  8. Received a letter from Barclays wishing to settle out of court :D so i have signed on the dotted line and returned so to all the peeps just starting there claims, just stick with it you will get there in the end.

First of all sorry for not updating this sooner but school hols etc, but never mind they go back next week:D I phoned Mr Jeremiah and he seemed to be ok there where a couple of points he did wish to point out that there where one or two dates that exceeded the 6 years to which i agreed to knock off the the amount i would be claiming. with that he said he will be contacting me shortly A few days later letter arrived with another point about claiming for Authorised Overdraft Usage Fees which total about £150. the letter goes on to make me an offer taking into acount the above points of £676 which is £120 less than the Woolwhich offered me months ago and i refused it then Final paragragh in this letter which has wobbled me a bit reads as follows " As you will have seen from our defence, we consider that your claim lacks merit and that it will fail" Well i'm sure by now you have guested what my reply was to that offer, and i would be continuing my court hearing on Oct 2nd. has anyone else had a simular letter:? ????   10. the court date for me is not until 2nd October in Reading. seems a long way off wish it could be sooner Dave
  11. Well at long last the court have sent me my hearing date 2nd October (day after my birthday), but in the meantime like many others i will be having a chat to barclays Mr Keith Jeremiah cos you never know he might reach for the cheque book....LOL Dave
  12. Wonder if you could help me I received my invoice today normally it is £24.99 (payed using pay point) a month this time it was £34.99. I contacted NTL only to be told they now charge £10 for late payment I have had a look at my invoices for the last couple of months and nowhere on them it states any payment dates. According to customer services they do not have to, when asked how are we meant to know when to pay by they say it is in the T & C’s I cannot find anything apart from the following. ___________________________________________________________________ 6. Charges and Payment 6.1 You must pay all the Charges for the provision of Services and/or Equipment, for which we bill you (whether you use the Services or someone else does), together with any Value Added Tax and any other taxes (at applicable rates from time to time) which apply in relation to any Charges payable under this Agreement. You must pay your bill by the due date for payment. You will be liable for the Charges from the day on which we first make the Services available to you unless we notify you otherwise. 6.2 If you do not make your payments on time, we may charge you a reasonable fee for late and/or non payment. We may also withdraw any discount we have given to you for payment in advance or payment by a particular means (e.g. direct debit). We may also charge daily interest on amounts not paid until we receive your payment in full at a rate equal to 4% each year above the Base Lending Rate of National Westminster Bank Plc whether before or after Judgment. Interest will continue to accrue even if the Agreement has been terminated, as long as this termination is not due to a breach by us. This does not affect our rights under Condition 19 below. 6.3 We may vary our Charges from time to time but will publish any change in our main offices and/or on our website prior to the change taking effect. We will however do our best to give reasonable advance notice of any increase in our charges which is likely to substantially increase the charges payable by a significant proportion of our customers. Your rights to cancel the Services if we increase our Charges are set out in Condition 20.1(i). If you request a change to the Services supplied to you, we may need to alter the Charges to reflect those changes. ___________________________________________________________________ It seems to me they are getting like the banks making and changing rules as they go, it also concerns they the fact that they do not state the value of these penalty charges in the T & C’s just classed as “reasonable Fee” plus a daily interest Sorry to go on but can you advise to where I can find any laws on invoices and invoice charges Dave
  13. not too scared here and not being egged on in here (apart from the wife wanting to spend the money). i wish my court date could come sooner but it is Barclays that is holding everyone up thay are going to wait til the last minute. in my area the courts have told me it could be up to 15 weeks for my court date due to the increase in people making small claims ( i wonder why) so the longer barclays hold on to your money the more profit they make
  14. took my questionnaire into the court today i ask them how long it could be to a court date??? was told it could be up to 15 weeks due to the increase in small claims over the last few months. so i join the long que of waitng Barclays members Dave
