If Mint (BOS) have not chased this debt since 2006 and did not request a token payment then the debt is statute barred. Whatever the general policy of Arden C/M may be regarding legal action, they can not pursue a statute barred debt in Court. Under revised OfT guidelines issued in October 2011, Arden are required to state that they understand this debt to be statute barred. Write to them and advise that this is a statute barred debt and that, due to physical difficulties, you are a vulnerable Client. Provide evidence of Disability Benefits and Medical condition. They should then confirm that no further action will be taken. If not, tell them to get lost.
