  1. yep i spoke to consumer direct and they have advised to write them a letter but the template they have advised is based around a faulty product and im not sure how to adapt it. was hoping for a more specific "breach of contract/policy" type letter
  2. yep its actually the store manager that is digging his heals in. there appears to be no way above him either. if i phone there customer services they tell me its down to the store. if i ask the store if they have an area manager etc they say no (of course) ive put it in writing but it sounds abit crap and i feel they will just throw it in the bin
  3. do we have a template letter i can use? how do i return the phone when they wont accept the return? plus i need them to refund the initial outlay of £69 thanks for your reply

  5. Hi guys and girls please help. where do i stand when a branch of three (mobile network) high street store refuses to honour their returns policy. Today i tried to return an iphone that i took out on contract yesterday and was told that they wont accept the return. Despite it saying on a card on the assistants desk that as long as you return within 14 days and the item is as new they will cancel the contract. (i have attached pic of this returns policy card) I also phoned three customer services from the shop and they told them they should cancel and refund but they still refused. and in addition to this on the back of the contract it says "in the unlikely even that you change your mind about your purchase you may return your handset to this store within 14 days provided that the handset is as sold and unused. This means that must not have been activated and personalised the handset by inserting the sim card and turning it on" i cant believe they are so adament despite it being in black and white everywhere. what can i do when talking to the customer chap on the phone i said can i escalate it but he said i have to do that through the store. which is a no go because it is the manager of the store refusing to do it. what is my next step? thanks kev
  6. thanks simon, so will the accounts not show on my file whatsoever? even if im still paying them off? or is it just the default that is removed and the account will still show but in green?
  7. yep thats right, as said in my initial statement. The movie they say was never returned was Toy Story 2. There is only 2 of us in our house myself and my partner. We still have the card and neither of us would hire such a film and we dont have kids. I know from experience though. If you forget your blockbuster card they will find you on the computer and let you rent it out without your card so it wouldnt surprise me if someone found the wrong account. To be honest though, if they have the ability to affect my credit report i will just pay it off. Although it makes my blood boil its not worth the risk of me losing a house i really want for the sake of £48.
  8. thanks for your quick reply. so there is no way they can come back and bite me in the bum. 1)for example my partner has a loan with an outstanding balance of £7600. It defaulted in june 2007. We are now paying this through a debt management plan at £100 a month so in 3 years the default will have been removed but the balance will still be approx £4000. How will this show on my credit file. Will it show as a good credit account in all green with an outstanding balance of £4000 and no default. Or will it disapear completely from my credit file? 2) The original quote that raised this doubt was from a member of the site team so it was a respected member and he mentioned them reapplying. Whether rightly or wrongly, is this something that happens and is it easily challenged? please help as i'm getting excited about our plans but it will all be to no avail if we are unable to get a mortgage.
  9. Good Evening all and happy new year (little late i know) I have recently posted a thread and received the reply below which has raised a few doubts in my mind. First of all though i'm not finger pointing at the person who said the reply, i thank them for taking the time to reply and answer my other questions but i just wanted to take this particular point out of previous thread so it didnt get confusing and to clarify things. The statement has worried me slightly. Myself and my fiance have a few defaults on our credit files all of them at least 3 years old. Therefore how i understand it if we keep our noses clean for the next 3 years and only build good credit i.e i have a vanquis credit card that i religiously spend £500 every month and pay it off in plenty of time every month. This will result in a credit file that doesnt show any defaults and a healthy ability to maintain credit accounts. Am i correct in thinking this as the above reply seems to suggest that the creditors have the rights to renew the defaults and ruin my credit history again. just to be clear, of the defaults only 2 of them havent been settled both of which are being paid through a CCCS dmp and may even get settled in the next 3 years. I really appreciate anyones help as we have a 3 year plan to hopefully finance a self build project and its all pointless if we arent able to get a mortgage to help finance it.
  10. i am just worried that it will affect my credit rating and thus stop me from getting the house/mortgage i want. I see it as abit of a grey area because its not like a credit agreement where you take goods and have to sign a contract. With blockbuster you sign to open the account (which i did approx 8 years ago) and then you just take dvds as and when paying cash to do it. Therefore i feel like it could be seen as a credit account but how can they prove it was me that took the DVD because you dont sign to take them out. I will contact them by letter but i wanted to check her first whether they can actually affect my credit rating. That is all that matters to me. I dont see why i should spend my time explaining to them why i dont owe them money. But this will be time well spent if it stops me getting a mark on my credit history. If they cant then i wont waste my time. I have checked my credit file and its definately not showing on there yet as of last night. The only things on my credit file are long term contracts such as overdraft, mobile phone, mortgage, hire purchase agreement etc. None of these are anything similar to a blockbuster account so i thought it may not be able to affect it.

  13. Hi guys and girls, My fiance and I are trying to clear up our credit histories with a view to remortgaging in 2-3 years. We have 5 defaults between us which will come off by then so we are very keen to keep our noses clean in the mean time. However i have recently received a letter from blockbusters stating that i owe them £48 due to a movie (toy story 2 dvd) being unreturned. I have never rented this movie and dont have kids so i believe its been put on my account by mistake. (I havent used my card in about 12 months but i still have it so it hasnt been stolen). They have sent me letters about it but i have thrown them away thinking they were junkmail as i havent used them in so long. I have opened the recent ones as they are red and from a DCA. I have contacted them by phone and told them that i am not acknowledging the debt and have never rented that DVD. They said that they will take me to court over it. Would a blockbuster account be classed as a credit account? could they make an entry on my credit file over this? i really dont want to pay them £48, i know its not a massive amount but its money i dont owe. If they have the power to put a mark on my credit history however i will pay the £48 just to be safe. Please help!
