I hope you mean get their finger out lol And yeah I'm worried about being left paying a fortune back to Shoosmith, I've been wondering if I can submit a counter with fees for my time and expenses play them for awhile.

Not sure what documents Crap Quest actually have. Not sure how far this carry on is going to go tbh.

And another 8 week extension so they can retrieve the documentation, sheriff to them last one either move forward with it or drop it. At the current time can I request all documents that cap quest have about me?

Sorry for the slow reply, I allowed it to go to court. Shoosmith didn't attend but used one of the clerks as in intermediary. They requested a further 3 months to get files but the sheriff gave them 4 weeks plus they also have to send one of their own people to attend in person, he wants them to explain why they have me up in court. That was after he read the letters they sent to me, I guess their own letters aren't doing them any good. See their latest communication, says there was a document enclosed which there was not but I'm not surprised. leter.pdf

Hi again, sorry didn't get and email notification saying you had replied back , that or I have over looked it in my inbox. I received the attached letter today via recorded delivery, now I'm no expert but I'm pretty sure they are saying that this was called in court on the 31st and heard by a Sheriff. et I know for a FACT they changed the dates themselves and they didn't attend court! Advise please as clearly they are at it. shoo letter.pdf

I'll call the court on Monday and make some enquires, in the mean time do you have any suggestions or template letters I can send to Shoosmiths at this time? That's now 2 months I've been waiting on CCA request to be fulfilled on and now the carry on with the court. I can't help but feel this is an attempt to lead me astray to get automatic decree.

The clerk I spoke to told me that its not the court that sends out the summons but Shoosmith lawyers. I have no idea to be honest, I'm thinking I may require some legal help on this one as it seems to be above my head.

I returned page 7 on the 16th of January, I went up to court at 10am along with my Father on the 31st to defend my position and sat waiting to be called, eventually spoke to a clerk who checked the details of the summons and I was informed Shoosmith had contacted the court on the 20th of January 2017 and changed the date to 25th of April 2017 and that I had to return page 7 on the new summons. I have not been informed of this change in date from Shoosmith by any means and I haven't been issues a new summons either. I have also been waiting from December for my CCA request to be competed by Capquest, the request has been acknowledged twice. Can anyone advise me on this please, cheers.

Multi-page PDF created and attached. The amount added hasn't been added via court, I check my credit file (noodle) and have discovered Capquest adding to it. December 2016 it was at £628 this month it has been updated to £814. No defense was submitted as I wasn't requested to, was only to file what I would be doing. Hi guys, been dealing with Capquest via Shoosmith. Sent CCA requests to Capquest via Shoosmiths as you can see. Even though they said no further legal action would be taken I went to court to day regardless after sitting like an edjit for several hours I went an spoke to a clerk. Turns out Shoosmith changed the hearing dates on the 20th January to 29th April and I've never been informed! At the current time I have yet to receive any documentation in regards to the CCA request yet my request has been acknowledged. Why has Capquest added £186 onto this account since last month? Why is Shoosmiths still taking me to court even though they said no further action will be taken while Capquest is "investigating"? Sorry this is meant to be the 25th not 29th.... And dont know whats going on with post images, was having bother adding them.

Right now our council tax is paid by direct debit. I do know that when we first moved in to our first home we were a bit lax with Council tax payments, hence why we no pay DD as its much easier and less hassle. In regards to our debt, this was being reclaimed though JSA but my wife got back to work just before Xmas. From my understanding we were dealing with Charles Anderson and that is why I'm confused as to why I'm now being contacted by ANOTHER Sheriff Office. Is there a template letter I can send to Walker Love to validate their claims? Surely I would need to see a summary warrant if its been issued and can I ask for a copy of charge for payment?

Magistrates are England and Wales only, I'm in Scotland. Even at that I've never received anything from the court asking me to attend, not for council tax anyway. Is there a letter template or something that I can send them, I've learnt never to talk to anyone on the phone in regards to debts.

