LOL! Thanks - I think what I'll do is CCA my 3 cc's & see what comes back in the first instance. Given that MBNA have already made a reasonable F&F of 35% if the CCA came back & was dodgy does that put me in a position to 'barter' for a lower f&f? One last thing , I promise, will it do any harm requestin the CCA for each of my CC's? Cheers, Leigh

Ok, thank you. I've read lots of posts on here stating that an unenforceable CCA does not mean the debt is written off & people talking about full & final settlements. Why would you make a F&F if the CCA was unenforceable? Also, if it was unenforceable why would the cc company take out a CCJ? (SO sorry if the above are stupid questions - v new to all this:-|) Many thanks, Leigh

Hi sliverfox, This is exactly what my husband said..............I take it there is no harm in asking for the CCA to see if they have a valid agreement? I 'guess' the offer is as they can see thru PayPlan I have a lot of debt & small income presently. How would you suggest I proceed - if the agreement were unenforceable what kind of % could I expect to pay do you think. Many thanks, Leigh

Hi I'm wondering if some of you can give your opinions on this for me please? I currently have a DMP in place with PayPlan for various debts I, unfortunatley, have & pay MBNA £95. They have frozen interest & charges. They, of their own accord & without going down the CCA route etc have offered me the option of paying about 33% of the outstanding credit card debt. Outstanding balance = £11,230.97 F & F Settlement amount = £3,798 I have no idea if this is a good offer or not, it sounds like it to me. So my question is, do I accept this or go down the CCA route in the hope of them accepting less IF the CA is unenforceable. Any thoughts greatly appreciated, Leigh

Hi I've just amended the CCA template letters on here to send to my 3 CC companies. Am I right in saying I should NOT sign it? If so do you just leave it blank? cheers, Leigh

Hi, I wonder if anyone has any experience, good or bad, of Kerobo Claims for overturning credit card debt in respect of cards taken out before April 2007. They have looked at 3 credit cards for me & one loan and come back saying they believe there to be several breeches with the credit card agreements. (They stated the NR Loan agreement was enforceable) They charge £395 + VAT for each case. I would REALLY appreciate some advice. Warm regards, Leigh
