Im resurecting this post as this loan has been passed to some debt collection company called 'mackenzie hall' and they are being extremly unreasonable with me to the point where they are hell bent on taking this to court. I was on holiday, when I check my mobile and I had a text from them, so being nice I contacted them to tell them I was away on holiday and so would not be able to deal with it now. The lady I spoke to just wanted my card details, despite me telling her I don't have them with me. Well I've been home for a few days and received another very aggressive letter stating the following. We write to you for the final time giving you formal notice that Quick Quid has legally assigned the rights to the above dept to Mackenzie Hall debt purchase ltd. This means that Mackenzie Hall debt purchase ltd. now legally own the debt. We have been instructed by Mackenzie Hall Debt Purchase Ltd. to consider lefal proceedings against you in the Northampton County Court for recovery of the full amount outstanding above, together with statutory interest and additional costs. If you wish to avoid court action then you must either pay the full amount within 7 days. There will be no further warning Upon Judgment, enforcement action could be taken against you, whereby the following methods could be considered: - Attachment order of your salary -Warrent of execution by the Bailiff/sheriffs officers instructed to seize you goods from your property. -Charging order or Bankruptcy may also be considered where applicable. I tried to contact them today to make payment arrangments, however the first person said they would only accept 3 month payment plan which I simply can't afford, she then abruptly told me they will just take me to court. She said that the debt is with the legal department and they will take me to court. When I asked to speak to the legal department she told me that I was and didn't like my attitude and was going to terminate the call (when I didn't). So I just put the phone down, before i lost it with her. I rang back and spoke to someone who wasn't as agressive however she was very simpathetic and said that they would only accept a payment plan over 3 months. She said it was a 1 month agreement, so I should pay it back immediatly in full or they would take me to court. I did point out to her that it would be seen as wasting the courts time!!! What should I do with these people. I've already made it clear that because of the way in which they are treating me over the phone I want everything in writing, which she said she will make a note of. This has really got me down, I've got a goodish credit file with no CCJ's or Defaults, so I don't want this to end up in court because I can't afford to get a CCJ on it. I want to offer payment over 9 months which i think is really reasonable. Please any advice anyone has would be greatly appreciated.
  2. Hi Yahoo User, Simply cancel the direct debit they have setup. Once this has been cancelled this basically relinquishes your authority for the company to use that direct debit anymore and in order for the company to setup a new one they will have to seek your authority again. In theory this would just usually involve a call to say your electricity company to ask them to setup a new DD and you would give your account number and sort code again etc. That is basically the authority the electricity company needs to setup a direct debit. When dealing with the scummy payday lenders it’s a little more tricky, again make sure you cancel the direct debit. You need to then contact the payday lender by email or post (not phone because you need to make sure you are recording your dealings with them). Advise them that you have cancelled the direct debit, advise them the reason for cancellation is the lack of notice when they debit your account, and the payments are not regular etc or for any realistic or agreed to amounts. You need to withdraw your authority for them to hold your account number and sort code also your debit card details in either electronic form or written hard copy form. Advise them all payments will be paid directly into an account they nominate. I would also make clear on the email that you will no longer authorise any direct debit setup on the accounts and if these account numbers are not remove/deleted this will be a breach of the data protection act, and give you grounds for complaining to the data protection commissioner. When the idiots ignore this request and go ahead and reset the direct debit up, simply contact your bank tell them you didn’t authorise it and you want to make a complaint. Give them the email and they will go to town on the payday lender. The payday lender may even have to explain to their own bank why they setup a DD on an account they clearly don’t have authority to debit. I would then write a “formal complaint” to the data protection officer for the lender asking for an explanation of why they still have your account number without authority and if they did remove it from their records they will have to release the source from where they got the account number. Basically they would be in big trouble as this is a serious breach of data protection. Hope this helps.
  3. I would look at their terms and conditions, it may say that they will only agree to take payments from your prefered debit method. If their t/c's don't state anything about if you fail to pay by card then they are entitled to take money by direct debit then they are in trouble as this is a breach of data protection law and they may have defaulted on their terms and conditions. I did see before in a different agreement, that if they do setup direct debit they are required to give you notice. It would be worth having a read to see what they are entitled to do. If they are not autherised to take money by direct debit, ask for the details of their data protection officer. Every company has one, and write to them to say they have breached their data protection act. If they ignore you, tell them you will pass everything to the information comissionar and they will be in touch. Hope this helps.
  4. I do know the law states that if a loan has defaulted, the creditor is no longer entitled to charge interest after the default date.