Received this letter in the post today, I've never had any contact with them before. There was no other information included so I dont even know which years this is apparently for! What would be my proper course of action? And how do I find out more about this 'summary warrant'. Regards

I have asked them to remove my phone numbers from their system, they sent me a letter saying this has been done but the will re-add my numbers if they don't hear from me. Now how can they add my numbers back on to their system if they have been removed? -

So been dealing with these muppets for the last few weeks now, they started calling my mobile I have now blocked that number so I don't get their calls. The other day I received a call to my house phone from the same idiots, after I refused to "confirm" my details over the phone she said they would send someone to my door which I promptly told her not to bother blah, blah, blah. Any way I requested that she remove my house number from their database, to which I was told that it would only be removed for 14 days and it would be re-applied to the database permanently. I told er to stop talking a load of crap and said goodbye. I today received a letter that went like so If my number has been removed how can it possible be re-applied? And I was under the impression that they couldn't do this. -
The walls have ears and so do I. I was thinking of meeting the clubs master and recording the conversation, that way I have undeniable proof that these things have been said. Although I am not sure on my legal stance on this.

Hi guys, So I'm gonna break this down as good as I can. Recently I decided to let my 4 1/2 year old daughter take up martial arts (my brother has been attending the same club for 10 years). She loves it, so a few weeks later I decided to take it up myself as I am not as fit as I should be, alls good and well and I was really exited. So the first day there I discover that my sister ex boyfriends niece goes to the same club. They had a very bad split up, the ex has been causing a lot of trouble and causing it when ever he can. Nothing to do with me and I've always keeps away from it. The second day there said nieces mother turns up, this is the first I have ever laid eyes on her and I only knew her before hand by name. So a week later she start telling parents of kids that attend the club that I am a convicted paedophile. The master of the club now wants to meet with me urgently face to face, I'm only presuming that it is to do with this woman's claims. These claims are untrue and I am at my wits end as to what to do, as I type this up I feel like my stomach is hollow and feel like throwing up. I'm terrified that I am in danger of losing both my kids (Daughter 4 1/2 and Son 16 months). Not to mention I am afraid to step outside my door, most members stay with in a mile of me. Right now I feel like throwing a tube of paracetamol down my throat and just letting it end. What can I do? I need help before I loss control of a situation that is already drowning me emotionally. P.S. I have already looked at the few slander thread that are on here, but none seem as extreme as this.

You know I see plenty of threads where people are getting great help and advice, quotes on what they should be putting in letters and emails. Yet when I post I seem to get told to go look for myself! Come on whats the point of these forums if peeps are just gonna tell you "go read this" "go read that" if I wanted crap advice i'd go to my local CAB office. I see threads where people are getting spoon feed info, anyone wanna spoon feed me? lol

OK so here is and update on the situation. Today I was going to buy an item but here is the thing that item already had FREE DELIVERY, so that would make their offer of free delivery pointless, so I called them below is an outline of that call Can't give a full refund. Item has been in use for nearly 6 months before it broke down. I am not entitled to a full refund because it is past 28 days. I won't be losing money, even if I bought an item of say £25.84 and postage costs £3 I still wont be lossing money even if the original amount is £34.59! Go figure that one out. then the guy had the cheek to turn around and say to me "look sir we are getting no where, we are going round in circles"! it was him that kept repeating "Your getting free carriage, your not lossing money". So I'm sending them an emial and maybe a recorded letter, what am I wanting this letter to say? Advice please.

So after posting I checked my emails and discovered I have finally recieved an email from aria about my item, a little late. So it would appear that they are offering free postage with the credit note. Does anyone thinnk that this is fair?

Hi guys, here is the situation. On 1st June 2010 I ordered a new graphics card for my pc from aria.co.uk. Sometime in November the card broke down, so I contacted aria as the warranty was with them. 1 day short of 7 weeks after returning the item I called them (after not getting any replies to my emails) and I was adviced that the item was found to be faulty, it was not repairable and it was no longer produced. Now because they couldn't supply me with a replacement they would give me an instore credit note. So I got my credit note but it wasn't for the full amount that I paid, it was minus the shipping charges. I would like to know if I am entitiled to a FULL refund which includes item and shipping charges. Invoice attached - Invoice.pdf
