  1. As a follow on in my claim I included the £8 service charges that they used to impose for using an authorised o/d but they were on the ball and have removed these from the claim (all 20 of them), can't blame me for trying though !!
  2. Thought I would add this thread to update you on a second claim from Co-op. After claiming back my charges from the Co-op over the past 6 years on my current account which is a joint one with my wife and also claiming on our joint Smile account. I persuaded her to send off for details on 2 old cc accounts she had with them . Along with the cc statements that they sent back were full copies of our current account statements. I double checked these against what I already had and found that they went back to an earlier date than what I had and therefore showing additional charges. Adding charges up on the cc accounts plus the new ones for our current account I went through the process of sending the prelim and LBA. My wife received a call today from the co-op saying that they will credit our account with the new claim but if we make any further claims that they will close our account. The additional charges totalled £270 and some were over 6 six years old but only by a few months. Thought I better post this info as a warning for other people if you are making more then one claim against the same account. SAR sent

    After a little bit of consideration I have decided to go the whole way with this one. I have redone my calculations using their cash advance rate to calculate contractual interest and written to them asking for the full settlement within 14 days otherwise a court claim will be submitted. Using the new calcs they still owe me a further £1100. Not bad considering the charges were only £743. I have done this on the basis that they had not settled my original claim in full and thought they were trying to buy me off by adding a little at a time to their offer. We shall see what response, if any I get.
  5. They will pay your full claim including costs etc and credit your account with this. If this then puts you into credit they will send you a chq for the extra.
  6. Chq received in the post this morning for full amount, wasn't expecting to see it until after christmas so well done again Cap 1 for beating your own deadlines. must be a record this praising cap 1 twice in a thread. long may it continue.

  8. well done, but don't confirm anything with the court until you see that chq, I'm in the same boat letter came Saturday along with letter from court giving me until 9th Jan to confirm I'm not taking it any further

If your experience is the same as mine expect a letter from them this week stating they have credited your full claim back to your card, if that then leaves a credit balance they will forward a chq within 14 days. Mine came this morning along with their defence from court which stated that they disputed the full amount of the claim but paid it anyway, without admitting any liability obviously !!

  11. Defence received this morning from the court . Defence is we paid up in full. Also got letter from cap 1 stating £1178 credited to my account which leaves me with an expected chq for the sum of £908 for the credit balance. will send confirmation back to court once the chq arrives. going to miss all this once its over only 2 more claims to finish out of the original 9.

    Finally got round to posting my lba letter off yesterday asking for the remaining outstanding money, got home today to find another letter from Rachel Claridge refunding me a further £473 which now covers all my charges but leaves the contractual int of £300+ only to be claimed for. will send a further letter asking for this back but how far should I push this as technically they have refunded all the charges
  13. as an add on to thomper's post if you have a £10 service charge you can claim this back as it was the charge for an unauthorised o/d before they bumped it up to £25
  14. monthly rate on my statements says 1.384% so just multiplied this by 12
  15. Just checked on moneyclaim and it says cap 1 have put in a defence. I guess the chq is in the post !!
  16. Paul, you can claim all items listed as fees, commission, daily excess charge, and the £10 service charges. Ignore the £8 service charges for reasons stated before and if you want to get claim back an element of the debit interest you'll need to complete one of the spreadsheets from this site, check around for instructions. alot of people don't think its worth the hassle at this stage, that's your decision though. good luck gaz
  17. Paul, when were you charged these £8/10 fees. If you are talking a few years ago, the £10 you can claim for but not the £8. The £10 was for when you exceeded your authorised od but the £8 was for using and staying within your od
  18. Yeah, £66 in charges plus £28.61 in interest, got £3 less than that and assumed that they had calculated the interest properly instead of using my dodgy calculations !! Good luck in getting the rest of yours back, I'm sure it won't be long gaz
  19. C1 acknowledge claim 17th November so have best part of a month to file a defence or send me a nice chq
  20. Chetz, have you got the rest of your money yet, chq arrived in the post this morning for full amount claimed in my case no sign of any part payment and was in responce to my prelim letter not the lba sent on Friday. Hope you get the rest of yours soon if you haven't already. gaz
  21. received statements after SAR on Saturday along with letter from Rachel Claridge stating she had credited £270 to my account as gogw as a final settlement of my complaint, nothing like getting their offer in first, I haven't even requested a refund yet !! however after waying up my options for all of 10 seconds sent prelim of today requested refund of charges + interest totalling £1065 lets see if they can refund the remainder a quickly.
