  1. I have made lots of CCA requests and it appears by a majority of the responses that the CC companies seem to be using a loophole of their own within the act) that allows them to send blank agreements with separate terms. By doing so it appears that they are actually conforming to the act without actually giving you the document you actually need. Hence why I went down the road of CPR not CCA. So frustrating!
  2. Thanks for the replies guys. The complaint to MBNA went to the complaints dept for not responding to the CCA req. I have waited the statutory time scale within which they have to acknowledge the complaint (FSA regs) and have recieved nothing. I cannot believe that this company is able to operate this way. I used to be a compliance officer for the largest sub-prime mortgage broker in the country (moved to compliance after being appalled by sales practices of other mortgage advisors within the company) and am well aware of the requirements all FS companies have to adhere to (or should do), yet it appears if they put their fingers in their ears and say "la la la la" I will go away! what would you do if cca request and cpr request have drawn a blank?
  3. Hi all, great posts. I am at a bit of a dead end with all my "challenges" to credit card companies. I need some guidance please. I have sent cca requests to the following: For myself - Capital One Santander (Kwik fit) For my wife - HSBC MBNA (virgin) For my dad - Capital one Natwest MBNA Mint All have basically been unable to produce agreements in line with CCA. They have all claimed to have fulfilled their obligation under the act by sending either blank aagreements with seperate terms or bad copies of app forms. HSBC have admitted they have no agreement (!) I have followed up all unsatisfactory responses with requests under the civil procedure rules, not cca, for copy of original signed agreement. The problem is this, they are all jsut ignoring me!! what do i do now I feel I am at the limit of letter sending as it has no effect. Can anyone tell me I need to do now? Do is end more letters threatening court, do I actually make applications to court? I hope someone can help as this has taken so much of my time and has been hard work researching the act etc, I really really want to see this through and win. Hopefully be able to help others.
  4. Nice letters homer!! I have gone thru the mill with cap one. Have had dealings with capquest who continued calling and writing threatening letters etc. I have gone thru the cca req phase with various diff letters inc last one which was a cpr letter giving deadline for agreement disclosure. Long story short, im now at the stage where capquest no longer call (guy apologised last time for calling me as he could see account was in dispute on his system), havent recieved any letters or statements direct from capone for a month or so. Dont know what to do now? they have sent a copy app form and clearly dont have an agreement, where do i go now???
  5. Hi all. I'm new to the forum and am looking for help. I am having similiar dealings with HSBC. I have sent a CCA request and numerous threatening chase letters and and have evenually got a letter back actually admitting that they do not have a signed agreement!!! couldnt quite believe this! however im not sure what I need to do now. Can ayone advise on my next course of action?

Hi all Very new this forum, but have been battling with a number of CC companies including MBNA who have blatently ignored all my wifes letters under s78 cca and now a cpr request, both for signed agreements. now have got the issue of global vantedge ringing 3 - 4 times a day. complaint made to mbna (twice) with no acknowledgement. Now escalated to FOS. anyone had any similiar dealings, got any ideas on where to go from here?
