June 2007 Has the claim been issued by the original creditor or was the account assigned and it is the Debt purchaser who has issued the claim. no, was assigned to cabot in 2011 Were you aware the account had been assigned – did you receive a Notice of Assignment? cannot remember. more than likely yes Did you receive a Default Notice from the original creditor? cannot remember Have you been receiving statutory notices headed “Notice of Default sums” – at least once a year ? not that i can think off Why did you cease payments:- i asked for a CCA from a previous dca - CARS in 2010 with no reasonable reply Was there a dispute with the original creditor that remains unresolved? just the original dca plu i asked for an explanation of additional charges from cabot. Did you communicate any financial problems to the original creditor and make any attempt to enter into a debt management plan? yes, originally in 2008 i was paying them via a DMP which i exited due to bad advise
  5. some info on the claim: Agreement on or arround June 2007. agreement assigned to claiment in 02/2011 therefore owes £558 plus court fee of £60 and solicitors fee £70. claiment is Cabot signed by Mortimer Clarke Solicitors
  6. ok, apologies for the amount of threads. this is a troublesome debt. ok, did a SAR and got statements going back to June 2007 but no agreement as i can remember. The debt has been passed on so many times i cannot remember. not sure on whether to dispute charges on it or whether to just pay up. i do not need another CCJ as ive just taken on a new job.

Hello all, bit of a shock i received a claim form for a Vanquis card debt circa £500. debt started from 2007 and assigned to Cabot apparently in 2011 which is the date they have registered me a default from. I must admit i have sort of ignored this one due to sorting out all the PDL ones i had. Now im worried, how shall i reply? i probably owe the money but have not paid anything since 2008/9 but not sure if i have admitted liability and certainly do not want a CCJ. Any advise what i shouls do? why was i defaulted 4 years late too?

  11. thank you DX. Regarding the money owed, would you advise to write for a payment plan or complete a form to give me more time to pay? afterall the debt i sitll need to pay
  12. secured on car for £400 with loans to go (bill of sale). not taken any action yet but have a default notice with full amount required if not paid by 28/8/13
  13. i was silly enough to take one of these loans out in March and have got myself in a mess with it. i made my first payment successfully in April but since then have made no payments. i was made redundant from my job but have now successfully secured other employment. Now i am ready to make payments but have received the default notice for arrears. the loan was for £400 and the letter threatens to seize goods ie the motor. Now, i want to make payments but want to spread over time, i also no longer have the car as it has been scrapped. where does this leave me in regards to the law and is there a form i can apply ot the court to hold action while i pay off the loan?
  14. they have confirmed a week's wage but not an amount. i suppose i should just wait but with having to wait a month in hand at my new job and relying on this payment it has left me in financial hardship. a costly mistake

Hello,i am not sure this is the correct forum but i need an opinion on returning to work.basically i started a new job 2 weeks ago and had my travel expenses paid for as i was due to be paid end of this month.However i missed the payrol cut off so will be paid end of June instead leaving me incredibly short of money and a 6 week wait for funds. work cannot pay a bridging amount.my question is will there be any support from the jobcentre or any help i can gain until im on my feet?
  16. ok they have replied today advising they will now pay me but not for another month as my letter reached them after the cut off!im happy they wil pay but shouls i have to wait another month?

  18. ok reply has come back saying in accordance with DPA etc gthey can only keep information for 6 years and to go to om budsman if unhappy with reply. does this need to be done via a form or letter? im going to read the FOS site shortly

Letter before action I am writing to you regarding your decision not to pay me my week's wages owed. After seeking advice from Acas, i have been advised you should not be witholding any such payment. Therefore i ask again for payment of dates worked from..............to.....................inclusive are paid to me by ...................or i will start ET proceedings. Yours Faithfully
  22. yes ive sent a lettert asking for payment and when it will be paid. the answer was as i didnt give a weeks notice, they have used this to counter act what i would have been paid. do i need to go gthrough tribuneral now or fire off another letter?
  23. thanks for advise. they claimed i had to give a weeks notice but will use that to ofset the week i have acrued. what steps do i take next to ensure payment??
