I sent my prelimary letter and my LBA to Capital one and was offered £395 as good will gesture. was going to put my court claim in but then an unexpected bill came in and the money wasn't available to pay the fee that was bout 2 month ago i now have the money for the fee but do i have to start the process again or do i just carry on and go to court now? ive read through the FAQ but this doesnt seem to be covered.

Sorry to interrupt on your thread but ihave gone through all the threads including this one regarding the interest calculations and still am confused. the 8% interest is calculated yearly but when filling in the moneyclaim what exactly do i do Eg. claimant claims interest under section 69 ....at the rate of 8% a year from xx to xx of (what is this total) and also interest at the same rate up to judgement or early payment at a daily rate of (what rate do i put here). Please help as i am filling my claim in today thanks caroline
  4. Halifax really annoying me now.... got a call from them the other day asking for payment of £63 they say I owe them. I told them that I was disputing the charges and until thecases was complete Iwasn't gonna put anymore money in my account. I checked my account today just to see if by any chance they had settled my claim brfore I submit my Moneyclaim and found that they had moved money from my joint account to my current account to cover the over limit charges. its a good job i checked cos my mortgage comes out tomorrow and that would have left it short and of course would have incurred charges!!!! I HATE THE HALIFAX WATCH OUT COS I'M COMING FOR YOU NOW... SEE YOU IN COURT!!!
  5. Thanks for your replies Just a quick question which I'm sure has been answered but i don't seem to be able to find an answer to ( Iwork night and have a lot iof time to browse):? Has anyone had a joint bank account closed from the Halifax which they are not claiming about? I have no charges on my joint account with my husband but am afraid they will close my joint account out of spite
  6. I bought a TVand DVD player about 4 years ago on credit from powerhouse. The credit company was First National I duly paid my £27 per month for most of the time but changed my bank account and they tried to take it from the first one and when it bounced the kindly charged me £20 per letter. They now say i owe them £295 in charges My question is should I pay them then claim them back or not pay them and explain that i feel they are excessive etc....:?
  7. Halifax's full and final offer of £905 wasn't so full and final after all:cool: recieved a letter today offering £1500 pity I posted my LBA yesterday isn't it? Think I'll drop them a thanks but I want all my money back or see you in court letter after the weekend

Thanks for that info Will be having a good look at the court stuff and on the moneyclaim over the next two weeks - sent Lbas to both Halifax and MBNA so am expecting to need to know as much as possible. When i worked out the claim it came to a total of just under £6000 with the interest. Even though the court fee will be £250 I should get that back when i win shouldn't I? Halifax -owed £4986 offered £905 LBA sent 29/06/06 Mbna -owed 1200 - no offeres LBA sent 28/06/06
  9. Still no further replies from Mr Richard Aitken who kindly offered £905 despite a reply letter saying thanks but i want all my money please. If no reply in post tomorrow will be sending LBA HAlifax £4986 owed - offered £905 refused Mbna 1200 now owed -no replies-LBA sent 28/06/06

Thanks for the reply;-) Got a letter this morning offering £905 as a good will gesture and also saying this was the full and final offer. of course if they can offer £905 then they can pay the full amount:p so i'm afraid Halifax you will be recieving my LBA one week from now (unless you pay up in the meantime of course)

Relatively new to the site found it after some kind person sent me the link Thanks Have sent prelim letters to both Halifax and MBNA Have recieved standard replies - no offers yet though Halifax owe me £4986 since august 03 which i have asked back:eek: Both have until next week to pay me or they'll be recieving my LBA My account is over limit by £121 at present even though nothing has gone in or come out since March this is charges in June only!!!!
