Hi i have been on hold with things due to family illness i am yet to fill out CISS sheet and take things further , been paying mars each month - had a call today to review things and can i get a remortgage with someone else as my interest isn't covered each month on the arrears. There is an SPO in place which still has 2 years left i said and i pay £146 extra a month I am going to sort things BUT in the mean time can they change the SPO amount ? i thought it had to be in place for the 6 years and they couldn't change it? they also want income / exp to see if i can pay extra.. giving me 14 days to make an appointment with a mortgage advisor to see what i can do to pay it off or remortgage... apparently they are trying to help me. I filled a complaint about the call and asked to speak to manager and he didnt know what to say. I will not talk further i was caught off guard and i should in future not talk i know this but letters are often so vague and threatening i never know what they mean

I do love your straight forwardness sometimes Yes i will keep fighting back , do i stand a chance ?? hopefully I do get anxious and ramble , i am worried they'll try and get an eviction date if i do not up my payments as i have broken the SPO due to covid , which is understandable but the payments should increase to cover the covid break as with every other mortgage . I am hoping that i have time before they try and pursue things thats why i wanted to write back to them?
  3. i know but they scare me and letters like this scare me even though i know I've been paying what i was told so they can't do much at moment can they? thats all i am asking ... a little bit of reassurance , i do suffer with horrendous anxiety i want rid of it and to pay it off , but i don't understand that i won't be left with a balance still as I've had it since 2007 and apparently ill be paying £143,000 back on a £30,000 loan. Well i won't have paid that much back so they can turn round and say i still owe a lot can't they? even with fees taken off? I've been paying since 2007 where do i find this CISHEET can i put in for a court date to ask for time to finish SAR and get legal advice and to ask to pay the court ordered amount? or can i write to Mars and say i am paying the court ordered amount back as instructed ? i just feel like this letter needs an answer ?

No i know that but i want to know if its just scare tactics to get me to pay up, thing is I've been paying for 6 months now id be surprised if they tried court as I've been paying court ordered amount they say its not enough hence asking for an income / exp every couple of weeks. I just want to know if they will try repossession but i can't see how they can Do i count every single charge on there, are all charges unfair - missed payment charges ?
  5. ill have a look So do i need to be worried about them writing to ask for this shortfall ? is this their way of getting me to agree to the higher monthly payment to cover the higher interest they say is on there now
  6. What will they try and do next , this is all because they want a higher payment isn't it. Do i not respond to it? Also with all the SAR info , i am adding up whats been paid and what fees have been added is this all i need to do? theres so much to go through its taking a while

I now have a letter we have been unsuccessful in our attempts to contact you in respect of the outstanding payment shortfall on your account its important to clear the shortfall amount as soon as possible if for any reason you are unable to make this payment , call us on ... immediately to discuss the reason for the arrears and what repayment options are available to you whilst in arrears you incur additional interest on a daily basis an arrears fee of £40 is charged monthly ????? the shortfall they say is £30k I am so annoyed , all this because i haven't upped my payments and done the income / expenditure. Do you have any idea what i can do as am not finished with all the SAR stuff
  8. they just keep saying i have no arrangement in place and need to do the income / exp to set an arrangement up. I have ignored this and paid for first 3 months after covid relief, i paid contractual as they said pay what i can afford then for next 3 months i paid the court ordered amount in full , would it best to make a payment to them for the extra amount i didn't pay in those first 3 months after covid break so i haven't breached anything as such?

  11. sorry i only wondered if they could do anything since i am just paying and ignoring their requests for income expenditure to set up a payment arrangement i have statements from paragon and mars , i need to send to further back than them but having trouble finding details but i will. Its taking me a long time to go through it all
  12. just going through all my figures, i will need help soon but in the mean time another letter saying in order to set up a payment plan we still require from you 3 months bank statements and an income / expenditure I don't need to do this do i? i am still paying on time the court recommend amount, do i put in writing i am paying this amount so they stop asking or just leave it
  13. I just worry I’ve not missed a payment since covid break was over etc so I can’t see they can push me into an arrangement when I am paying what’s been in place I just know they will say they need more money due to the break in payments and interest etc

They are still pushing for an income / expenditure to get an arrangement in place to "stop calls letters etc and further action" why do i need an "arrangement " I've paid the court ordered amount and have paid 5 months in a row since covid break , i didn't pay the full court ordered amount at first as they said to pay £300 and would work together etc with what was affordable.   16. well I've written a letter stating only contact by letter from today and I've SAR both mars and paragon , i need to find details from earlier people who owned too. Taking to post office now to send signed for!
  17. Hi i think its best i put in writing to contact me only by letter and reiterate what i will be paying , shall i include an income / expenditure like they are pushing for or just leave that out

Yes it was really crafty of them , this was in court way back before 2018 too and the solicitor who came for paragon even said to me before going in, first yes we agree to the payment arrangement what ever it was and secondly i would look into all those unlawful charges on your account they have been robbing you blind, I hope after getting all the information i can really gather the evidence of how much i have paid and what wasn't lawful.

Hi i dont ignore you , i get scared and anxious to not talk to them and like i am rocking the boat and then they will think right she's not playing ball lets get her into court again, i am terrified of that So i am now corresponding by letter , how do i deal with their requests for income expenditure

I said to the lady on the phone , if you could do in writing from now on please , i didn't say anything just listened to what she said, didn't agree to anything just said , ok if you could remember to put in writing from now on please ... i was just annoyed firstly that they called an secondly that i have looked like a late payment and been charged. Ive read that i don't have to fill in an income / expenditure . Ive just sent off my SARs to all concerned so hopefully in next few weeks will have some figures to look at. I hope i can prove all the charges and payments I've made are above what balance they have

I have told them writing only now, though they called today and said ill need to fill in an income / expenditure form? is this a legal requirement ? i also paid on 28th this month and because it was by BACS as usual they didn't get till 1st March and charged me £40 for missing feb payment date?? i said ill be paying the court ordered amount and they said that they'll need an income / expenditure and then can review the account as theres a lot of interest on there and although she didn't state today she didn't feel the extra 147 a month covers that, last few months they were trying to push me to interest only - why is this a benefit to them as it must be?
  22. I am not trying to get out of anything at all ! The reason it comes up every year is i have medical conditions which make it hard to deal with things and i go through months / years where i do not feel up to rocking the boat and the anxiety it may cause me , so i don't think berating me every time i come on here is justified. I feel ready to take this on but needed help , if you can't then say that don't just take pot shots at me as you do not know my circumstances so if anyone can help - they called today and i answered due to thinking it was a delivery order i was waiting for and i said id be reverting to the court order again and they said that was it affordable etc and i still need to do an income / expenditure as i have no arrangement in place , she pushed the interest only again as she said that extra 100 a month court ordered didn't cover the 311 interest thats added every month. I feel like if i pay the court order then they will push to take it further as i had time off for covid and then since oct only paid the contractual payment as we weren't working still, so i am classed as defaulting
  23. The reason its been 12 months is that i had to wait to be in a position to offer some money. If the current owners of the debt do not have all the previous paperwork what does that mean for me? is it a good thing?
  24. ri need to go back to the extra £147 a month even though this defaulted through covid and after - won't they say we will enforce it as it was me who defaulted? shall i put in writing and just say i will pay the £147 as ordered by court for the foreseeable, not sure how to word it with them and why do i SAR everyone from this debt, do i not just need who owns it now?
