  1. Hi, No CCJ and its been 16 months since last time I made payment. Been trying to rack my brains on this one and the loan was originally taken out some time in 2002

Hi This morning, out of the blue, I received a letter from morrcroft (acting on behalf of bank of scotland), wanting to discuss settlement of a 9K loan and that as I hadn't replied to their previous letter (what letter? never received) that they would pass my account to their Home Collections Division which could result in soemone knocking on my door. They are asking me to call them........should I? especially as I would query the account and amount. I did have loans with them 6 years odd ago but thought they were all cleared up as I payed reduced payments for years. I have moved house a few times and I will admit my book keeping skills arn't that brilliant so there is a chance I have miscalculated but never thought of being that much money adrift!!!! Any sound advice as to how to procede... Thanks
  3. Hi rebel11 Eon are the ones who are now chasing me for £2K, scottish power are the compnay that should of taken over the electricity supply. It was obviously all going through, or gone through, as I have a final bill from Eon saying sorry you're leaving us...........
  4. Hi, Received an email this morning from Eon saying I owe them £2000! Now I havn't quite got to the bottom of this but the story is as follows:- 2008 moved into rented house deceide to change my gas/electricity supply to one company assumed all went to plan (damn that was a mistake) 2009 received an overdue FINAL bill from the old company saying sorry your leaving us but pay your final overdue bill now - which I did in full 2010 bills are all on line with new supplier and DD set up so thought nothing of it 2010 left house rang company provided readings closed account- told supply new address and they were to continue supply at new address - job done. Now it appears - that, due to the email I received this morning, a problem has occured and I have been in limbo between suppliers, and that i never did leave the old company (even though I have letters from them telling me that i did) Now I guess I'm at fault for being nieve and not checking all the details and assuming that two major suppliers could handle a simple change in supply - however, I now have a problem...... Any suggestions as to a course of action greatly received.
  5. Hi, Just a quick one..........barclays are suing me for 5K loan. I have counter claimed with 2.5K of unfair bank charges on current account and wanted the 2.5k deducted from 5k. Barclays have submitted a affidavit saying that two sepperate cases. 2.5k is stayed pending OFT case therefore seeking jundgement on 5k. They have produced an unsigned credit agreement. Hearing is on the 14 jan. Any advice?????

  7. My own experience is:- 1. The house is not in your name, therfore they cannot go for it. If it was in your name, and lets say, you transferred it solely to hers in the last two years, then they could make a calim as it would be seen as you disposing of assests. 2.I'm not sure about the car, other than if It can be proved you require it for work, then it cannot be seized, other than that it can.
  8. I agree. One of my loans is now 4 years old. I quite happily paid it for the first 2years (5 year loan), and then I remorgaged to clear everything. My big mistake was not to ask for a redemption figure. i purley worked on my own calculations. Therefore, after securing the remorgage, then asking for a redemtion figure, we were about 5k apart (there's being the higher). Now I suspect (and I will now show my ignorance) that i got mixed up with paying off capital and not interest, therefore the first two years I was paying off the interest only, and probably wouldn't start paying off capital until year 3. Anyway........I have no documention for this loan, would like some?
  9. Hi zooman, Again, thankyou for your advice. You have answered another query of mine recently. Firstly, sky, they are impossible. I tried to cancel my subscribtion, but kept being put on hold.....in the end the only way to stop was to stop paying them. It worked but now the DCA's are on my case.... Secondly, I keep following threads about asking for a copy of the agreement, if one cannot be produced,then the debt is unenforceable (spelling check!). I want to right to all my creditors to get a copy of agreements (mainly because my filing of old is appaling, so I would like a fresh copy of all agreements).....however should an agreement not be found, it would appear the debt cannot be enforced. Therefore should I write to DCA or original creditor?
  10. Hi, I'm in a bad finacial way. i have fallen behind on a lot of bills like sky/catalogues/credit cards. Anyway as expected I am receiving letters from DCA's saying they "they are acting on behalf" or "our client has instructed"...... Does this mean that my debts have not been sold ? and that the original creditors are the ones I should be talking too ?
  11. Hi All Whilst going through my statements, i found an item, which pointed to interest being charged on unauthorised overdraft. I suspect this is when I have gone over my agreed overdraft limit. Question, Can you claim this back ?
  12. Zooman, Many thanks for your reply. I have since spoke to the DC, and told them that I'm preparred to go to court, with that there was a sudden climb down on there behalf and they are happy to proceed with the original agreement. This was after they tried "so your paying XXX amount" and I said no its X amount. Having looked through the form you linked too, i'm tempted to go to court, because my financial review dosn't take into some considerations the form does, and I would probably end up paying less.   13. Help ! I have been making reduced payments on a loan, via a dect collection agency, who are acting on behalf of the loan company. I have been late a couple of times on payments, however have always brought them up to date. However, I received a letter from them this morning saying that papers where being prepared for court, and if I don't pay the full amount by 10am monday, then court proceddings will start. I cannot pay the money, I cannot pay more than what I am doing now. They allready have a breakdown of my finances showing this. Should i go to court and see what a judge says ?? Starting to get nervous. Any advice
  14. Hi everyone, This is my first posting to the Forum. I have been following the threads with interest over the last couple of months with interest having found out about this forum via motley fool. I am just starting out, I was luckily enough to find a draw full of statements. Going through them I nearly up to a 1000 pounds that barclays have "stolen" from me, strangely enough my overdraft the last few years has risen to a 1000 ! Coincedence maybe !!!!!!!!! I have some blank months to find, so will approach BB with the DPA letter. On another note, I got a letter from barclaycard yesterday saying they were dropping charges to 12 pounds !!!! Admittance of guilt maybe!
