  1. Hi all, Its 5.30 14 Oct not been yet. Can I ask someone what will they do when we refuse to talk to them or let them in . What happens next please ? Have prepared an income and expenses account to push through the letter box to them. As far as goods are concerned we have nothing of valiue after 15 years of suffering one problem after another but have refused to borrow or go into debt Ifwe cant afford it we dont have it, all our debt problems have been with living ex and utilities Is it any good trying to speak to United utilities again at this point . We have a negative amount of moneys available but do I still make an offer of payment by installments £5 a month say. As its gets closer getting more strained, wish it was over. thanks for listening.   2. Sorry to be posting again but have got another letter saying coming on the 14 October with removal Contractors to sieze and remove goods. Do I have to let them in, for what good it will do them. Thats what Bristow an Sutor said but when they found we have nought for past council tax they put two attachment of earnings on my part time income. By the way upto date with this years Council Tax There is limited income coming into the house is that the details they want or just what My wife has, which is about £500 a year and not every year. Dont know what to do, after my last experience with Bailiffs. Dukes Told horrendous lies and denied it all when questioned by Council I was going to tell them No correspondaence on telephone or verbally unless it is being recorded can I say this Really worried just dont know where we stand. How can I offer payment by installments when we dont have enough coming in now, can I still offer installments at this stage as it says the execution has not been settled so we are coming for your goods. CD She was keeping it away from me because of last time. worried for my stae of health and mind. Yes went to nottingham court I found out when saw letter from Bailiffs and came on here again sorry should have learnt from last time Direct from benefits past years not paid other addresses apparently. I am completely in a fuzz dont know which way to turn or do.

From a nottingham court had a judgement wanted £228 a month apparently from a nother address we lived at prevoius ly as well as here £1900 now £2036 court and with bailiff charges. and more to come . but do they only want to know how she can pay if she isnt working. got my son over 30 at haome and brother in law pensioner to. Dont know what to do.
  4. Bailliffs called unitied untilities debt in my wifes name. Will they want to know all the income coming into the household . My wife is not working due to illness after losing job 2 years ago. you can probably see my past experiences in archives. I myself are on pension state pension have had to take on a partime job against doctorrs orders. another firm of bailiffs put an attachment of earnings on my wages for council tax debt. so only come out with £95. after aeo. because this is in my wifes name do they only want to know what she can afford to pay, or because it is a household debt i.e. for water. we got turned down for that water thing if unable to pay said we did not qualify. can any body tell me what to say. Thank you
  5. I am really grateful for all the comments and information that people have given up their time and energy to bring to my original questions and concerns. In the midst of all the conversations and postings I appear to be a little lost on the question, I posted the letter the bailiffs had sent to my employer it was not an actual application for an attachment of earnings but a letter, if you go back to the posting asking for information , I was looking to see if my employer has a legal obligation to reply to this letter as it is not an actual attachment of earnings order. ??? CP

  7. Does the bailiff ask for whatever amount he wants or is he governed by the scale of % charges dependant on wage income?? CD
  8. Hi, Is my employer under any legal obligation as to this letter, to complete the questions they have asked It is not an actual request for to set up an attachment. It seems to suggest to my employer they don't know where I am which is nonsense. Letter is headed in bold headlines CAN YOU HELP US TO CONTACT THIS EMPLOYEE? Enquiries indicate that you may be or still are the employer of the above. We wish to make contact with them or alternatively if we are unable to do so we would pursue an Attachment of Earnings Order WE would be most grateful if you could please let us have the following information followed by 6 questions including last known address are they still in your employment If yes can you confirm their payroll reference If, no do you have any current employment details for them If we were to pursue an attachment of earnings could you give us the correct address where the paperwork should be sent and the name and address of any person to whom it should be addressed Please advise the date of your next payroll - is your payroll Weekly/Fortnightly/Monthly It continues quoting sections of the Data protection act 1998 section 29(3) The information Commissioner has confirmed the debt we are trying to collect fits Section 29 category and you can therefore release the information to us Is this letter something they have the power to send to my employer Thank you for your thoughts or knowledge of this.   9. HI I only work part time for health reasons not supposed to work according to docs but have to to survive 16 hours a week I take home £112. When I went back to work when my wife lost her job and council had an attachment of earnings order on her wages, by the way she was unable to work at that time as she is now ill, so I had to. My wages less than she was earning. Right at the beginning told the council on-line of the change of circumstances. but received no council tax rebate. but got a change in housing benefit. I told them then, put an attachment of earnings on my wages which they refused to do. Six months down the line requesting a re-look at our situation was told yes you should have got council tax rebate. because you are over 60 will only roll back to 3 months back allowance. Thought that was the end of it but no, after one week was contacted saying you don't qualify for this because when you sent in change of circumstances it only applied to Housing benefit for you you were not getting council tax rebate so it wasn't a change in circumstances for council tax I should have applied for Council tax as a new application according to their rules. so took back and cancelled the rebate, which was worth £10 a week So sent in new claim for council tax rebate and didn't get it still to this day no wiser why. So now have this agreevation all over again.
