  6. Hi, I've finally got all the info I need and looking through my notes it seems there is nothing against me in the last year with regard to money owed. Therefore I need to write a letter asking for my money back (£90) and to get the default notices removed. Can anyone help with the wording? Should I send a seperate letter or should I put the money and default request in the same letter? All help appreciated. Thanks Paul

Thank you for your further letter regarding your request for a copy of the transactional data held about your bank account. I can confirm that you have been provided with all the transactional information you are entitled to under the Data protection Act. As previously advised the bank account transactional information which has been archived onto microfiche is not covered by the Data Protection Act and it is not possible to provide you with a computer print out. However, I can confirm the Abbey has made arrangements to send you this information as soon as it has been retrieved from our archives. Yours sincerely Sheena Small On Monday their 40 days are up so if nothing materialises by then I think I will just average the charges for last year for the last 6 years. As this works out to nearly 9k for two accounts I will be quite happy with that. Any other thoughts?
  8. On saturday I received a letter from Rachel Dimond in reply to my complaints (sound familier yet?). The only problem is I haven't actually complained yet. I also rang and was put through to Rachel. She was very nice and polite. I didn't rant and rave because she was only doing her job. My original letter was sent 62 days ago, but my cheque was sent 33 days ago so, officially they have 33 days left. This is the reply I sent to them. Thank you for the letter dated 4th May 2006. Further to our conversation at 11.40am today I would like to confirm the following. The letter did not, at any time have any complaint about your bank charges. It was simply a letter asking for all my statements or a breakdown of all my bank charges and it was a reply to your letter dated 13 April 2006 (your ref MANINT/HN/847). This is a breakdown of all the letters sent to you regarding letters sent asking for statements or a list of charges: • 7th March 2006 - Original letter asking for a list of charges or Statements. • 5th April 2006 – Reminder sent including a cheque for £10 for information. • 21st April – Letter sent regarding your letter ref MANINT/HN/847. All of these letters’ have been sent registered post and they have all been confirmed delivered. I realize that in the original letter I made a mistake and I did not include a cheque for £10. I also understand that your 40 days to reply to my request starts from the date you receive the cheque and request. You received this letter on 6th April 2006. This cheque (no-300002) cleared my account on 20th April 2006. This means you now have 7 days until the 15th May to comply with my Subject Access Request. As you are aware I have sent a letter to the Information Commissioners Office and I will have no hesitation in doing so again. I also know you have received these letters as I have been sent a set of statements for the last year for this account. If you fail to reply by 15th May, I will make a claim based on the charges for the last year and average it for the last six years and send another letter to the Information Commissioners Office. I am sure he would be interested to know how long it’s taken to reply to my requests. For the record my original letter was sent 62 days ago. I look forward to receiving my list of charges or statements. You have seven days to comply. I have been patient, I know they have received my cheques. In seven days time the will be sent an LBA.
  9. I feel really guilty asking again, but, any news on what I should do next please? Just to pour more salt on my wounds, I have two current accounts with Abbey and I made this mistake with both of them. Should I just write them a letter re-iterating they have forty days from receipt of the cheques? I have received the standard 13 months statements for both of the accounts and one letter telling me about the archived accounts on one of the accounts. Hope this info helps a bit further.

  11. The SAr request is already in order. I have been refused credit, the missed mortgage payments last year probably didn't help though. If I could possibly get some kind of compensation that would probably remove some of that bitter taste from my mouth. I know the first thing is to get my SAR request back, after that, what do I do?
  12. Hi, I have noticed I have been defaulted within the last 19 months against an account that was settled almost three years ago. I have just written a letter to the relevant company (Northern Rock) can you tell me if I need to add anything else please? ACCOUNT NUMBER: Unknown I have recently requested a copy of my credit report and upon reading it I noticed in the last 19 months entered three defaults (status ones) against my name. As this account was settled on 15/07/2003 I therefore ask you remove these defaults immediately as it is impossible to default a settled account. The information will be against the address as above. For security reasons my DOB is xx/xx/xxxx. Failure to do so will result in me making a claim to the relevant bodies. You have 14 days to comply.
  13. What would I put in the DPA letter if I don't know the account numbers? I used to be really really bad at keeping paperwork and the only reason I know I had something with BOS is because I have just been reading my credit report. Thanks

