  10. Court date set for 5th March 08. Have to file bundle by 14 days before hearing. Have to file witness statements by 18th December.
  11. Hi Hills, I am claiming PPI back from HFC/Beneficial and have a court date set for 5th March 08. Have you started a claim yet? hows it going?
  12. Hi there, There don't seem to be many people trying to reclaim missold PPI from HFC, now Beneficial Finance from what I can see. I have a date for my hearing now and I would like to know what they are likely to do. I am fully prepared for the hearing but was wondering how they usually operate? Any advice greatly appreciated. Thanks
  13. Hi, I have lost touch with what has been happening lately and was just wondering if any of the banks/building societies/credit card companies are still settling claims out of court? I know some have applied to put claims on hold until the test case is decided in a few months, but have all done this? or are some still being reasonable? Thanks Anna
  14. Something along the lines of...they are not taking it seriously because they just filed a standard bank charges defence instead of ppi. They refuse to communicate with me and are obviously wasting courts time. They have no regard for courts time etc. They wrote to me this week to ask me to accept their new defence inorder to save time and costs etc...cheek!

  16. Hi There, This thread is all about PPI now - can a mod please move it to the PPI section for me and maybe change the heading to "Beneficial Finance PPI claim"? I am in court next Tuesday for a hearing about whether the court will accept their new defence. (The first one they filed was in relation to bank charges - silly BF). I had asked for it to be struck out and the hearing is to make a decision on that. Some advice for my hearing next week would really be appreciated! Many thanks
  17. HFC filed a defence to my PPI claim but it was in defence to bank charges! I have read that a bank has done this before and they got their defence struck out but cant remember which thread it was - can anyone remember? I have submitted a claim for their defence to be struck out but have not heard anything yet.
  18. I recently wrote to them to ask for proof of the other costs they added onto my mortgage account totalling £3500. Such as repairs fees, litigation fees, etc. Well today they emailed copies of various invoices that show these figures so I guess thats the end of this case. They have proved they incurred these costs so I accept that. Im going to forget about the ERC unless there are any further developments in the future.
  19. Abbey settled my 'admin charges' but they wont budge on the ERC. Well its a small victory at least!
  20. OK. I have had 2 replies from HFC stating that I signed the legal agreement to confirm I understood the loan agreement and PPI Insurance etc... I have told them that the fact i signed it does not prove I UNDERSTOOD it... only that I understood where I had to sign in order for the funds to be released! Im losing patience with them - any suggestions? I filed a claim online a few days ago. They are keen to keep telling me they dont want to refund my PPI...well at least they are communicating, unlike other banks!

  22. I am trying but am worried - why are they writing to me?? apparentely when someone else searched for him he came up at my current address!! We havent lived together for 7 years and I have moved house 6 times.
  23. Anyone heard of this? Called themselves 'MCS Courier Services' but wouldnt give me any information because they were looking for my ex. Very suspicious tale the man on the phone gave me, apparentely they have a parcel for my ex and tried to deliver it to my old address and were told to try my new address. They posted a postcard addressed to me, with "please ring x on 01xxx xxxxxx" handwritten on it. What do you think??
  24. Had a reply from Egg today they have now refunded the remaining ppi to my account, apparentely when i fell into arrears some of it was refunded as the policy was cancelled. I need to check their figures but they say they have refunded £868.68 to my account and they hope that brings my complaint to a close. Didnt take as long as i expected, they caved in very quickly, and after only 2 letters!!
  25. Well Egg have replied by sending me a copy of the agreement that I signed, (which I already have). They said that because we signed the agreement this confirms we asked for PPI (because at the bottom it says "by signing this agreement you confirm you have read and agree to the terms and conditions and the payment protection policy terms and conditions". They also pointed out I am legally bound by its terms because i signed it! What do i do now? start a court claim? complain to oft?
