  1. Hello I wonder if anyone can help me. Ive been receiving calls to my mobile phone. The call rings three times then stops. This has happened a few times to i contacted the number to find it was from a company called AIC debt collectors chasing a Finance debt for a company that i used to be a Director for. Back when i was a Director i took out a Lease Purchase agreement with Lombard for a Van (as the company is a valeting company) The agreement is in the name of the Company. This agreement was solely on the van and no personal guarantees were signed by myself. Three years ago the company hit financial difficulty and a couple of payments were missed so Lombard who where extremely unhelpfull took the van back. The company was at the time going to take legal action against them on the grounds of loss of income as we had attemped to pay back the defaulted payments and there was £54 oustanding left to pay which lombard refused to accept any further payments. Lombard have been sending letters to the company chasing the remainding balance which was £2000 since they received the Van back. Because we felt we were unfairly treated we refused to pay as we were prepared to continue paying our monthly payments and keep the Van which was the companies livelyhood which they had refused. Anyway the company battled on and was able to get another Van with another bank. It is now doing a lot better than 3 years ago and I've now sold this on to members of my family. I'm now being told from this company who i have no idea how they have got hold of my personal information that i signed a personal guarantee for this van which i did not. How can i take action against these bullys with regards to data protection. I've already made a complaint to Offcom with regards to cold calling.
  2. Thats very interesting because when i spoke to Link a couple of days ago, they told me that they are just a service company to Lombard and don't buy debts off them. We are currently looking at finding the finance for the Van. We may have to take this to court as Link is stating that the balance is 6k but that also includes all interest for the 2 years that we would have had left if the aggreement hadn't been terminated. Are you a limited company? Have you got any personal guarantees on any of the loans?. If we do have to give the van back then we will have to put are company in liquidation. The only good part to that is that we know that Lombard will loose 4k.
  3. The debt has been passed on to Link Financial and we are still waiting for them to get in touch with us. Does anyone know if they offer repayment plans to cover what's left on an agreement.
  4. We are a small valeting company which took out a Lease Purchase agreement with Lombard for are Renault Traffic van. This agreement is over 5 years. So far we have paid 3 years of this agreement off and had never missed a payment until March this year when one payment was missed due to another payment leaving our bank account at the wrong time. We contacted Lomard immediatley regardig this missed payment and spoke to one of there advisers who split the payment onto our next two months on direct debit. We thought that would be the end of the matter, however two months later we received a call from lombard stating that the adviser we had spoken to had left the company and didn't set up the direct debit facility correctly and admited it was there fault and they were to blame for the arrears we accrued. therefore not only did we owe the one month missed. We now owed 3 months as well as the current month. Since we are a small company we do our accounts on a quarterly basis therefore were not aware that the direct debits hadn't been taken. At this point Lombard demanded the money upfront which we have been unable to do. We wrote a letter of complaint to them which they never responded to. We finally came to an agreement after numberous phone calls to them of these payments being paid over the following 3 months. We were able to keep this up for the first two months but were unable to manage to pay the balance outstanding for the 3rd month as well as are normal payment and had to spilt this up and pay it over another couple of months. We have continued to pay lombard every month as well as anything else that was outstanding. We have been paying this by cheque every month as we have now had two occasions where lombard have not set up our direct debit facilities correctly and therefore not taken payment from our account. We have recently received a letter from lombard terminating our agreement with them and stating that they will be collecting the van in due course. This is the first letter we have received with regards to this and when contacting them we have been told to contact a company called Link Financial. On contacting Link Financial they at present do not have any record of our company and we have been told to wait 10 days before anyone will contact us with regards to this matter. We are looking for advice as to wether we can take legal action against lombard with regards to this matter as if they do take possession of our van it will mean that our company will no longer be able to trade. Also there must be laws with regards to data protection. Any help with this matter would be greatly appreciated.
  5. Also we are trying to fight to keep the van or know what are legal rights are as since Lombard have cancelled our agreement and it has been passed to Link we don't know where we stand.
