So far i have received the 'parking charge' notice. It was captured on ANPR on 1st May with notice being sent on 10th. It states that payment to be made within 28 days of date issued 7th June , And then immediately underneath it says reduced to £50 if paid within 14 days of date issued which is 24 th May.

Update. The property has finally been sold with a deficit of £2.5k which i have made arrangements to settle with the mortgage company. Restons released the charging order so it now remains to be seen if they try to get me to increase the payments after 6 months. At the moment the whole thing has taken its toll and i will probably wait before i hear from them again before challenging them about added interest charges and associated costs. Thanks to everyone for the advice received. -

Ok, i expect the sale of the property to go through in the next 10 days so i think i will wait until its complete and then write to them and ask them to fully explain the 22k outstanding. Will keep you informed, thanks for your help. -

The fee i refer to is the monthly payment towards the original debt. This has never increased and my recollection is that the judge stated there would be no interest rate additions at any time. Obviously the charging order will be lifted as the property is sold. I also dont dispute that i owe around £16k as stated on recent account summary from HFC, the issue is that Restons are saying that the amount to settle is £22k. I paid the loan for a number of months and have paid the monthly charge since 2005 so it seems ludicrous that the sum outstanding is almost the same after 9 years of payments. -

Sorry, but im getting more confused. If it's expired why do Restons have to release the charging order so the property can be sold. Also i am still paying the monthly fee as agreed in court in 2005. Surely if i stopped paying they would take me straight back to court for not complying with a ccj! -

I contacted the local county court who gave me a website to do a search on myself. The cost was £4 and the result was nothing on record. Im guessing that might be because of the length of time. I am hesitant to contact Restons at the moment as the house sale is not yet complete. Are they obliged to send me a copy of the judgement? -

Sorry i was away last night. The date was 2005 and it was heard in my local court and i did attend. I am virtually certain the judge stipulated no additional charges and no increase in interest was to be applied. -

Can someone advise me the process for getting copies of the ccj from the court. I only know that the judgement was sometime in 2005. -

Surely i can get a copy of the ccj ? Wont this tell me the details. Im not trying to avoid the monthly fee just to ensure they are not adding costs to it. I already have a statement from HFC in July 2013 showing 16k outstanding and i dont dispute that What i dont understand is how Restons are saying it is £22k. -

Update: finally i have a sale which is £2k below what i need but the mortgage company have accepted the proposal to pay the shortfall and Restons have agreed to release the charging order. Interesting thing with Restons is that i have commenced paying the ccj payment again which is £35 per month. Their documentation sent to me indicates that there is £22k outstanding but the paperwork i received from the lender and who receive the money indicates £16k. I smell a rat but dont know what to do. Im 90% certain that the judge did not allow any interest payments when they won the ccj but i have lost the paperwork relating to this, all i know was that it was in 2005. I also checked the original loan and i did not take ppi. Can anyone advise on how i should now deal with the ccj/charging order please? -

Todays update. Went to council tax office, they only offer 25% relief so will have to pay £96 per month in the meantime. Also buildings cover is expensive on an empty property £155 for 3 months. Gas and electric will need to stay at a low level to avoid freezing pipes. I have instructed estate agents to try and sell and have given a deadline of end of January, unfortunately if it doesnt sell by then i will have to voluntary surrender. Fingers crossed. I will inform mortgage company tomorrow that i am remarketing until the end of January and not paying them in the meantime.......should be interesting. -

What about buildings insurance and council tax? I would struggle to pay these as i have moved out and am paying bills on a rental property. Would also guess that the premium on buildings will be higher on an empty property. Also without the mortgage company agreement the monthly mortgage would be due which is £700 the mortgage company did say they would work with the original estate agent. -

The property is empty save for curtains and also a tv and sound system installed in lounge which the prospective purchasers were going to buy. The mortgage company also suggested an assisted sale. My understanding of this is that they would give me time to try and find a new buyer but that charges would still apply at some point. The house value is around £165k but i had agreed a price at £148k purely to get rid and Ay solicitor/ estate agent fees. -

Well things have now gone from bad to worse. My house has been sold only for the purchasers to change their minds after i moved out and before exchange of contracts. I now have a house that i can no longer afford and little prospect of it being sold quickly. The mortgage company have suggested voluntary surrender but i would need to agree with my ex who just doesn't seem bothered. Anyone who can suggest a course of action please? The outstanding mortgage is £145k and the sale had been agreed at £148 which would have left a reasonable situation, my concern now is that the house could be sold for significantly less. -

I have a feeling that they have all been destroyed and i would probably need to start the process again. I will look for them in next few days but not confidant, the reason the house is being sold is due to divorce and much documentation was destroyed during the process. -

I didnt really think i could win the case and financially couldnt afford to fight it. Very soon i wont own a property so i will look into how i can deal with it as the payment will carry on for years. -

Thanks, i can only point out that i have paid for last 5 years so that would suggest that i will not do a runner. I am not purchasing another property, does that have any effect?
