  1. Hi I have received a letter in response to my CCA request within the 12+2 days time limit. I have never ever seen such a rude and nasty response from a large organisation. They state that they have provided a 'reconstituted version of the executed agreement'. They also state in their fluffly jargon that the documents they have supplied can omit the signature, remains enforcable ( not that at any point have I said to them it isn't) and that they have satisfied their obligation under section 78. They then repeat that it's enforcable and they will treat it as such. It then warns me of using a claims management company (?????) and states web sites from the Ministry of Justice and the CAB. It refers repeatedly to 'your client' also ?????? It is rude, aggressive and shameful. Now here is the technical stuff - the documents supplied are: Credit Card Agreement regulated by the Consumer Credit Act 1974. - stating it is a copy of your agreement for you to keep. It states it is an agreement between Bank of Scotland plc ( BUT THIS WAS OPENED WITH HALIFAX WAY WAY BEFORE THE MERGE ????) my myself and my current address. - No date supplied either !!! It mentions credit limits are set from time to time and does talk about repayments and interest rates. What has made me very cross is the letter also quite clearly states: We will not be entering into any further correspondance with you regarding ther equirements relating to the provision of copy agreement. Please advise........................... Is this document acceptable from them. What do you think I should do next.?? With a letter like that - if they want a fight - lets go !!!!!!   2. Hi guys Sorry for starting a new thread but I just don't know where to start a new thread and I wondered if you could possibly post a link for me. I previously started in thread in this section entitled CCCS - say I will never clear my debt. I have followed your advice so far and received a really nasty letter from Halifax regarding asking for a CCA, the information they have supplied (it's not a signed credit agreement) and that they refuse to correspond on this matter further. I wish to post all the details on a forum that deals with Halifax credit cards - do you have one please ? Many thanks for your time.
  3. Hey ok.... You have me fired up - I'm gonna do it !!!!! Either way I've nothing to lose ???? Will dig out all paperwork tomorrow - go to Staples and get a file. Will get some postal orders and hit em with it. Thanks once again - I will keep you informed. Just one more question - what about charges added to the credit card accounts. I know all these accounts have charges on them too. Kind regards
  4. Many thanks once again. I am more than willing to follow your advice and do as you say, but please forgive my ignorance. What will these processes achieve? I am now a mother of one daughter, on my own and can still only afford to pay them the collective amount of £60 per month. There are most definately charges on the halifax current account - would I reclaim them to reduce the balance only ? What about the rest of the accounts - can I ask them to write off the debts because it will take me to my grave to pay them off ( I'm 35 now!). I don't bank with Halifax now and have used an alternative currect account bank for the last 3 yrs ish. - No charges on that account !!! By asking for the CCA - is there a chance these accounts are un-enforable ? Sorry for nagging - it seems like a really massive task for me. I really appreciate your patience. Thanks

Here are the creditors and balances off my most recent CCCS statement: Egg - Personal Loan - £10810 Intelligent Finance - Personal Loan - £6304 Halifax - Credit Card - £3099............was Intelligent Finance card CI Finance - Credit Card - £2933...... not original lender Barclaycard - Credit Card - £2079 Halifax - Current Account - £2056 Halifax - Credit Card - £1415 Blair Oliver & Scott - Credit Card - £1353..... not original lender Argos Card Services - Store Card - £595 Direct Legal Collections - Credit Card - £579.... not original lender Creation Financial Services - Store Card - £232 HFC Bank - Credit Card - £1122 I really don't think these balances would agree with the lenders records though as some of them are adding interest again.   6. Hi I am new to this web site and wondered if anyone could offer a little help please. I have been with the CCCS under a payment plan for about 3 yrs and my debt is still at over £35k. As my circumstances were due to a relationship breakdown and not lack of income I stll can't afford more than my original amount of £60 per month to all of my creditors ( 12 of them at £5 each ). At my last review their advice was to manage to scrape together the court fees and declare myself BANKCRUPT !!! I really don't want to do this - without going into too many details I will probably lose my job - and therefore all my income. Can anyone advise what letter I could send to all my creditors asking them to write off my debt due to my circumstances. I thought it's worth a try, and does anyone know of anyone that has been successful down this road. Many thanks
