  1. Hi, been offered 1 hours work a week self employed at a rate of £20. I need to know a few things - how will this affect my JSA when I declare the work? and how do I declare this? I've never been self employed before so need to know what to do regards taxes/NI too. I know I'm asking a lot here but I want to work and in the current climate self employed may be a way to go.     My answers to the three questions asked by DMA. Lets see if they sanction me! 1) Why did you not provide the provider with ID to prove your right to work? I DO NOT HAVE TO PROVE TO THE PROVIDER THAT I HAVE A RIGHT TO WORK. THIS IS A MATTER BETWEEN MYSELF AND THE RELEVENT GOVERNMENT AUTHORITIES. THE MERE FACT THAT I HAVE BEEN MANDATED ONTO THE WORK PROGRAMME WOULD SEEM TO INDICATE I HAVE THE RIGHT TO WORK! IN SPITE OF THIS I SHOWED THE PROVIDER MY SIGNING ON CARD, REFERRAL LETTER AND I EVEN GAVE THEM SIGHT OF MY BANK DETAILS BY SHOWING THEM MY BANKCARD. THIS IS ABOVE AND BEYOND WHAT IS REQUIRED TO PROVIDE MY IDENTITY. 2) Why did you not sign the Data Protection Consent Form? AS PER MY LEGAL RIGHTS AND THE DWP GUIDLINES TO PROVIDERS I DO NOT NEED TO EXPLAIN MY DECLININING TO WAIVE MY RIGHTS UNDER THE DATA PROTECTION ACT. THE FACT YOU ASK THE QUESTION IN THE FIRST PLACE IS GROUNDS ENOUGH FOR A COMPLAINT TO THE ICO AND/OR THE DWP. 3) Why did you not let the provider keep or copy your CV? I AM ONLY REQUIRED TO SHOW THE PROVIDER THAT I HAVE A CV. I GAVE THE PROVIDER FULL ACCESS TO MY CV DURING THE SESSION. LEGALLY I AM NOT REQUIRED TO LET THEM HOLD OR DUPLICATE MY CV. AS PER MY LEGAL RIGHT I HAVE DECLINED TO ALLOW THE PROVIDER TO DUPLICATE OR KEEP MY CV. Lets see how long they take to reply. I'll let you all know how I get on. Thanks to everyone who has commented and provided details (and template) for my reply.

    @ Bakatcha I better deal with it - I really don't have much to fear - worst they can do is stop benefits and then I win appeal. I understand that could be a long battle but as long as I'm within the line of the law. I just won't expect any apologies. Hopefully the job I've got will hurry up and get me a contract and start date. I really want to get going with that. Its not worth me relying on their computer glitches.

    Yip - thats what I'm going to do. I'll put my responses up later when I've finalised them. Only problem I have is with the end you provided to question 1 " At the time this was accepted by you as proof of my identity and of my right to work and I wasn't asked or mandated to provide any further proof..". They obviously did try to press for further ID (I even met the manager/enforcer of the place) but eventually started keying my details in the computer which I would take as them accepting my ID. Any ideas how I can change that?

    Amazingly its the JCP who are asking for answer to those questions - its sad their staff aren't told clients rights.

    Good news - I hopefully have a job - awaiting contract - hopefully it wont fall through for any reason. I'll need your help for signing off ensuring they don't get paid. Bad news - that could take a few weeks and I've just been sent a letter stating that I attended the work programme but failed to participate in it. They've asked me to answer some questions or I'll be sanctioned (I obviously need money to continue my job search in case that contract does not come through). Can you guys help me answer them in the best way possible? 1) Why did I not provide the provider with ID to prove your right to work? 2) Why did I not sign the Data Protection Consent form? 3) Why did I not let the provider keep or copy my CV? As I understand the above questions are on pretty dodgy ground and I could probably fight them on the basis of the questions. My answers at present are 1) I gave the provider my signing on card, referral letter and even let them see my bank card. 2) As per my legal rights I do not need consent to the data protection consent form 3) I am only required to show the provider I have a CV and legally am not required to let them hold or duplicate my CV. What do you think of my answers and how could I answer them better. I understand even if I give them the correct answers they are likely to try to sanction me.

    Hmm had an early interview with them yesterday. They are really jobsworths with no plan B if you don't sign their forms etc. Didn't sign DPA waivers and provided my signing booklet and referral letter as ID. Stated that any funding they provide may be affected by not signing the DPA waivers (not my issue). Absolutely hounded me for an email address as I can't sign onto their special system which has jobs no one else has without it. After ten minutes I set up a new hotmail one that I stated would only be used for the purposes of logging onto their system. They refused to accept my as it wasn't what they were looking for - driving licence, birth certificate, etc. They wanted to know if I had a bank account - I said yes my JSA gets paid into it. They wanted proof. I showed them a bank card to end the questioning. I showed them my CV and declined to give them a copy. Apparently now my work advisor will be setting up a new one with me unless I give them a copy. In the end they let me go while they work out what to do with me. Any idea why they are after my ID? I take it what I provided as ID will be fine? Have I messed up by providing an email address expressly for the purposes of logging onto their systems? I take it if they force me to write another CV I can decline to let them keep it and would be within my rights in telling them that before they made me set it up?

    Great advice. Registered my interest for some volunteer positions (which are actually more demanding and useful than basic jobs - actually help me get a half decent job). Got asked to fill in two forms when I visited. One was a data protection consent form and the other a consent to share form - I presume I protect my DPA rights by not signing/completing these? and I will be within my rights - no sancations etc?

    Right. Got an appointment with one of these places next week. I've read about ten pages back and its pretty scary what goes on. I need a quick guid know what to do/not to do. I think I may have signed one of those waiver forms when I last signed on but am not sure - is it the job centre that gets you to sign them?
  11. Hi, First time I contacted halifax and asked for a CCA they sent me out my most recent statement. When I sent a chaser letter they replied with a reconstituted copy. They state on the letter - "The copy of the agreement enclosed with this letter complies with the requirements of the consumer credit (cancellation notices and copies of documents) regulations 1983 (the "regulations") regulation 3(2)(b) provides that a copy can omit any signature box, the signature or date of signature. In summary we are not required to produce a copy with your signature on it. by providing a copy of the agreement we are complying with the requirements of the Regulations the agreement remains enforcable. By providing you with the documents attached to this letter, we have satisfied our obligation to provide a copy of the executed agreement under section 78. As such the agreement you have with us is fully enforcable and we shall continue to treat it as such. We will not be entering into any further correspondence with you regarding the requirements relating to the provision of copy agreement." Ok so where do I go from here? they admit they have sent a reconstituted version. What do I do now? I am based in Scotland - how does this affect what I need to do next? Thanks

  13. Ok call me silly I'm a newbie round here - whats incorrect with that CCA? - I've got the same one - and its pretty illegible too.