  5. Sorry to hijack the post, but I too defaulted with QQ in feb and have not heard a thing. I did go to town on them though and said I was perfectly happy to pay £45 to take them to court so the court can impose the payment plan. Never heard a thing!!! It also states in their t/c's that they will only debit by their prefered debit method (direct debit/debit card) so if you arranged to repay or extend your loan via debit card, they are only autherised as per their t/c's to take the payment by debit card and it also states that they have to give a certain amount of notice by law!

  7. Hi Tillytiger, Hope this helps with wonga, Email errol.damelin@wonga.com, he's their director and copy in customercare@wonga.com. Entitle your email 'formal complaint'. Put down your proposal, and state that you've been informed by the office of fair trading that the offer is reasonable if you state in the emails your in financial hardship. The reason for this is, I did have a genuine problem with wonga in the fact I did have genuine fraud on my account so my bank cancelled my card. I informed wonga way in advance and got their account details to pay the money in. On the day of repayment, my new card arrived, but wonga wanted an extra 10.00 because my card had been cancelled. I went to the oft, they just told me to deposit the money in their account but they said that wonga by law had a duty to act on any correspondance that had 'formal complaint' written on it. There is a big lack of customer services in wonga's organisation and I got a call from the head of wonga called vicky and I still have her details if you need them. She was extremly apologetic and I got the interest refunded. If you get no where let me know and I will pass on vicky's email and phone number so you can ring her in person. She is genuinly the head of their customer services actually based in there secrative head office.

Dear TXTLoan, I'm impressed with your rejection rate of 85%, and did a stint in financial underwriting for credit cards so I agree with you that your lending criteria will evolve and change over time. I'd be interested to know out of the 85% rejection rate, how many were fraudulent transactions, and how many were genuine. The reason I feel payday loans should be banned is like many people on here I've just defaulted on 1 payday loan tomorrow. I've managed to clear the other 2 that I had. I realised very quickly that my wage was being comitted to payday loans. As I am a very good customer, with a strong credit rating as in the past I wasn't so good with credit but I've managed to build a good credit rating back up. I have 1 credit card that I always pay on time so this has helped my credit score. Due to the devil worshiping credit refrence agency holding records for 6 years I have a default that is about to drop off the file so to speak in 2 months. I'm planning to get a current account and a small overdraft so will not be reliant on payday loans when I end up with a hugh bill. The point I'm trying to make about payday loans is, you may have a strict lending criteria but you'll probably be very willing to lend to me, but here is where the system of payday loans falls down. I could then go to 3 other payday lenders who would be very willing to lend me £700 a go. I get £1000 after tax so that's when I'm probably not going to payback these loans, even with just defering. That is a good example of why payday loans should be banned, high street banks would not be allowed to operate in this way, and wouldn't. There are no controls to stop those who you can lend to but don't have self control when applying for credit, and living beyond there means. The other reason is that the people who may, not necesserly use your buisness model but other payday lenders, maybe in a desperate situation or simply don't have self control when it comes to credit and don't take responsibility or control when trying to live within their means. I learnt the hard way but thankfully I'm nearly out of debt. One last thing I would like to add is I think it's brilliant that you are willing to engage on this forum. You should be commended. Other payday lenders like 'wonga' or 'cash till payday' should follow this brilliant example in good customer relations. I also like how you demonstrate the charges and how they mount up over time, but you will not sway me from my stance that payday loans must be banned, it's worrying how the people that are slaves to debt, are those at the bottom.   9. I'm wondering if quickquid have to provide me with advanced notice to debit my account. In there t/c's under debit autherisation it say the following "we will provide you with advance notice before we re-present for payment a previously returned or dishonoured debit." I've included the full t/c's of this section. Do they have to provide me with advanced notice. Any help would be appreciated. DEBIT AUTHORISATION: You hereby voluntarily authorise us to debit your nominated bank or building society account ("your Bank Account") or Debit Card for any amount that is payable by you under this Loan Agreement, including the Loan Amount, Finance Charges and any other fees that you incur ("Debit Authority"). We will debit repayments on each Payment Date to your Bank Account or Direct Card in accordance with the Debit Authority given by you above. If a payment is dishonoured for any reason, you agree to pay us the Dishonour Fee, which we may collect by Direct Debit to Your Bank Account or debit to your Debit Card in accordance with your Payment Selection You authorise us to verify all of the information that you have provided, including past and/or current information. If there is any missing or erroneous information in or with your loan application regarding Your Bank Account or Debit Card details then you authorise us to verify and correct such information. If we are unable to correct the information, you acknowledge that this may delay the payment of the Loan Amount to you. You agree to assist us to correct information by providing us with such information as we may reasonably require. We will give you a notice if you or we make any changes to the debit arrangements under this Loan Agreement ("Advance Notice"). If you have elected to pay by Direct Debit, you and we agree that the period of Advance Notice that we will provide to you is 3 Business Days. The Debit Authority given by you for the purposes of this Loan Agreement is to remain in full force and effect until your obligations to us under this Loan Agreement are fully satisfied. If a debit is returned unpaid or dishonoured for any reason when it is first presented by us for payment, we may re-present the debit for payment to Your Bank Account or your Debit Card by presenting two separate debits for the total amount that is payable by you. We may do this on more than one occasion. If we are required to do so under any applicable law or other legal requirement, we will provide you with advance notice before we re-present for payment a previously returned or dishonoured debit.
