I have seen posts from other owners which show it is possible even though it may be rare Metal Flakes in Fuel System | BimmerFest BMW Forum I agree Stoneacre couldn't have known this would happen. All I know is that we 100% have not misfuelled this car ourselves and believe this to be a fuel pump error so I do think BMW should take responsibility.
  2. Hi Thanks for your comments. The car has not been misfuelled but if it had been it would not have been covered by my insurance. The car was paid for by funds from a personal loan so unfortunately not PCP or HP. I have looked again at the report and although there is a paragraph at the top saying no obvious signs of misfuelling it is followed by a quote so this could perhaps be considered to be just a quote. I am ringing the garage today to clarify and looking into getting a further inspection report from the AA/RAC.

  4. Hi Sorry, Yes I will space properly, I was in a bit of a strop! I used a garage who specialised in BMW repairs near to me . Blackpool motor works ltd. They charged £110 to inspect and check diagnostics. They have also quoted for repairs. I have set aside some time tomorrow to put in writing as you suggest. Thank you

BMW complaints department refuse to accept my independent report , they say they will only accept one from one of their dealers, I stated that I did not trust their dealers and wanted an independent report and they flatly refused to take this into consideration. I told them that their dealer wanted to charge me another £800,to even investigate the possibility of car not being misfuelled and they also advised me that in their opinion it was not worth it because outcome would be the same. Again, BMW flatly refuse to take any of this into consideration . I have been told that my complaint will not be taken any further and they referred me to the ombudsman. Absolutely shocking customer service. I am effectively left with a written off car and they just kept repeating it wont be taken any further !!!!
  6. Hi I think we have probably done around 7000 miles if that and we paid £22k for the car.

Yes the fuel pump failed which caused damage to other parts of the car. so the damage is still the same but we have established that it was not caused by misfuelling, therefore must be a fault within the car. The original quote from BMW was £9600 plus, Independent garage have quoted around £7000
  8. Hi I have now had an independent report done which states, no obvious signs of fuel contamination, fuel pump fault, Do I now have reason to request BMW to cover the cost? Does the Consumer Rights Act apply in this case? it is reasonable to expect a car to last more than 3 years before it costs you £10,000 in repair costs!,

  10. Hi Im hoping someone can point me in the right direction. I bought a used BMW from Stoneacre last January. The car has been regularly serviced and well looked after. On Thursday night the car , with no prior warning cut out on me and i had to call a tow truck to get it to my nearest BMW dealer. They rang me next day to say they had found swarf in the fuel system and asked if I had put wrong fuel in , I advised them I certainly had not! They then advised me that the whole fuel system would need to be replaced at a cost of £9,600!!! and that they would first have to see if it would also need a new engine , this would cost around 6 hours labour they told me. The car is only 3 years old and has only done 33,000 miles. My questions are: Should it not be down to the garage to tell me what has caused this to happen, my husband has done nothing different to the car, used the same fuel he always does etc and never lets the tank run dry so I am assuming it must be a faulty part? Should we be expected to pay for the garage to find the faulty part? If it is a faulty part (maybe the fuel pump?) should BMW be held responsible for fixing this given the age and mileage of the car?   11. Hi A year ago I was granted a Tomlin Order for a debt owned by Aktiv Capital (originally MBNA) and was helped by the lovely people on here. The order was agreed for a lower amount because I queried charges. I have just received a statement off AK. It states that I owe the original amount, not the amount agreed on the order and has also added fees charges of £335 ! It does not itemise the charges. I was under the impression that the amount agreed on the order was the amount I will owe and that they were not allowed to add further charges ? Can any kind person help with some advice. many thanks CW
  12. hi andy , our posts crossed in the post as it were !! thanks for the reply , so i just wait to receive the order and sign etc and that is signed by the court ? is that then it ? can they then not push me for more or full settlement through another court order in the future ? i appreciate all the help many thanks CW

  14. Hi I received this first email today , they accepted my offer and as you can see said they would draft the order -is this good news for me ????? Thank you for your email and attached letter which we received today on 29th July 2013. We wish to inform you that our client is happy to accept your offer of £12,986.00 in full and final settlement of the claim referred to above. As our preferred method of payment is by direct debit, and this requires a monthly payment plan, we would prefer it if the Tomlin Order specifies that the debt is to be repaid by monthly instalments of £20.00. If this is agreeable to you then we will go ahead and draft the appropriate Tomlin Order and send it out to you (together with a direct debit mandate for you to complete) in the next few days. We look forward to your response. I then received this - We refer to our previous correspondence with you regarding the above matter. We wish to inform you that before 31st July 2013 we were required to notify the Court whether or not we wished to proceed with the claim. Today we have informed the Court that we do wish to proceed with the claim and we hereby give you notice of this, as is our obligation. Please be reassured that our proceeding with the claim is merely a formality to enable the settlement agreed between the parties (please see our earlier email to you for reference) to be finalised without any unnecessary costs or time being incurred in the future. We look forward to your response to our earlier email of today’s date. Is this bad news for me ???? im a bit confused, are they saying theyre going ahead with court so judge can sign order ?? I dispute charges and interest tothe amount of £2031.22. This would makethe account balance £12,986. I would be willing to enter intoa repayment schedule via Tomlin order.   17. Hi andy I know the amount of debt before they added all the charges as i have all the statements. but do I suggest a tomlin order to them ? and do I suggest it with proposed figures thanks CW

Hi i have just received the following response to my letter to WHassal - could somebody tell me what the best response would be , given that I do not have any lump sum available to settle with so would have to initiate a repayment plan of some sort ? thanks CW WITHOUT PREJUDICE SAVE AS TO COSTS Aktiv Kapital Portfolio AS Zug Branch – v – Claim Number: We refer to your email of 24th July 2013 and its attachment in which you indicated that you are considering withdrawing your defence in light of the fact we have now complied with your request for documentation relating to your account. We note your comments about the change to the interest rate and that you dispute the total amount of the debt. Our records show that you owe a total of £15,017.22 (including our costs). We would welcome your thoughts on how much you believe you owe us – our client is happy to negotiate a settlement that is agreeable to both parties if this can avoid proceeding to trial where both parties will inevitably incur further expense. However, we would draw your attention to the fact that we do have a substantial amount of documents supporting our claim and therefore we are not concerned about the strength of our current case. We look forward to hearing from you shortly.