I was just perusing my credit file and I notice that there a three institutions -Northern Rock, MBNA and BOS - that have entered default marks against my name in the last 18 months although I cleared them all up to 3 years ago. I am going to be writing to them asking for all DPA charges to my name, but how would I go about asking them to remove their marks in my credit file. Should I write a seperate letter just asking them to remove it, or should I wait until I get my DPA info? Paul

  16. This morning I received a the letter acknowledging my complaint and saying they will investigate my complaint. Now last Friday (21st April) I sent this letter below to them; I am in receipt of your letter dated 13 April 2006, outlining that you could only provide me with printouts covering recent transactions on my account, because any earlier information has been archived. (*I also acknowledge receipt of the information you forwarded.) My request was for a complete list of transactions and charges relating to my account since 07/04/00 – in short, a list of charges with dates and amounts – alternatively, a complete set of account statements for that period will be acceptable. This should be retrievable from your accounting systems, and easy for you to produce. I will accept a computer print out of these transactions. I am aware that you have been willing and able to provide other customers with a print-out of transaction information covering this period – and am ready to bring this to the attention of the Information Commissioner. I would also draw your attention to Smith v Lloyds TSB Bank plc (2005) EWHC 246 (Ch). This letter has been sent by first class recorded delivery, and therefore should have reached you by 24/04/06– as you will be aware, as of this date you are seven days late in returning all the information requested by me set out by my original schedule as stated by my letter dated 13 March 2006. I therefore, have no option but to report you to the Information Commissioners Office for non-compliance of a DPA request. As stated above, a complete set of account statements for the period in question will be acceptable; however, I expect this to be provided to me within the next seven days or I will have no choice but to estimate all charges against me. Yours faithfully etc etc The problem is, when I originally sent my request (8/3) I didn't include any money. In the reminder letter that I sent (5/4) I did include the money. As far as I am now aware that means the forty days started on the 5th and the fortieth day ends on the 8th May. So, should I still follow through with the letter dated above? Should I just accept that I made a mistake and wait until the 8th? Sorry if I have waffled a bit. What should I do now. Any advice appreciated. I have sent the letter to the ICO as well....

  21. Ok, I got my reply this morning from abbey about one of my accounts (3 days late!) Some of the text reads... 'Some of the information you have requested relating to transactions on your accounts, is no longer held on our systems ans therefore, an admin fee is required. The fee will be as follows:- £5 for monthly statements which has been archived. £10 for multiple monthly statements, which have been archived. The transactional information remaining on our systems will be forwarded to you, free of charge, underseperate cover' The rest of the letter is about 'manual interventions' and what they think it means blah blah blah My questions are:- Does this mean I may have to pay £5 for each monthly statement (two accounts) going back 5 years? (got 12 months of statements for one account so far) Could I just send them a letter estimating costs' for both accounts? (I haven't a clue what they may be, but if I claimed £5k for each they would soon get their act together and tell me what they really were) Any help appreciated.   22. I am posting my letter to the office in the morning. Abbey's fortieth day was Monday 17th.
  23. Yesterday was the 40th day from my original request for all information. This morning I received the last 12 months statement on one of my accounts. I have just come off the phone from customer services and I now know that I should receive the rest of the info by the end of the week. I ended up speaking to a manager to find out the name of the agent I spoke to because he wouldn't tell me his full name - 'there has been security breaches' - and I have to say he was nothing but pleasent to me. I have been avidly reading all post's on this site and its strange that some people have been turned down (subtlely) for their DPA requests and although a little late I have been assured that its all in hand. However, they have gone over the forty day deadline I gave them....... It seems I now have a letter to send to the ICO.
  24. Hello, I have just written a reminder to Abbey as it has been 28 days since I wrote my first letter. It may also have something to do with the fact I never sent a cheque in the first place and I thought I would hedge my bets, tell them they have 12 days left and include payment so they don't send me a reply on the fortieth day asking for some payment. (I'm not letting the buggers get away with that one......) The reason for the post thought is, who do I make the cheque payable too? I know this may sound like a daft question, but, I'd like to make sure I get it correct so they cant stall any longer. Thanks Paul
