  2. Having accepted HSBC's almost full offer as partial repayment and giving them until 2nd Oct to pay up in full, I have today recieved an offer of the full amount in full and final settlement . The money should be in the bank in 7 days. Delighted, if only Barclays was so easy! Donation on it's way, keep up the good work guys. Cheers.

  4. Hi All, Need a little help here I think. Got a "General Form of Judgement or Order" yesterday from the court setting a hearing date of 22nd Dec to last half a day! It also says: "1. The parties shall by 4pm on 17 Oct send to each other statements of the evidence of any witnesses of fact they intend relying upon at the trial and shall append to those statements any documents they intend relying upon" It then goes on to say: "2. The parties shall co-operate to prepare a bundle of documents for use at the trial such bundle to include the statements referred to above. 3. Each party shall prepare a skeleton argument and that shall be included in the bundle referred to above. 4. The claimant shall lodge a copy of the bundle at Court by 4pm on 8 Dec" So my questions is, the evidence of witnesses of fact referred to in point 1 does that include things like the OFT report and the other documents our claims are based on or is it just if you want to use a witness? If it does mean all the documents, why does it have to be sent to the bank so much earlier than the court? Do I just get the bundle together now and send a copy to the court and a copy to Barclays anyway? Any help appreciated, just need some clarification on the wording above from my letter. Thanks Rob
  5. Hi All, I sent my prelim request to HSBC on 28th August asking for £1168 back. 2 weeks passed and I didn't hear a peep so sent my LBA on 12th Sep. Finally got a response from HSBC on 22nd Sep. Said the usual, the charges are fair, and if it went to court they'd win, however to end the matter they are offering £1020 refund. Not bad really, only £148 short of what I asked for. I've been very tempted to accept it to be honest, but that's what they want so have written back today saying I'll accept it as a partial refund and have given them until 2nd Oct to refund the full amount before starting court action. What do people think my chances are of getting it all back without going to MCOL?? Keep it up everybody!
  6. True to their form Barclays defended my claim and the courts sent me the AQ. Returned my completed AQ to my court on 06-09-06 and they said I'm going to be looking at a court date of the end of Nov at the earliest so it looks like I'll have to wait a little longer to get me money back from Barclays. I guess I should use this time to start getting my document bundle together. Keep up the good work everybody!
  7. Hi Rachael, I'm just behind you waiting for Barclays to file defense (they have until 28/08/06). Anyway, send a list of your charges to Barclays solicitors, like the list you included with you request for repayment. With regard to the AQ, have a read of some of the other threads, there's a couple that detail what needs to be done, there's also some info in the template section I believe. Hope that's some help. Keep going!
  8. Amazingly the cheque arrived today, a mere 24 hours later, so MBNA settled in full! If only Barclays was as easy. What a great site - thanks
  9. LBA deadline is up tomorrow (15/08/06) so gave Gareth Tunnicliffe a ring as a reminder. As others have stated he's a nice and reasonable chap. He gave me the blurb about the charges being reasonable, however they want to avoid court action so have agreed to settle in full. As my account was closed a couple of years ago they'll send a cheque which may take up to 10 working days to arrive. Agreed with Gareth that if it hadn't arrived by 28/08/06 then I would commence proceedings against them. So hold out everyone going for MBNA, you'll get your money back.
  10. Barclays acknowledged my claim on 08/08/06 and have indicated they intend to defend all of the claim so I guess it's time to start getting things together for the AQ when it arrives. The saga continues.....
  11. Well nothing back from them other than standard 28 day reply so LBA went off yesterday by fax and post. The waiting continues but it'll be worth it in the end

If the charges have made you go overdrawn and the bank have charged you interest on that overdraft then you can claim back interest on the charges whilst you were overdrawn and Vampiress' excel sheet in the library will do this for you. A lot of people (including myself) have not claimed back this interest however as it is difficult to calculate and some let the banks keep this as it is fair to charge interest on an overdraft they have given you. As I undersatnd it anyway. Once you get to MCOL stage however you then add on the 8% interest from the court act.
  13. Quick update for everyone. As suspected Barclays got back to me on the last day of my LBA deadline saying that their £1000 offer can not be increased and is their full and final offer. They were very polite though and "apologise in advance as it would appear we are unable to reach an amicable resolution". So today have submitted claim though MCOL, came to a grand total of £2510.86 including 8% interst and court fees. Feeling a little nervous as Barclays always seem to defend and drag things out but I'm sure it will go the way of others eventually. Just to confirm it is 28 days from the day the claim is deemed served they have to defend isn't it? Cheers guys
  14. Sent my Data Protection Act to MBNA on 13/06/06 and didn't hear a peep out of them for nearly 2 weeks. Then got the standard "we are dealing with request you'll hear from us 28 days from the date of your letter". Charge info finally arrived on today (18/07/06) along with a goodwill offer of £110 (they took £348 from me between 2000 and 2004 before I closed the account), cheque to follow according to Steve Bailey. So today have sent them prelim letter accepting the £110 and asking for the remaining £238. They put the usual blurb in their letter about how their charges are fair as they incur significant costs when a default transaction occurs so in my prelim letter I aksed them to demonstrate these costs. Will be interesting to see how they reply. The clock is ticking!
  15. With only 4 days before my LBA deadline expires Barclays have come back with an offer - £1000 on an £1850 claim. Quite generous compared to some other peoples offers from Barclays. Needless to say I shall be holding out for the full amout and filing via Moneyclaim on Monday if they don't up their offer to the full amount! Wish me luck!
