  1. it may well be, especially if they take you to court and end up getting less.
  2. if they need proof of who you are they shouldn't have sent you anything in the first place, its all very well comming over all data protection, but they've already broken it if they sent you details of someones debt without being certain of who you are. payments do not proove admision of debt, they could proove you were too scared not to pay, or you did not know your rights. Does payment to a mugger prove you owed him money?

I went to uni in the last years of the grant (half grant half loan), the loan does not have to be payed back untill i earn over what they deam to be half the average wage; last year it was about £1900 per month, I know i won't ever be earning that much so i guess i'll get it defered for ever. I know if i had quit before the course was finnished i would have had to pay back my grant aswell. I would imagine the Uni would let you pay it off by payments, the problem comes if you completed the course they may not give you your degree untill you pay em, but as you have none they can't do that. i know when i was there even a library fine outstanding could cost you your degree, and they know how to give library fines. as far as know things are even less generous now, but as has been said before they can't get blood out of a stone, the important thing is to talk.

  5. i WAS paying these idjuts, when they started the letters about no tolerating things, so i CCAed, i was still prepared to pay while they came up with the docs but as they kept adding stupid charges on i stopped paying. so had they kept quiet i would have carried on, all the threatograms have done is stop me paying.

Um, well that is a bit silly. an executed agreement is exactly that. i have had a couple of these sent to me and i have refused to accept them. if they can't or won't supply a copy of the executed agreement one must ask if indeed such exists. I would imagine if it went to court and the creditor turned up with an executed agreement, the court may ask whey it was not shown before when asked for. I agree that they aren't going to give you the actual agreement because you might "lose" it and they would have no claim, but can they seriously expect anyone to hand over money just because they want it? I mean i can't honestly say i remeber every penny i owe.
  8. Hi, i've got a copy of the 1974 act, but i know it has been updated a couple of times, where can i find details of these updates? One that puzles me is the one about s77/78 and this so called true copy; the 74 act (great year i rember it well, twas when i left school) mentions a copy of the executed aggreement, so when i put in a request under the act i expect a copy of the signed agrrement, but some creditors are claiming they do not have to send this, only a "true" copy which seems to be an unsigned credit agreement. to be honest this is of no use to me, and if this was the case couldn't they just send out unsigned agrrements to any one they liked claiming they owed them money? What i want/need is a copy of the executed agreement as in the act so i know if this is indeed my debt. can anybody shed light on this? cheers.
  9. i don't think you need worry. I've thought about this question and if a court asked why i have been paying money off a debt that i know am desputing I would answer that i was scared and payed it, if your only making tokern payments aswell all the better.
  10. cheers, I wrote to: Barclaycard Costomer Relations Department 1234 Pavillian Drive Northampton NN4 7SG these seem to be the people who handle complaints, i first got put onto them when i wrote to barclaycard telling them i thought the bullying tactics of mercers where a bit over the top for just going a few weeks over on payments, and i thought a big company like barclays would not have used these "thugs". the addy they gave me was: Customer Care Team Barclaycard House Norwich Way Liverpool L32 8UY Not sure if these are the people i need to talk to, although it would be nice to think there's a whole "team" working on my behalf, whether or not they would be the right people to find my CCA i'm not convinced.

My wife and i are a little in debt, and when we moved we lost a lot of paperwork, i am in the process of writing to people i may owe money to to ask if they have a CCA so i know who my creditors are. a lot of the address i write to don't seem to have anyone who can read working there. they either ignore me completly or write letters that bear no relation to any i have written to them. i have not been phoned by anybody because i forgot to tell them my phone number. the one address i need at the monemt is for barclaycard, i got some rubish from mercers and calders, but when i try writing to barclaycard they keep starting the complaints procedure. who can i write to ask for my credit agreement? cheers
  12. harajuku, why do DCAs ignore my letters, one even admited they had not read them and had loat them! I've sent 100s and only got a few replies.
