  1. I received my DPA info today, but I have a problem I don't know what to do about. I asked for the last 6 years, but the covering letter Barclaycard said this; "Enclosed you will finc copies of your credit card statements from June 2004 to the present time. These statements are stored on computer. We will be sending your statements prior to this date later. These later statements are stored on microfilm (rather than computer) and, take more time to search and reproduce. We will get this information to you as soon as we can. This is likely to be within the next 6 weeks or so." I originally sent my DPA request off on April 17th, so they have 40 days from that date to supply me with all the info I asked, which would take us to May 27th. Today I get a letter explaining they have sent me only partial info and will be another 6 weeks (maybe) until I get the rest. My question is this; Is this legal? Can I file a complaint after the 40 days saying my DPA request was not fulfilled? Do I stick to my 40 days or do I have to go with the Barclaycard timelime on this? HELP!! Thanks

I will do that I was talking to a friend of mine earlier today who has been there and done it with Credit Card companies and he tells me that the CC Companies work faster than Banks do when it comes to charges. Apparently most offer you the difference between the amount you were charged and £12 pretty soon after you request it. Heres hoping!
  5. I am considering reclaiming charges RFS have charged me in the past for late payments, admin fee's etc. But I don't know if it is possible to reclaim these charges. Does anyone know? If so, where do I get the templates and is the process any different than the bank process? Do you still send the £10 & DPA letter? Thanks
  6. After successfully claiming back all my charges from the Northern Bank, I thought I would turn my attention to Credit Card companies - in this case Capital One, and attempt to reclaim all my charges. DPA Letter all ready to post tomorrow. Lets hope they dont take long sending out my info!

  9. I have recently successfully claimed against my bank who refunded all of my charges. However, I would like to know if it is possible to persue all of the credit card companies to reclaim charges they would have imposed, or is this claiming thing limited to bank accounts only? If you can claim against them, can someone paste a link from this site (where there is one) about the processes involved with CC Companies? Thanks for any help you can give me
  10. Each case is different but when you file your small claims case, thats when the Bank know you are serious. Generally speaking they settle out of court. When this happens the norm is they refund you the full amount they have taken from you in charges plus interest (which is the amount you would file with the court) as well as reimburse you with the court fee. Some Banks however make partial offers right up until the Court deadline. My advice is to stick with it and accept nothing less than the full amount as sooner or later the odds are you will get it. The Northern Bank offered me a partial refund a while ago and I was briefly considering it. However one guy on here summed it up in a nutshell...if the shoe was on the other foot and you owed them XXX amount, do you think the bank would settle for less than that amount? I think not. So go for it, claim all the way.
  11. I paid £62 in court fee's but I believe its dependant on how much you are claiming. You pay the fee's upfront when you file the Court Claim, but if the bank loses the case - which they more than likely will - they have to pay you back the amount you paid in fee's on top of what they owed you.
  12. Yes you can claim everything back bernard. I just won my case against the Northern Bank, they settled in full.
