  1. Yes I have all my statments. - How do I apply to the FOS? sorry feeling really out of my depth here. I agreed the PPI settlement and requested they paid it by way of cheque but they ignored this and have refunded my account can they do this? thanks for all your help x
  2. Nov 2007, heard from them with my PPI claim they will refund but I requested it in cheque form but they have refunded it to my account can i do anything about that?
  3. Thanks, I keep sending them reminders that I have not yet received the signed agreement from them but still nothing. Got a letter re the PPI stating they were looking into it and my complaint would be passed to Bcard, its the same letter I got from them 3 months ago. So going to start pulling hair out soon with them. Tried to call them but get no where told will send copy of signed agreement out by 1st class post but it never comes. Would love to wait till it became statute barred but that is 6 years! Only took agreement out in 2007.

  5. Hi Yes I send a formal CCA request this was back in Feb, there is PPI on it and I have requsted that back but again heard nothing, and they continue to add default charges onto my account. Any suggestions?
  6. I currently lodge with a friend and pay half of everything. The hardship was caused by a break up with my ex and all debts were left to me. I have provided Abbey with all evidence of outgoings and they know what my wage is and have provided evidence of this also. I changes account becuase if I had had my wage paid into the Abbey account beacuse they have reduced my overdraft by over £1000 the money would have just gone for that and I would have had nothing left that month. I didnt want to risk that so opened a differnet account with a non linked bank and have my wage paid into that. I am on a very low wage and only just meet my bills and some I don't, which they can see from my credit profile which they have checked.
  7. I have written to Bcard stating the account is unenforceable and for them to confirm this. They originally gave their usual TOB and stated it was even though they do not have or have failed to produce my signature on anything. So I wrote back stating that could not omit my signature and they clearly did not have it on the original document and thus the agreement is unenforceable. This was 2 months ago and I have heard nothing since. They have stopped writing to me and so have Mercers, but I keep getting my monthly statement demanding payment (as I have stopped paying them). Can anyone please advise me of what to do next. Thanks
  8. I wrote to abbey requesting that they repay the unfair bank charges they have imposed on my account and stating that i was in financial hardship. I completed all the forms they send to me, providing evidence that I can only just make ends meet and that some of my debt I cannot afford to pay. The amount owed for unauthorised bank charges is £1600. Which ironically is the amount of my overdraft. I have since moved to another account 9not with Abbey or any linked ppl) and have my wage paid into that account, and pay my bills out of that also. As Abbey have also deceided to reduce my overdraft from £1600 to £500, and well I simply cannot come up with that money. I tried to speak to them aabout this but got no where and have brough this to their attention, but as you can see from there response below they don't care. My account is a graduate account and therefore they should not be imposing interest for my overdraft until 25th Nov 2009 as this is 2 years to the day from when I graduated. However the intend to charge me from 3rd Nov. I received this response from them, after constantly chasing them and getting no where: "Thank you for your recent contact regarding unauthorised overdraft bank charges on your account. Our understanding is that you are currently experiencing financial difficulties and you are requesting a refund of the unauthorised overdraft bank charges incurred on the above mentioned account. We are satidfied that the charges to which you refer have been raised correctly and are in accordancace whith the terms and conditions relaing to your account. We have carefully considered your finacial activity with Abbey, together with the information obtained from credit reference agencies, to assist your claim. Please note the check with the credit referncing agency will not be recorded on your credit file or made available to other lenders and will therfore not affect your credit record. As a result we appreciate your current finacial situation and therefore, as a gesture of goodwill, we will be refunding unauthorsied overdraft bank charges totalling £95. This amount is based on the unauthorised bank chnarges you have incurred in the 12 months proir to the date of our receipt of your claim for financial difficulty, that have not been previously refunded. In addition we will cancel any unauthorised bank charges, to be applied to your account until the end of the statement period 3 November 2009." Really not sure what to do, so any advice would be realy appreciated. I have previously requested that they stop any interest due to the financial position I am in but clearly they have no intention to. Help please x:confused:
  9. No not yet, he was unsure as he has a mortgage with them. I spoke to him and the Abbey card I though was a credit card is actually a debit so that clear's that matter up. All his other credit cards with Abbey are MBNA cards and he holds 3.
  10. I went to see Natwest back in March 2008 for a loam ,whcih they refused but gave me a graduate account and an overdraft facility of £2000. At first I took money out and paid into it regular. However when I separated from my partner I need to the money to pay some bills and have not ever had the money to put back. They wrote to my stating I was in breach and so I wrote back explaining the sisitutauon an offerring to pay £10 a month into the account. They never wrote back but I have kept to what I said. As it will take me a lifetime for me to repay this money, I wondered if anyone had any suggestions as to whether there is any assistance I can seek? Or even a loop hole ( I like them - but who doesn't) I don't know much anbout overdrafts execpt I intend to avoid them from now on. Natwest have never imposed any charges on my account, so I cannot try re-claim any. Any advice at all would be appreciated x
  11. Sorry for delay, lots on. Thanks for advice I can see that when it comes to Abbey and my parents cards I lack the knowledge to do this successfully. Think I will just avoid their accounts with Abbey and try the others. Thanks again - appreciate it . x
