  1. Hello,

     

    I recently took on a permanent contract with a company and worked 5 days before resigning.

     

    They have told me i will not be paid as i should have given 1 weeks notice and because i didnt they have used this against paying me.

     

    Now, i was sure no notice was needed in the first 4 weeks but silly me, i have thrown the contract away.

     

    can the employer withold my pay and do i have any leg to stsdn on or should i just dismiss as a costly mistake?

     

    Luckiliy i have since returned to my old employer.

    I refer to your letter dated.................where you advise you have been unable to uphold my complaint referring to being misold PPI.

    Unless you have an actual transcript or recording of the actual telephone conversation whereby I AGREED to have PPI, you are relying upon 'pure speculation'

     

    Therefore i am requesting prove this recording as you are purely guessing this advise would have been given. You need to product the PROOF you are relying upon forthwith as no tape recording was provided on my SAR request via Arden Credit Management who are chasing the debt.

     

    I now look forward to resolution of my complaint within 14 days before i approach the ombudsman.

  3. ok, i have typed up a challenge letter.

    will this suffice or is there anything else i need to add?

    im not too good at typing these letters an have copied from previous posts. apologies!

     

    Dear Sir/Madam,I acknowledge your letter dated .................... where you advised there is no case of failings for the ppi cover

    and that everything was covered in the initial telephone call.

     

    I disagree and make the points below.

     

    1. You advised that the agent on the telephone call would have given me all options and not pressurised me into taking the ppi.

    It was not fully explained that this cover could be bought elswhere and i would not have paid for the cover in the knowledge it would add £2k to my debt.

    I was in full time employment at the time the loans were taken out with yourselves and I received employee benefits

     

    2. I was not aware PPI was included in the amount I was paying, the process as I thought was signing the loan documents and this was the amount I had to pay for the loan.

    If I was informed that it was optional I would have opted out.

     

    3. I would suggest unless you have an actual transcript or recording of the matter IT IS unfair for you to introduce 'pure speculation'

    I sent a SAR request to the debt collection agency and no tape recording was included.

    I would like proof of this recording as you are purely guessing this advise would have been given.

    If your advisor acted fairly, as you say, then there would not have been PPI on the loan because had they been fair they would have explained there was PPI on the loan

    and that it was optional, but because they did not do this I have ended up paying for PPI I did not want or need

    and would not have signed up for if this had been explained at the time of the loans.

     

    For the above reasons and those mentioned in my previous correspondence I am requesting a full refund of all my insurance payments.

     

    I reserve the right to take further action and will allow a time period of 14 working days for your reply.

    5 months down the line,

     

    Arden have been kept quiet with the minimum payment but

     

    RBSlink3.gif who administor their PPIlink3.gif reclaims have refused the PPI request due to my friend being fully aware of all terms nd conditions.

     

    they have also sent him the PPI booklet which he did not receive.

     

    Obviously i want to challenge this.

     

    do i send the challenge to RBS or Ombudsmanlink3.gif first.

     

    any idea on letter templateslink3.gif please?

    i'd pay a token amount by bacs

     

    do as post 34

     

    just write that you dispute the outstanding balance of the account

    in view of this, and servere financial hardship, token payments of £10PCM will be made

    by your internet banking site until the PPI matter is resolved

    and a true balance is known.

     

    From the date of this letter your DD against A/C no. has been cancelled

    and i have instructed my bank to refuse to honour any subsequent requests for payment

    without my express written consent.

    Following your recent communication, i dispute the amount of money you are claiming i owe therefore i advise you this account is now in dispute.

     

    There amount of money you are claiming includes PPI of which i believe i have been mis sold. Having read through the statement you sent in May, i believe i have paid this debt off and am now ceasing payments with immediate effect.

  8. Hi my claim for ppi from citi financial was upheld. I have been waiting for my cheque and it is over the 15 days time limit stated on letter, I have contaced citi financial on a number of occassions, once stating cheque was dispatched on 4th october. I have contaced them everyday amd get a different story from signuters not being recieved, when they have already stated they have everything required. The telephone number is for a call centre so find it hard to get speaking to same person, feel this is very unprofessional....has anyone else have similar dealing with citi or can offer advice thanks

    Seems i have the same issue as you! they have not sent a cheque yest but state my acceptance letter was received on 17th October. 2 more days before the 14 days is up.

  9. ok, sorry for delay DX. I now have the paperwqork in front of me.

     

    The CCA has agreement signed for Oct 2004 total amount to pay is £12,176.40.

     

    Breakdown is £8500 loan, ppi £1942.14, interest charge for credit £1734.26.

     

    He then has a full statement of all payments made, first by dd to Lombard then reduced payments to arden following defaulting in 07.

     

    I have calculated he has paid £8859.12 using the statement arden have sent, but the statement shows balance left to pay £8126.10 and no mention of charges.

     

    Im baffled as to what to do next. he has paid the amount borrowed and a bit more.

     

    OK, im back with this debt. really am struggling to get scanned.

    i am trying to get a relative to set up as PDF then mail to me to upload.

    as you can see by time of last post, im still waiting.

     

    Ive got further info.

     

    on his Credit file, the debt is logged as owned by idem (arden) with a default date of June 2007.

     

    he has had a further letter asking for inc0ome and expenditure form although he is still paying Arden £100 per month.

     

    We need to do a PPI claim but i am still unsure of what to do.

     

    Do i?

     

    1. Send PPI to Lombard or Arden?

     

    2. The original loan inc interest and PPI is 12k. he has paid just over 8k leaving a balance of 3700. Surely a PPI claim would wipe that out and the rest?

     

    3. how shall i proceed with this?

     

    Any help would be appreciated and i will chase scanning the docs. something required for Christmas i think is a scanner!
