Additionally, where there has been any event in my account history over this period which has required manual intervention by any member of your staff, or any other person, I require disclosure of any indication or notes which have either caused or resulted in that manual intervention, or other evidence of that manual intervention in relation to my banking business with you. If you are unable to supply this data because there has been no such manual intervention, then please be so kind as to confirm this in your response. I enclose the statutory maximum fee of £10. You have 40 days in which to comply.   3. They should accept a normal letter by rights, just ask them to confirm the amount owed. State that once you have received this you will sort out a payment that you can reasonably afford. It is sad but true that the majority of councils now pursue people even to them going down the route of the courts, even then the courts will only make a person pay what they can reasonably afford. All utilities, countil tax, mortgage etc., should come first before any other debts that you may owe. I was unemployed earlier this year and applied to my local council for benefit, no problem, then I got another job told them about it as soon as I started the job, now some 6 months later I get my new bill for the rest of year 3 months at £95 pm month more than I was paying before. They won't let me pay this extra £285 over the next year even though it was their fault as I informed them when I started worked again. Just goes to show how useless a lot of the councils are. SD
  4. I know it worrying but help is at hand. Its a long way off court and if a claim is made you will get lots of help from all the caggers. If it went to court a judge would only order you pay what you can afford even if its only £1. Don't speak to any of the low life on the phone it is their chance to try to intimidate, scare and force you to make some sort of payment. Get the telephone harrassment letter off immediately make sure any correspondance you send to them states communincation only in writing. If your with BT ring them up and get your number changed and go ex directory it can be done within 24 hours and you even get a choice of phone numbers you can have and then you will get peace and quiet, the only calls then would be from your family and friends who you give the number to. I did that and the calls stopped immediately. I have had only one creditor take me to court so far and that was struck out with the help of the caggers. SD

Ring CCCS up and tell them what is supposedly going to happen on Friday if need be see if you can arrange with CCCS to take the money January instead of December gives you more time to sort Shop Direct out. You can then also just send token payments to your other creditors for Dec with a short note to say that the there has been a problem setting everything up but that the plan should start in Jan. I did this when I went with CCCS back in April last year and all but one was fine with it and the one that wasn't happy about it still only got a token payment. I would also have thought that you would need to agree to Shop Direct taking money out of your wages. As above if you have a contract for your staff discount check it out. I don't think that there's much else you can do until your HR get back to you. I would suggest you get a direct email address for HR they must have one or someone higher up to get this sorted out for you. Are you near to the offices if so call in and say you want to see someone there and then. Make sure you inform CCCS about this situation and also see if they can get through to them on your behalf as you are not having any success. SD

  7. If you've sent them an account in dispute letter then it is up to you whether you stop payment to them if you haven't already. Unless the debt is in joint names then they have no right to your partners details of income. You could send them a reminder that the account is in dispute and also refer to your previous letter regarding writing off the deebt and enclose a copy of that letter then wait and see what response you get. That's what I'd do but it is up to you. SD

