Hi All, I'm not sure if I have anything here, but I have a car on finance with Park Motor Finance and whilst unemployed for 5 months I never missed a payment although I did start paying at the end of the month instead of the beginning as this gave me more time to accumulate the necessary payment (£233). I started work again in Oct and asked to carry on paying at the end of the month. Now what i didn't realise is that every time this has happened they have charged me £10 + interest approx £4.53. I complained and have received a response telling me the charges will continue to accrue every time an instalment is missed (no payments are missed I merely pay them at the end of the month rather than the beginning). Can they do this? or do I carry on paying the charges until I have a spare £233 so I can pay at the end of the month and the beginning of the next? The agreement ends in June 2013! Point 2 with these ****ers is when I do call to pay they are keeping a note of the number I called from and then a week later once the instalment date is missed the calls and texts start. I use a work phone and at no time have I given them permission to store the number yet the calls start coming. The first time this happened I complained and the response was human error. The second time this happened I was told tough - bring your account up to date and we won't contact you! Is this a breach of the Data Protection Act because a) the phone I called from could have belonged to anybody b) they are storing and using my personal information without my permission albeit to contact me or c) when they do call / text / leave voicemails they say they are calling from Park Motor I have been told as they don't say 'Park Motor Finance' this is fine. They still ask for me by name. Lastly I'm paying £233 per month for 5 years for a car which cost £7,500. Unfortunately they were the only ones offering me credit at the time I needed the car so to get anything back from them would be a bonus! Please help...

  3. Thanks Slick, Is there a spreadsheet to calculate the compound Interest? I have had wins in the past from Abbey, HSBC, Capital One, Egg and Lloyds with the 8% but BC have annoyed me so much I would like to claim back as much as possible. Taking the action to court isn't a problem. I just need to see if it is worth the extra time and expense!
  4. Hi, I am just starting the process with MS / Barclaycard with about £500 in charges dating back to 05. What is the interest I should charge for this? I currently pay BC 1.597% monthly or 2% for cash (monthly). Would I charge these rates or do I charge the statutory 8%? Any help would be really appreciated! Nickd
  5. Thanks, One question I do have is if I send the DPA letter before action letter and send an account in dispute letter to Mercers will this damage my credit file? Also if or when it goes to court if a judge finds in my favour will all inaccurate history sent to the credit agencies be deleted? I think my plan is to send the letter before action giving them 40 days to show I am being reasonable, and also send an account in dispute letter to Mercers/BC so they stop chasing me!
  6. Sorry its taken a while, but I finally sent the SAR to BC on the 16th October and have recieved back copies of statements and a print out from an old dot matrix. But what I havent recieved is a copy of my credit agreament. Alos the account is now with Mercers (due to 3 months of no work). Should I pay them or do I put the account in dispute? Does anyone have a template letter for this? Lastly my aim of this is to get the debt written off, the path I was going to take is the DPA route. Is there a better way as taking this route I would presume I still need to pay them?
  7. Thanks for the Info, I think i took the Ms card out in about 2004 applied on-line if that makes a difference? Once the request has been made for a copy of the original document should I carry on paying them as normal? Nick

  9. Please HELP!!! I have a Barclaycard Platinum previously goldfish and prior to that MS Gold. Although I'm not in default I have had plenty of charges and would like to get a copy of my original credit agreement for the MS days. What process do I need to go through to request this? Is there a template? On a second point what happens if they are unable to provide this? Can I get the whole card balance wiped? Also I took out an Egg card in 2004, which after having my card cancelled in early 2008 (mass cancelation of cards), I settled the balance of £5k. I have recently received all of the default charges back but can I also get a copy of the original agreement from them? Again if it is unlawful do I have any comeback? Thanks, Nickd911
