  1. Yes they've sent me details so I can set up a standing order. I suppose I might as well start paying them now. Just wondered how much grief they're likely to give me if I ignore them completely for now.
  2. Defaulted on a Wonga loan in July 2010, sent a letter saying I couldn't afford to pay anything at the moment and never heard anything until this week. They've now offered a ridiculously small amount per month repayment plan which would take 20+ years to repay. Are they setting me up in some sort of trap here? To be honest these guys are not high on my list of creditors so I'm wondering whether it's better to just sit it out and see if they take me to court. Do they get nasty? it seems strange they've left it a year in the first place.
  3. Exactly how does a credit reference agency keep track of where you are? (besides electoral roll) What I mean is if I have 5 or 6 credit accounts and I notify just one or two (say one bank and my t-mobile) of my NEW address, will the other credit accounts become aware of this? I'm curious as to how your entire credit file "moves" with you. Is it simply by the electoral roll?
  4. You don't need to change bank account. Just ring the bank and say your jacket with debit card was stolen. i just said I think I left mine on a bus but wasn't sure if it was actually stolen. They send you a new card with new a new number and expiry dates.
  5. I'm defaulting on a Lending Stream loan. I've cancelled my debit card but I agreed to a direct debit being setup when I applied for the loan. Obviously I want to take control of how I repay them. What are my rights regarding direct debits? Can I write to Lending Stream removing their rights to apply it? Their direct debit doesn't show on my bank account yet because they haven't tried to take any payments via it yet. Any thought on how to stop them using the DD?
  6. Okay. I'll send Link a letter using one of the templates you've posted above. Thanks again for your help.
  7. Thank you very much for the reply. I'm still confused as to whether they have actually complied though, especially when I read threads like this one:- http://consumeractiongroup.co.uk/forum/showthread.php?173201 Quote: "This means that while the lender may have complied with the legislation, you will not have your signed agreement or a copy anywhere near to it." But I'll do as you suggest and make Link aware that I haven't received an agreement with my signature on it
  8. Thanks for the replies. I should have been clearer that I know I have acknowledged the debt between 2002-2008 as well, but last time was in 2008. I've never paid Link a penny though, only sent them letters explaining I couldn't afford to pay anything. So I'm not sure what to do now. I can't see how I can tell Link Barclays haven't complied with my CCA request if in fact they have. A SAR request might be worth it, there may have been a CCJ against me for this debt for all I know (which changes things obviously). Nothing appears on my credit file now though.
  9. I wrote back to Barclaycard asking again for a true copy of my agreement (I want something hopefully with at least my signature on it), but they've now sent me this letter and I don't know how to respond:- http://i959.photobucket.com/albums/ae80/darkrain10/1.jpg http://i959.photobucket.com/albums/ae80/darkrain10/2.jpg http://i959.photobucket.com/albums/ae80/darkrain10/3.jpg They appear to be basically saying they've complied with my request for a copy of my CCA. What should I do now?!
  10. Yes I CCA's Link and Barclaycard replied. Link purchased the debt in June 2002. I have never paid them anything but I did acknowledge the debt in writing sometime during 2008.
  11. I have a debt for a Barclaycard which was assigned to Link Financial in 2002. Unfortunately I acknowledged the debt in 2008 but I've never made any payments. So in May this year I decided to see if it's enforceable so sent off a CCA request. I've now received a reply direct from Barclaycard, but all they've sent me is a blank application form (from 1994) and some Barclaycard conditions on a separate piece of paper. Here's the letter from them:- http://i959.photobucket.com/albums/ae80/darkrain10/scan0061-1.jpg http://i959.photobucket.com/albums/ae80/darkrain10/scan0062.jpg Application form: http://i959.photobucket.com/albums/ae80/darkrain10/scan0066.jpg http://i959.photobucket.com/albums/ae80/darkrain10/scan0065.jpg Some extra terms and conditions: http://i959.photobucket.com/albums/ae80/darkrain10/scan0063.jpg http://i959.photobucket.com/albums/ae80/darkrain10/scan0064.jpg Could somebody help me with a suitable reply letter please? Clearly they haven't sent me a true copy of my agreement (it's not even filled in and signed!). I wonder if they're likely to have it from 1994. I'd certainly appreciate some help in how to proceed now. Thanks, DarkRain
  12. I've now got Barker & Lowe (Wonga?) demanding full payment. Is there any point in asking them for a copy of my CCA with Wonga? Are they even valid for payday loans? If I do request one, are they allowed to file a default on my credit file whilst I'm waiting for it? Thanks, DarkRain
  13. So may I ask why protecting your credit rating is so important? In my experience it's unlikely you would lose any existing credit you have. Remember any defaults disappear after 6 years anyway if you're thinking long term.
  14. Do you know if it's actually important I send that letter at this point? They're not ringing or writing other letters demanding payment, nor is there anything on my credit file as it dropped off after 6 years. So all I was thinking of doing now was waiting and seeing if they ever come back to me with a CCA.
  15. Unfortunately I used to reply occasionally to their letters explaining I was still out of work and couldn't make any payments. So there wasn't ever a 6 year gap. I think the last such letter was at the beginning of 2008. So at the moment I'm just trying to establish if it's enforceable.
