  6. recived a letter today from direct auto finance-- without prejudice to our legal rights they are taking the £15 off for the letter they sent as payment was late. sent a letter yesterday for £275 for these £15 letters asking for it back wait till they get that one.

  8. hi wrote a letter to direct auto finance about the £15 letter charge and that it dosent cost them this to send it.they replied saying it wasent a penalty charge but a liquidation charge so did a search on it found this gonna put it in my letter to claim back. . However, a liquidated damage clause will not be enforceable where it constitutes a “penalty”. The leading case on this point is Dunlop Ltd v New Garage Co Ltd (1915) AC 79, which laid down the principles what is a “penalty” in this context. heres the link.Prettys Solicitors hope its of help.

  10. surely you can claim back admin fees this is what they have charged me while in arrears at £40.also i seem to be in arrears alot and i dont know why as always payed by credit card and always asked what the outstanding was on account and payed it. according to the dpa i got today im nearly always in arrears guess im gonna check it against my bank statements.

  12. sent first letter to ge money for list of charges got no reply in the 40 days.sent second letter saying they were in breach of the dpa and had 14 days to reply.got letter today with all there crap about what it covers also about redemption fee if you settle your account early its to recover there set up fees?how can this be when they charged me a set up fee when i took the mortgage out.im going to write and tell them this,what do i do about the list of charges they havent sent thanks.

    mbna have paid me £910 so far but have credited it to my account which there is only a balance of £200, i cant use my card havent been able to use it for a couple of years,so wrote letter accepting that amount and to pay balance off and send me a cheque for the rest then i shall go after the rest they owe me.

  18. got letter today from marks and spencer saying they find the charges acceptable and will not refund.however they have said they are dropping there charges inline wth ofts change in the market practice.so im of to do my lba letter.

    sent dpa letter recieved information sent lba letter on 7th july with 14 days to respond, recieved a goodwill jester of £100 for £2000 charges sent letter of turning this down and they had 12 days left to respond to gareth.got letter today saying they will respond in 28 days from rachel.do i sent another letter or just wait.

  21. got letter today after sending away for 750 plus the 8 per cent bearing in mind they owe me over £2000 but in scotland.anyway wait for it they offered me £100 credited to my account only 250 outtanding on it as goodwill and a letter full of why they dont have to .should i reply and say i will report them to the commissioner.says that in section 3b of your agreement with us clearly states that u must pay £25 each time your payment has not reached us.so do i send a letter saying they only have 10 days left out of the 14 days to settle in full or i shall begin action.
  22. sent letter away asking for statement for last 6 years with chq for £10 and account number on letter.got letter bak saying they have no record of my card asking where i got it the date i got it as if you can remember that so sent them a statement. time is ticking for them that was sent on the 7th of june.so even thou they say theres no record and have replied when the 40 days are up they are in default.
