For Info guys Olympian Financial took over Swifts Old building in Hornchurch and the owner has a good relationship with Swift on many levels. So you may find that they "churn" a lot of swift mortgages" to other Sub Prime Lenders. With regards to commission you are correct on about 2% to 5% but it has come down over the last year or so. With regards to unenforcability I was under the impression that asuming one thing was wrong with an agreement then the whole thing was void. So rather then go just for getting your charges back you should go for the jugular and argue the whole thing is unenforcable therefore void. Sparkie you are good by the way I take it you either have legal training or are a Solicitor etc and just helping people out on here!!