  10. Hi thank you for your replys, I've drafted a strongly worded email offering them a reasonable payment plan over 6 months, for the origional capital plus 1 months interest due. If there not happy with that, then that's there problem as i'm going to get hold of their bank details one way or another and make the monthly payments. I've also said in the email that if they set even 1 direct debit up I will take them to court. I'm sure they would have an hard time with a judge when i'm offering a totally reasonable payment plan, plus it will only cost about £50 to take it to court. I doubt quickquid would be stupid to apply charges because I will just take them to court. I think if I take an hard line approch towards them, they might back off. I'm also going to send them a subject access request to make sure they have followed my instructions by removing all telephone number for me as I request communication be in written form either by email or post. Can someone let me know what to do and write when sending a subject access request. I know to send it recorded delivery, and is there some kind of payment you have to make for it. Dear txtloan, I am in favour of banning payday loans, and agree with the general notion that you are tempting people who can't get an overdraft with there bank with expensive credit that you havn't really means tested their ability to repay. Would you be will to prove that your buisness model isn't this by providing a rough % of how many loans default, out of the loans that default how many get to day 46? It would also be interesting to know how many % wise of customers borrow week after week? I know that this could be sensative information but I'm asking for % not how much capital you lend. Thank you
  12. Hello all, I've ended up with 3 payday loans , 2 which I am paying off this month:). Due to unforceen circumstances I've been landed with a big bill this month that has to be paid and the biggest payday loan I have which is with QuickQuid. I just can't afford to pay, not even to pay the Interest. I've informed my bank my card is lost, and have made arrangments to pay the other 2 which are small. The loan with QQ is however for £450.00 and the interest is £112.50. I've already had to defer this 3 times already and the interest payments are killing me. I'm finally in a position this month not to borrow from the other 2 evil payday lenders. QQ sound an absolute nightmare, my worry is that I intend to pay this loan off starting from March's payday, over 5 installments at £112.50. This is the principle amount and the Interest that was due. I refuse to pay any other charges. My other worry is, I havn't changed my account number as I need it to stay the same and I'm worried about them taking the money by Direct Debit as this could make me go overdrawn and plus I've heard a lot of payday lenders trying debiting smaller amounts. Can anyone help me with this, I am trying to draft an email withdrawing my authority for them to contact me by telephone, comunication via email or post only. I also need to make sure it's clear that I do not autherise any direct debit by them from my bank account. Is there anything that can help me with that, such as any legislation? any help or advice would be greatly appreciated. D-Day for me is this Friday (19th). Richard.

Hi Tilly, Not to scare you and it wasn't my intention but NO bank can garantee they will not let funds transfer as most banks are automated and there computer system sometimes can let payments through. The best thing you can do is hand a letter to your bank manager making it clear you do not autherise any payments out of your account to any firms (supply the names to your bank) or to any other company. Make it clear in the letter that any funds that are debited from either your card or by direct debt is unautherised and can be treated as fraud. This basically will force your bank to keep an eye on your account and they won't allow any payments to leave. If they do they will have to put the funds back in to your bank account. It's ok for someone in your branch to say one thing but it's another for the clearence centre to do another as one arm doesn't usually know what the other has agreed to.
