  1. Please can someone help me out with this urgently so i can withdraw my claim, thanks.
  2. Can anyone advise what to put in the letter so i can send it to the Court? Also will i have to pay any costs?
  3. Also Paypal stated that my money would be released on 30 November, If they don't release it then I presume I would have a very strong case If I were to start Court Proceedings against them again in future?
  4. How do i discontinue? Also if i discontinue will i incur any charges?
  5. I need some help on this and need to decide what to do next, What do people think of the defendant's defence which is above? I have received an Allocation Questionnaire but i really don't know what to do, Do Paypal have a good defence? I like the way they try to worm their way out of it just because they are based in Luxembourg.
  6. *****UPDATE***** Paypal filed their defence on day 27, 1 day before they would have run out of the time. I have received a copy of their defence from the Court and from Paypal themselves and it is very long and lots and lots of pages but basically this is what it says:- Paypal admits that the paypal case blah blah blah relates to the account limitation on the Paypal account. Paypal admits that a balance of £185.78 was in the Paypal account on the date proceedings were issued. Paypal admits it has received various letter and emails from the claimant. LINKED PAYPAL ACCOUNTS (What this has to do with the matter i do not know.) A review of the Claimant's account activity confirms that he is the owner of three other Paypal accounts. All of these accounts have outstanding issues, These accounts are as follows:- Blah blah @soandso- Account limited for cross platform selling (what the hell is that?) Blah blah@soandso- Account limited for cross platform selling and unresolved merchandise complaints, Account is currently restricted with an outstanding balance of -£246.64 (Who's fault was it that the account has a negative balance i wonder??!!) Blah blah@soandso- Probable unauthorised credit card use. The claimant needs to confirm credit card & location to lift the limitation. (What using my wife's card with her permission is unauthorised card use?? What the Hell!! Then it goes on to say:- As the claimant has specified two defendants with whom he has no contractual relationship, the claim should be struck out on the basis that it discloses no reasonable grounds for bringing the claim in accordance with Civil Procedures Rule 3.4(2)(a). CONCLUSION:- In view of all theabove, Paypal firstly contests that there is any cause of action against the named defendants (Paypal (Europe) Ltd and Paypal (UK) (Limited) as they are the incorrect defendants to this claim.
  7. So Buzby, You would be happy paying over £400 for a phone that seemingly or it looks like it has been used as a demo phone or at least been used to take pictures. Would that be acceptable to you? **EDITED** Also i never got the chance to inspect and look at the phone the person who served me got it out from the back got the phone out then went out the back came back out and the phone was in the box and that was it.
  8. Buzby you are not very helpful at all being honest. Would you personally be happy if you paid out hundreds of pounds for a sim free phone only to find out that it had basically been used as a demo phone or had been used even though it was supposed to have been a brand new phone?
  9. Could i ask for a discount off the amount i paid seeming though it would be classed as second hand rather than new? Just trying to think how much to ask for as it is obviously not brand new.
  10. Yes i was definitely misled. Regarding the photos, the datestamp says 01/01/207 which is just the default time on the phone but i did not even touch the phone instore when i was buying it and i had someone with me too.
  11. I agree with what you have said Gyzmo, They should not sell a phone as brand new when it has obviously been used for demo purposes to show people the phone. I should write to head office and demand a full refund and inform them that i am considering contacting trading standards.
  12. Cheers for your reply andrew. Can i take the item back anyway? As it was only bought two days ago and surely Phones4U have some kind of return policy where you can get a refund?
  13. I bought a mobile phone from phones4U from one of their stores on Tuesday. It was bought Sim Free. However looking at the pictures on the memory card today i have found two photo's taken instore, Which means that the phone has been taken out of the sealed box and used and re-sealed, Is this allowed? I just don't like the idea of people messing with my phone when it is supposed to be new and unused and bearing in mind it cost me over £400. If i wanted to could i take it back for a refund?
  14. I forgot about an email that I received from Paypal last month it says the following:- Thank you for contacting PayPal. My name is Leslie and I am a member of PayPal's Executive Escalations team. I called your home number but the woman who answered indicated that you were not home at the time. I'm sorry I was not able to speak with you when I called. A review of your account shows that we are waiting to receive the requested information from you. Please log into your account and review the Resolution Centre to learn what information we need. We appreciate the tracking information you provided but we need you to provide a photo ID, proof of address and supplier information before we can review your PayPal account. I realize that you requested that we release the funds in your account at that time. However, PayPal discloses in the Legal Agreement that we may hold funds up to 180 days to offset any reversals in an account. Therefore, we encourage you to provide the requested information quickly so we may review your account in a timely manner. If you are not able to provide the requested information or remove the limitation, please contact me via email after July 27, 2009, and I will see if we can make an exception and release the funds in the account at that time instead of after 180 days. I can not guarantee that we will release the funds after 30 days but I will gladly review your account at that time. Again, it would be best if you provided the requested information so we can review your account quickly.   16. I checked my bank today and the money has gone back into my account so i got a refund but i didn't get a reply from the B&B.
  17. Paypal seem to screw everyone else, people like me and andy who are trying to get our money that in a way could be classed as 'theft'! If anyone screwed Paypal over i wouldn't give a toss about Paypal and wouldn't feel sorry for them at all. I've read hundreds and hundreds of stories like mine where people have never got their money back even after 180 days now that is theft so if they can screw people over and take people's money then why not play them at their own game?

Basically what it says is:- Defendants full name if different from the name given on the claim form:- PAYPAL (EUROPE) S.A.R.L ET CIE Address to which documents about this claim should be sent:- C/O PAYPAL (UK) LIMITED WHITTAKER HOUSE WHITTAKER AVENUE RICHMOND UPON THAMES SURREY UK And at the bottom they had 3 options either they could defend all of the claim, defend part of the claim or i intend to contest jurisdiction, they ticked:- I INTEND TO DEFEND ALL OF THIS CLAIM.
  19. This is a copy of what i received from the Court today, I notice that they changed the name from Paypal (Europe) to Paypal (Europe) S.a.r.l et Cie.
