thanks for all your help, i will get it all down in writing and send off a letter this week. FIngers crossed they accept errors have been made, and I had re-taken the test, but just not applied for new one due to various errors which resulted me getting my old licence back.

the licence was a manual. To be honest, being as it was 9 years or so ago... I dont remember getting a provisional licence. I remember having my original counter part with the 6 points on, and the bloke asking the question at the test centre... But allowed it to continue as I explained i had to re-test due to 6 points rule. I was told I get my old license back with the 6 points on upon completion of the test. But i now understand, you get a new licence?? and the points are wiped? So from what I understand is, the DVLA didnt revoke my licence.. they returned it with the 6 points stamped, to the courts... and upon completing my tests I produced my pass certificates etc at the courts and they gave me my license back, and kept the pass certificates to send them to dvla! This was not long after this 6 point rule came in, and no-one knew what they were doing. I was one of the first the test centre had to do a re-test, and even my driving instructor had no idea!! Whats the best thing for me to do? As far as i was concerned it was sorted. But now appears this admin error, which was not a fault of my own is causing them to say I need to do my test again. They have not revoked my licence still, and have no idea what is going to happen. I have contacted a solicitor and will be sending out a letter to relevate dvla department this week.

To start from the beginning. In about oct 2000 I got 6 points on my license, which was in the first two years of driving. So dvla rules, my license was revoked & then I had to sit out my theory & test again! This being completed in may 2001. I then went to the courts - who revoked my license, payed them a fee (cant remember how much) and they gave me my licence back as I proved I had re-taken the test. I was told this was what had to be done, and I would get me old licencse back. So i have been driving since. I have been stopped by police few times, and hired cars etc etc.. with no problems, Until october 2008. I went to hire car, and had no counter part. So they phoned DVLA to check, DVLA spoke to me said its ok to hire the car, but they had my new version number counter part & I had to apply for it. So I applied, but got back a provisional license. Phoned them today and they're saying because I haven't applied for new license within 2 years of re-taking, I have to do my test again?? I am fuming!! I have had no problems with the police, various dealing with the dvla, car insurance etc etc.. But now they spring this on me?? The dvla even let me hire cars.. they gave the autorisation to the car hire centre!! only 4 months ago. So due to various mistakes by the court, dvla... I now have been told I no longer have a LICENSE, and have to re-apply!! My job relies on me having a license, so its likely i will also lose my job!! anyone help me ?? please
