  1. Unfortunately i've been back to the scene of the accident and there were no cameras there. It was near a set of traffic lights on a main road not much on either side.

  3. I haven't actually taken any pictures and neither has a garage. Do you think this might help? I was wondering if I could ask to be sent the 3rd party accident statement so that I could potentially scrutinise it (do a bit of detective work!), is this allowed? or are only the insurance companies allowed to exchange such details. Thanks,
  4. Thanks Mossy, Would you suggest that I proceed taking the 3rd party to court asap eventhough I haven't yet had the result of my claim? Also I only have the 3rd parties name and work telephone number, would I be able to issue the proceedings at his work address?
  5. Hi All, This is my very first post on this site hope someone out there can help me out. I am insured 3rd part fire and theft with NO legal cover. I had an accident about 3 weeks ago when I was stationery in traffic and a Van hit the back of my car (and passenger side corner of the back bumper) . At the time I only took his details down thinking this will be a straightforward case because my car was hit from behind. Prior to the incident I could see from my mirror the van was actually trying to prevent a 3rd car from coming into the space in between our two vehicles and in doing so hit my car. I even asked him and he confirmed that was indeed what he was trying to do. Having taken the 3rd parties details (its a transport company) I then reported the incident to my insurance company and also began to search for an accident management company that would deal with the case on my behalf. I decided on Accident Exchange (based in Northampton) on the basis they returned at the top of a google search. They assured me it was a straightforward case and I had nothing to worry about. A week later I had a call from my insurance company advising me that the 3rd party was now disputing the case saying that I was changing lanes at the time of the accident and he could not prevent himself from going into the back of my car (cheeky bugger!) and that I should complete the statement of accident and return. This got me worried so I contacted Accident Exchange, they were unable to confirm what my insurance company advised me (the third party statemtent) and were having problems contacting the 3rd party so continued to advise me that there was not a problem and this was a very straightforward case. At this point I hadn't signed anything neither had the ACM provided me with a car (which they said they would) as they were waiting for the 3rd party to admit liablility. Last week I received a call from the ACM to confirm what my insurers had told me and stated that they could no longer resprent me on this case as such cases most likely are split liability (50/50) because it was his word against mine (there were no witnesses). I am really worried as I don't want to pay out excess and having the worry of paying an inflated premium come next year. The 3rd party seem to be very clued up in terms of how to proceed with such matters however in my 10 years of driving this is the first occurance for me. How should I proceed? I feel very strongly about not giving in and would be prepared to 'fight all the way' however I am aware of how much legal representation can cost so would appreciate advice from members on this board.
