  1. gatser - I have a similar predicament to yourself. Basically i was told it was paid off but 3 years later i found it wasnt which was due to a admin error they made 10 years previously and took 7 years to sort. Just keep firing the letters off to them and make sure its very clearly marked as a complaint. It wasnt until i wrote a letter to the cheif exec and the majority of the management board that i actually got an acknowledgement of complaint! that was dated 28th sept with a promise to respond in ten days!
  2. Appreciate this is a bit of a ye olde thread but just wondered if any one could give their views on my predicament with the beloved SLC. My situation is thus!... In Summer 1998 I apply for my 1st year loan using my forename and surname, in summer 2000, I apply for a further loan using my forename, middle initial and surname. When you apply for your new loan each year this just gets added to your one account. However as my middle initial was included, the SLC computer couldnt handle it and generates two accounts. I begin having payments deducted around 2003. However due to the way their systems are set up, payments can be allocated to one loan at a time. So eg for 03/04 Loan A receives payments whilst Loan B sits there gathering interest. The following year payments are allocated to Loan B etc. The Last payment to Loan B was received at the end of the 04/05 tax year. I then begin making a concerted effort to pay off Loan A assuming that this is the total of what I owe SLC, make overpayments and clear it off by Nov 2006. A few further payments are taken but refunded. I later discover that Loan A and B are merged at the end of the 06/07 tax year. This problem had been brought to their attention much much earlier. Coming forward to Sept 2009, I havent heard anything from them for 3 years, I have been over the threshold for making payments and have been in constant employment since 2006. I then have £80 deducted from my wages and find out I apparently owe them £320!!?!?!!?!?!?. Speaking on the phone is getting me nowhere quick so Ive started emailing and writing. What I want to clarify is this... Is a student loan covered by the Consumer Credit Act? It was over a decade ago I applied so i no longer have any original paperwork. Do they come under the Banking code? Are they regulated by the FSA? I have submitted a DSIR and a CCA request and have sent a letter (with email copies) to the complaints dept. They have two stages of appeals to their complaints process so I expect the process to take some time. Any advice would be really appreciated
  3. I have posted this in the student forum but thought I would try down here on the off chance anyone could share their wisdom. Its not (well i dont think it as at the moment) related to charges but more about a disputed balance. The situation I have got is as follows... I applied for funds in 1998 using my forename and surname and in 2000 using my forename, middle initial and surname. The normal process is that every new loan you take out each year just gets added to the overal balance. However as the SLC computer couldnt handle this middle initial it generated two loan accounts for me. As far as I can recall they were aware of this problem fairly early on. I begin making payments around 2003 and have been in continuous employment since then and have been earning over the income threshold for payments to be made. As their system cant allocate payments to more than one account at a time what effectively happened was that for one year Loan A would receive payments and Loan B would sit in the background gathering interest and then swap round the next year. The last payment was allocated to Loan B at the end of the 04/05 tax year. I then paid overpayments onto Loan A assuming it was the total balance I owed the SLC and paid it off around November 2006. However at the end of the 06/07 Tax year the two loans are then merged six years after the initial mistake was made at the application stage. Three years after I last had any dealings with the SLC i notice a £80 deduction from my salary and contact them to find out that I havent cleared my debts and I owe £320. After getting no where with the customer service team I have sent three letters to the Complaints Dept (copies also emailed), sent a DSIR request and a CCA request. Im slightly confused what is the best angle to approach this. Do the SLC come under the Consumer Credit Act? Does the Banking Code apply to them? Im fairly certain that the majority of this balance will be interest. Do you think I have a case to argue that if interest was applied when the SLC did not allocate payments to the loan(s) (despite me earning sufficent salary) and effectively kept them hidden from me I should not have to pay this. Any advice would be greatly appreciated. Cheers
