  2. Hi All Could you possibly advise if the statute barred rule applies to mortgage shortfall after reposession? My son had his house reposessed by Halifax in 2002 and has since been living abroad. Letters have been sent to him at my address periodically from various solicitors requesting payment of shortfall. I just bin them. No contact or payment has been made since the reposession and I am wondering if this is now statute barred, can you please advise?
  3. Hi all, received letters from court and also from HFO today. Court say a copy of my defence is being served on the claimant, the claimant may contact me to try to resolve any dispute. If dispute cannot be reolved informally the claimant will inform the court that they wish to proceed, the court will then inform me of what will happen. Where he wishes to proceed the claimant must contact the court within 28 days after receiving copy of the defence. After that period has elapsed the claim will be stayed. The only action the claimant can then take will be to apply to a judge for an order lifting the stay. HFO gobbledygook states " Please be advised that your requested had been made" Err pardon? They also say that it will take up to six to eight weeks for them to receive the requested information as they do not hold copies of the original agreement and statement. The account has now been placed on hold, which means that further action (dont they mean No further action) will be taken toward the account until they receive all the requested documentation. signed Stephanie Dubant

  5. Hideous people! what a way to make a living eh? Cant beleive they are getting away with all their underhand methods, the OFT must have had so many complaints about them.

  7. Got the defence sent off recorded. Thanks for your help, I am my own worst enemy I bury my head in the sand and leave everything til the last minute! Ive just come across a letter I got from T&R in May saying...... We act for HFO Capital Limited("HFO Ireland") a debt factoring company incorporated under the law of Ireland (company number446327) who has been assigned your debt from HFO Capital Limited ("HFO Cayman") a company incorporated in the Cayman islands (company number MC-138277). HFO Cayman originally acquired your debt from BARCLAYCARD ("the Original Lender"). For the avoidance of doubt, this letter constitutes further notice of the chain of the chain of assignment.

  11. I acknowledged by post. POC... The claim is for monies due from defendant under an interest bearing credit agreement. The defendant defaulted on this agreement on (no date ) The Claimant HFO Services Ltd is a services and collections company which collects debts for HFO Capital Ltd. HFO Capital Ltd purchased the Defendants account and all rights and obligations attaching thereto from the original lender on (no date ). Notice of Assignment has been provided to the Defendant. The Claimant claims 225.00 being instalment arreas due from the Defendant. On satisfaction of this claim and the costs there will be an unpaid balance of (they left this blank) to be paid by the Defendant which is accruing interest at the contractual rate of 12% PA signed Turnbull Rutherford
  12. Hi sorry I havent got back to you for a while, I havent been able to scan anything up and have got myself in a terrible state over this. Received court claim form issued 1st june from Northampton Court, sent acknowledgement stating I was defending all of claim, sent CPR letter to HFO which they recieved on 22nd June and have had no reply from them. They are only claiming £225 which they say in POC is instalment arrears from defendant. This is the amount Turnbull and Co bullied me into agreeing to pay monthly or they would put a charging order on my property, they told me to get it from friends or family and said this was the least amount their clients would accept. Not sure what to do next! This happened a couple of years ago when I foolishly contacted T&R by phone when I was spooked by a letter they sent me. I paid one instalment.
  13. Hi, after I sent the Account in Dispute letter to HFO I received a copy of my original application for a Barclaycard dated 10/1997 which is very smudgey and barely legiable plus copy of T/C. I have today received a letter from Turnbull Rutherford Solicitors ( same post mark as HFO SW19) threatening legal action if I dont pay up within 14 days.
  14. Hi, I recieved a reply to the SAR I sent to Barclaycard today but it only contained copies of statements and none of the other information listed in the SAR. I also received today a Schedule Of Litigation from HFO " because you have failed to contact us" even though I sent them a CCA letter on 11th feb. My last payment to Barclaycard was made in July 2006. They were charging me £20 for late payment, £20 for exceeding my limit plus over £30 interest every month. Any advice on what to do next please?
