  1. What would you advise is my first course of action:- Contact Claims 2 Gain to negotiate payment of original fee (40%) of PPI refund given to me ie £221. or is past that stage now due to County Court Claim sent to me. Thanks for your help

Not Yet Has the claim been issued by the original creditor or was the account assigned and it is the Debt purchaser who has issued the claim. Assigned to Pannone Corporation LLP, Manchester Were you aware the account had been assigned – did you receive a Notice of Assignment? YES Did you receive a Default Notice from the original creditor? Cant remember. Have you been receiving statutory notices headed “Notice of Default sums” – at least once a year ? NO Why did you cease payments? I was charged 40% of sum awarded (over £200) I thought it was extortionate. Claims 2 Gain would not accept a smaller fee. What was the date of your last payment? Not paid their fee. Was there a dispute with the original creditor that remains unresolved? NO Did you communicate any financial problems to the original creditor and make any attempt to enter into a debt management plan? NO
  3. Claims 2 Gain Limited. Have issued a claim through their solicitors via the County Court Business Centre, Northampton. I (stupidly) gave them details of a company I believed may owe me PPI, I subsequently was awarded a cheque of £635. Claims to gain wanted a third of this money for their services £212.... I wouldnt pay them. I would have paid £100 for their services at a stretch but they were adamant on the charge made. They did hardly anything other than take details from me over phone, email forms for me to complete, and then they sent the details to the lender, who consequently sent me a cheque payable to myself. Pannone Corporate Solicitors acting on behalf of Claims 2 Gain have issued, from County Court Business Centre a claim against me now, asking for £661.96 plus Court fee (£60) plus legal rep fee (£70) total £791.96. I have to enter a defence or pay up. Can anyone assist me who knows more about consumer legal rights on what I should do now. To settle the matter I would pay the £212 originally asked for or if not agreed to, defend my actions for withholding payment. I am retired now, have a long term illness, claiming pip, and have low income.

  5. Led to believe I didn't claim interest until I went to Court, not at particulars of claim stage. I'll cut my losses and accept the amount they're offering plus Court costs paid and remember for future reference to include interest charges when I send in particulars of claim if I need to claim back unfair bank charges again in the future.
  6. Due to go to Court on 1st November but have now received Letter from Lloyds Solicitors offering me the full amount claimed plus the £80 Courts costs I've paid. QUESTION: Do I accept, or ask them for the interest as well?? The total amount is £780 before costs. Anyone H E L P me work out what the interest would be on that. I couldn't fathom the Excel spreadsheet to do it myself.
  7. Sent statement of claim to Court by 22nd September as requested and copies to Lloyds solicitors, Sechiari, Clark, and Mitchell. Should have received copy of their papers (showing witness details) by 22nd September but have heard nothing from them at all. Rang my County Court today to enter a judgement as they've failed to produce the documents but the Clerk told me I'd have to wait till the Court date 1st November and mention to the Judge that the solicitors have not sent papers to me. Has this happened to anyone else? Any help would be appreciated thanks.
  8. Letter from Court is dated 12 August but I received it just over a week ago. I've got until the 22nd September to send copy documents to Court and Lloyds. It says Witness statements must be included in the documents filed so that'll be interesting as Lloyds TSB have stated they have a witness. I've only sent a copy of the statement entries before now with the charges I'm claiming underlined so I'm having to trawl through and pick out the ££ I'm claiming and list them again for this schedule of amount claimed. Roll on November 1st is all I can say. Planning to ditch Lloyds after this fiasco, I've already set up another bank account. Good luck with yours Barty keep us informed.
  9. Hi Barty. My hearings on the 1st Nov. Have you been asked to provide a schedule of how the amount claimed has been calculated to all parties? So much for the bank deferring the hearing date to negotiate, as they haven't bothered, suppose they're hoping I'll give it up as a dead loss (yeah right!)
  10. I've opened the spreadsheet. I thought of putting 'Geteven 'v' Lloyds TSB Bank Plc. then 'Breakdown of Amount Claimed' then would you put columns for the relevant year, month and figure claimed? Also whats the formula for working out the 8% interest calculation as it's over a year ago since I used spreadsheets. Thanks for your help!

Update: Received 'Notice of Allocation to the Small Claims Track (Hearing) from Court giving me a Court hearing date on 1st November, and asking me to send copy documents to the Court and defendants no later than 22 September 2006. Original documents to be taken to Court on date of hearing. I also have to include a schedule of how the amount claimed has been calculated and identify the basis for each charge (!). Could do with some help from the forum. I've read different threads but can't find one specifically showing how you identify the basis for each charge. All I have is copy statements showing charges taken which I've put a pencil mark against and totted up to make a final total. I haven't included account charges of £7 per month, just overdraft interest charged and the unfair charges of £30 I've paid over 6 years. Many thanks for your help, could do with some guidance, thanks.
  13. Yes. The banks solicitor will try anything to put people off going ahead with their claims. They're making 4 million profit per day last I heard and they're worried this might decrease in the future with us all claiming unfair charges back.

  15. Thanks mjanet. Its weeks since I handed my AQ. in - don't remember putting any time on it (oops!) Just been reading Enforcer's thread and how Lloyds paid up 5 days before the Court hearing date. YippeeeeeeeeeeeeeeIayyyyyyy, that's cheered me up no end.
