreed amount. Wonder what they will have to say about that!
  10. Good point, I will just send back an up to date income/expenditure sheet showing my mortgage payments have increased, I will also inform them I wont be increasing my monthly payment!
  11. If that is the case i will ask in my letter if MFS have applied to the court to be replaced as the claiment for the C.O!

Ok, so i sent a letter to both MBNA and Restons (to clarify I have been making all my payments to Restons) asking what happens with the CCJ and the CO, today I received their reply which reads.... RE Marlin Financial Services LTD v Yourself The sale of the account affects neither the CCJ or FCO. We remain instructed in this matter. Our client would like to take this opportunity to review your financial circumstances with a view to obtaining an increase in instalments. We are also aware that you have received a refund of PPI premiums amounting to £1400. To this end, please find attached a financial statement for your completion, may we please be in receipt of the same within the next 7 days. I can assume from the above that Restons are now working for MFS Portfolio, and I think they have a bloody cheek asking for more money every month! Well the mistake MBNA made was sending me the cheque for the PPI as that was cashed and used to pay off my mortgage arrears, my mortgage has been increased by 1% since last month and it also due another 0.5% increase in September so the chances of me paying more are slim to none! I think my first response to Restons will be an updated income/expenditure sheet along with a letter directing them to their letter confirming they will accept £xx amount per month if they obtain a Charging Order (which they did) I will also point out to them that I have also always paid more per month than first agreed!
  13. Ok, have just found out the letter from Restons in reply to my letter with a monthly amount I have offered and it reads... Due to the sizable balance and poor repayment history the claimant requires the security of a Final Chraging Order against your property. They do not require this for the purpose of requesting an Order for Sale but merely to ensure repayment of the judgement debt by way of a sale or remortgage at some point in the future. On the basis the Final Charging Order is granted the claimant is prepared to accept repayments, as offered at the rate of £xxx per month, subject to reviews. I'm as confused as the OP to why MBNA would sell off the debts they are guarenteed to get?! The only thing I could think of was to balance the books in this financial climate that is screwing everything!? As I mentioned in an earlier post ref Charging Orders, would I be correct in saying MBNA can NOT just hand over the Charging Order with the account they have sold? I was going to start my own thread but as I appear to be in the same position as the OP I thought it best to keep it all here as any replies would benefit us both.

My payments were not set by the court when the CCJ was issued, Restons legal bod asked the judge about payments after she had issued the CCJ but the judge said that was a different matter as that court sitting was just to issue/decline the CCJ, I wrote to Restons the following day with an income/expenditure form and an offer of payment which they accepted and which I have kept up with ever since (even paying extra when I had available funds) The Charging Order was applied for by MBNA/Restons 4/5 days after the CCJ was issued.
  16. My letter from MBNA states.... We've transferred ownership, together with the rights to collection, of your debt in relation to the above credit card account to MFS Portfolio LTD. You should await further information from MFS Portfolio as to what will happen next. Until you receive new payment instructions we'll process any payments made into our bank and transfer them on your behalf. If you have given us details of your financial circumstances we'll provide this information to MFS Portfolio together with your recent payments (if any). I am also sending MBNA and Reston's a letter asking what happens with the Charging Order as there has been no mention of it.
  17. I will be watching this thread with interest! Today I also received a letter from MBNA informing me they have sold the debt to MFS Portfolio (who I might add I cannot find any info about on the net). I also have a CCJ and a charging order on my house and an agreement in place with Restons to pay £xx amount per month, as the charging order was applied for by MBNA I'm guessing they cannot pass this over to MFS with the purchased debt?

Oddly enough I received a letter from Barclays today in reference to another claim for mis-sold ppi on the same business account as the above but for overdraft protection and not a business loan as above, this recent letter states they HAVE upheld my complaint and will issue me a cheque once they have received my acceptance form!. What is the best way to contact the FOS, phone or email?

I also put in a PPI claim to MBNA Credit Card, had a letter back almost immediately saying they are looking into my case, approx 2-3 later I received another letter stating my claim was being upheld and I should receive a cheque for £xxx amount within 28 days. Their cheque arrived a week later which I thought odd as my CC account with them is being handled via their solicitors due to arrears etc, I was of the beleif that any repayment would be credited direct to the account?!
  21. NRAM true to their word credited my bank last week with the amount stated in their letter!

Well a long time has elapsed since the last letter from Barclays so today I decided to give them a call to see what was happening, I was politely told that the case should never have been re-opened as their letter which stated "you were not mis-sold and this is our final word on the matter" was the end of it. So I will now send off all the relevant information to the FOS.
  23. Have received a letter back from Barclays thanking me for my letter (see post #2) and informing me they are looking into it.

I had a letter from NRAM, sent off the relevant information they requested and have received a letter back saying my claim is upheld, they also state in the letter how much they are going to pay me and that it will be depositied to my bank account within 28 days, no mention at all about any commision.