  14. Hi tilly, This is a bit of a long reply but will give you a way to beat these companies, be able to sleep at night and have a great Christmas. It's kind of an old fashion way of doing things, but it really does work. Well this how I did it anyway and will require a bit of research before the 16th and a bit of time. It won’t wipe your debts but it will lift a lot of the stress for you and your husband. You need to find a small building society that offers savings pass books and has branches that you can easily get to. Give them a ring and ask them if they allow a standing order facility on the account and also if they can write cheques for you. All you need to open them is the usual forms of ID's and it doesn't take too long to do. Make sure it isn't with your current bank. On your payday as soon as your wage goes in and the bank opens, go down and withdraw everything except the money for bills that are on direct debit such as your debt management company, ect, if any bills fall after the new year cancel the direct debit, give them a ring and ask them for their standing order details and instruct your building society to set them up for you. With draw the rest of the money and put it in your pass book account. You probably would have done this with your debt Management Company but write a financial plan over the Christmas period till next payday. Work out how much you need for presents, Christmas food ect. Now calculate everything else you will need on a weekly basis that are essentials such as Weekly food shopping bill, petrol/bus fare, gas & electricity ect. So times how many weeks you have from the 16th to your next payday by the amount you need for essentials every week. Take this amount and add it to the amount you need for Christmas presents and take this from the total amount in your passbook account. With any luck you will have a bit left over. With the left over amount again divide by how many weeks you have till your next payday. Every week on a certain day such as a Saturday morning go down to your building society and withdraw what you need for the week plus a bit of your spending money that’s left over but don’t withdraw it all. Make sure you note the banks opening times over the xmas time so you know when to withdraw next week’s money when they are open. If your hubby is burying his head in the sand then I think it’s only fair you take control of the finances. You ask you hubby that all his money is going in to the same account and with your pocket money allow him to have 30% of it, you can have 30%, 10% allowance for each child such as pocket money or if they need clothes and the other 20% find somewhere to save it up such as a sock or even leave it in your building society account. I think you will have got the gist of it by now. In regards to your bank, write a letter to your branch manager, doesn’t have to be all neat and tidy but make sure you inform them that there will be zero funds in the account after all bills are paid. Inform the bank that you hold them fully responsible if you allow any payment out of any old/new account. Inform them that no one has you expressed permission to make any direct debit instruction or debit funds from your card. Ask BT to block their numbers but this does not always work as they will have many numbers they ring from, I would ask if you can have your phone service temporally cut for 1 month so your home phone isn’t ringing every 10 seconds. Email them and mail them the letters telling them not to ring you and all correspondence is in writing in the future. You need to tell them that you are “urgently reviewing your finances” and that they need to send you a projection of the balance as per January payday. Inform each of the companies that you will contact them “10 working days” after the receipt of your letter with an instalment plan. This should give you till the New Year before you need to respond as working days means mon-fri so 2 weeks but it looks less. Once you have your balances as per Jan payday then work out how much you want to pay off in instalments each month. Make sure it’s what you can afford, don’t stretch yourself. Make sure you get them to agree in writing either in email or post that they agree to the instalments. If they agree and ask for your card details inform them that you won’t be providing any card details yet. Make an excuse that you have changed banks and are awaiting new cards. With the time left till January payday shop around and try and find a prepay card, these are either visa/mastercard and the companies may charge a small fee either for setting it up or on any transaction but if you shop around you can find one that won’t cost you that much. You need to get 3 of these, they don’t do credit checks and you can have as many as you like. Hopefully you will have these by January payday, if not ask the payday lenders for their bank details and inform them that you will put the money in their accounts as you have still not received your new cards. If you have received your new cards, mark them to indicate which card is for which payday lender so you don’t get them confused and top each of them with the instalment amount and email the payday lender or even be a bit cocky and ring them and give each of them the number for the prepay cards. They can try and try to take as much as they want but these cards will only allow you to take what they have on them, like pay as you go mobiles do. It also confuses them because your card details will be completely different which will take the pressure off your main account. You can even tell them to just debit them automatically on certain days every month but never reveal they are prepaid cards as it will give the game away and they may try targeting your main bank account. Try to keep using your pass book and just withdrawing on a certain day, it works for me. Every Saturday it’s a ritual, I go down to bank and get me weekly allowance out. I then go and do the weekly shop and I’m home for 12. I leave an allowance in my wallet for the weekend and hid the rest in a page of a book. It’s handy to have a diary to plot everything in too so you know what bills to pay each Saturday as I try to use giro slips as much as possible. Hope this make sense and hope every goes well on the 16th, I will keep an eye on this page.
  15. Hi people, I wrote a letter to welscum about the default. They wrote back within 10 days saying it was an error and they will remove it from my credit file immediatly. Result!!! Well not really. I got the letter from welscum on 29/09/09 saying the default will be remove within 28 days. I've since applied for my credit file from Experian, the date they did the report on my credit file was 29/11/09. The hire purchase agreement appears exactly like this; Welcome Financial Services LTD HIRE PURCHASE/CONDITIONAL SALE Started 22/10/05 Balance £0 Settled 24/05/07 Monthly Payments £109 over 18 months Status History: 000000000000 In the last 20 months of account activity, the number of status 1-2 is 0 and the number of status 3+ is 0 File updated for the period to 29/09/09 I've have since applied for credit with a High Street lender who has declined me. So I went to a credit broker (don't use them, they are a nightmare) but they did a credit search and told me that they had picked this default up and that's whats causing me to be a high risk. I didn't take the loan because the rate offered is sky high. What should I do?