Here's the telephone harrassment letter Harassment by telephone Account Number: XXXXXXX I am writing in relation to the quantity and frequency of telephone calls that I have received from your company, which I deem to be personally harassing. I have verbally requested that these stop, but I am still receiving calls. (delete if necessary) I now require all further correspondence from your company to be made in writing only. I am of the view that your continued harassment of me by telephone puts you in breach of Section 40 of the Administration of Justice Act 1970, and the Protection from Harassment Act 1997. If you continue to harass me by telephone, you will also be in breach of the Communications Act (2003) s.127 and I will report you to OFCOM, Trading Standards and The Office of Fair Trading, meaning that you will be liable to a substantial fine. Be advised that any further telephone calls from your company will be recorded. (Even if you don‘t yet have recording equipment!) Yours faithfully You will get help from the caggers with claiming charges back, I haven't gone down that route yet but I will be doing soon. Have you signed up with CCCS or Payplan as you will find most of the time that most of your creditors will stop interest if you are with a Debt Management Co., (DMP). Keep making the £1 token payments. I would still be inclined to CCA all of them. The main thing at the moment is that the mortgage co., are trying to help. Have a read of some the threads about claiming back charges and also have a read of the template section about the different letters you can send. Hang in there someone will be along soon with help over claiming the charges back. Did you have PPI (payment protection insurance) on any of the cards etc., and if so did you make a claim on any of them.   11. Personally I'd just ignore them and wait for the doorstep visit. They have to prove it's you that's opened the account not you to prove you haven't. I'm sure that if it went as far as court it would be laughted out of it. You've the proof that you details were used illegally so tell them to sxx off. SD
  12. The vans detect signals being sent to TV sets, they can actually tell you what you were watching. They know what addresses are occupied and if you've not got a licence they want to know why as they don't believe people don't have TVs. When my son moved into his flat he had a call saying you haven't a licence he said I don't have TV so let them and of course he didn't have TV he hadn't got round to buying one. Needless to say no apology just good bye. I doubt if your monitor would be picked up but the equipment they use is very state of the art stuff. SD

  14. This company charge a document fee up front. You then pay a set amount per month which goes into a savings account. Letters go out to all creditors after the first months payment. CCA letter request 1st, you get the CCA sent to you which you forward onto first step. It is then checked by their legal department for any errors, if unenforceable further letter to sent to creditors from the legal team, if no CCA received within time limit into dispute it goes and so on. You pay separately out of it for any CCA/SAR requests etc., Creditors do not get paid anything in the beginning, if the CCA is enforceable they make them a token payment to begin with. Your monthly fee in the savings account at first is taken towards the initial costs of first step say your initial fee is 10% of the overall balance outstanding to your creditors once that is paid to first step and your savings account gets into credit they will make full and final offers to each creditor as your saving increase. In the end there is the fee they charge which is say 20% of the overall balance they manage to elimate/full and final for you. Percentage rates are just a rough guide. They are a genuine company, this solution is not for everyone however, they do not guarantee you will not get taken to court or receive CCJs etc., but have a good legal team who will do your acknowledgement of service, witness statements etc., for you. They do have a very good success rate. Anything you receive from the creditors are forward to first step in the prepaid envelopes provided. Any calls received you just tell them to ring first step and they deal with the creditors. Yes you will still get phone calls from creditors but just as you can do your own harrassment letters first step do that as well. They do take a lot of the stress and worry from you however. At the end of the day it is your own choice if you go with them or not. However, on the forum you get all the help from the caggers who have gone through all this themselves like myself and have still won and it has only cost you a little time and effort to do exactly the same as first step do for you for a fee.   15. Natalie If they have branches or associates outside of the UK they can obtain your number that way because you are only ex directory in this country that's how they got the number. I was told this by BT when I complained that one of my Creditors had obtained my new ex directory phone number. This particular DCA took me to court and on my acknowledgement I made it clear that my number was ex directory and they had no right to use it, I didn't have another phone call from them. Truecall is a great tool if you can afford it. SD
  16. Dead right as angry cat says report the lowlife monkeys. I must admit they have left me alone for sometime now but I know it's only a matter of time before they start it up again with me in fact I'm suprised they haven't yet as I've reduced my payments (payments which I still make to GE so time will tell).   18. Putting an account in dispute which you pay through a DMP may not go down to well with the DMP Company some of companies want to stop dealing with you. SD

  20. Hi Good place to go is CAB they know all the things you can claim. I know of lots of people who have gone there and found out there was loads of other benefits which they were entitled to but never even knew about. SD
  21. Hi Just need some help with logging onto forum with my other user name so just registered with another user name. Not been able to do it since changing my email address and what makes it worse I can't remember my password either dumbo I am. Have emailed request a couple of times in the past 2/3 week for help when trying to log on but so far I've not had any response. Thanks folks
