  2. Red 7 I posted this thread a while ago, I have now claimed back all the bank charges plus interest from Nationwide. I included the unpaid standing orders and direct debit charges on my claim sheet. They can most definitely be claimed back but be aware that all the banks are currently undergoing a court case which means all current active claims are on hold. hope this helps.

  4. Hi My sister has got an account with Lloyds TSB. Whenever she goes over her overdraft by even a small amount, Lloyds charges her £30 PER DAY for a maxmum of 3 days = £90. Are these fair or unfair charges. These charges are being applied even now, after the OFT has ruled anything over £12 as unfair, hence the confusion. It must surely be OK for them to charge £30 per day for the convenience of going over the agreed overdraft limit, rather than just a single charge of £30? I don't know, I'm very confused. Help me out please. I'd like to know if anyone has had the same experiences and how it went... Thank you.
  5. I have won all my money back! The 28 days is up tomorrow, 9th July. On Friday, 6th July, I arrived home to a letter from Nationwide telling me: "I'm now able to confirm that we've refunded £1096.50 in charges and cancelled £2.52 in pending charges on your account. We have also credited £120.00 to your account to cover your costs and a further £292.32 which represents interest calculated at the court rate of 8% from the date the charges were appled to the date of the refund." I am overjoyed. A note to all those trying wth Nationwide or any other bank at the moment - do not be afraid or lose hope and keep going with your claim - fllow through with the ample, good advice given on these forums and you will get your money back. I will be donating some money to this website for helping me out. Thank you very much:)

  7. My claim was acknowledged on 11/06/07 and i now have to wait 28 days... I do have a question though... In the "Particulars of the Claim" I input the following: "5. Claimant claims: (a) return of the amounts debited of £1096.50; (b) Interest per S.69 County Courts Act 1984 of 8% - £292.32 continuing at 8% until judgment or settlement at a daily rate of £0.24; 6. Costs allowed by the Court." But aftwerwards, when they ask for 'the amount claimed' - I input the charges they owe me - £1096.50 and did not add the interest amount of £292.32? So at the bottom of the page, this is what is displayed: This does not take into account the interest of 8% I mentioned in the particulars. But there was a tick box to say whether I wanted to claim back interest and I had ticked it. It is not mentioned on the pdf of the claim though. I'd be interested in knowing whether Ive done this right or not... Thank you.
  8. First of all I would like to thank all contributors for this excellent website - there really is a lot of useful information here that has helped me in my journey to claim back money. Unfortunately it has got to court. I have just put in a MCOL claim for around £1300 (which includes the 8%). I have paid the court costs of £120. I have just printed out and signed the letter to the Court Manager, which I will be posting along with the schedule of penalty charges taken from me. Is there anything else I need to do at this point or do I wait for the Court to get back to me? By reading various other cases on here it seems Nationwide will only pay if it needs to so I see this taking the 28 days at least. I have not read too much in detail, but there is some interesting stuff in these cases and Im hoping to read some success stories in this forum when i get time off my work to browse further. I will, of course, keep you updated on my progress as it happens, but if you think I have left anything out or need to do something immediately, please do let me know. Thank you.
  9. Sorry Vampiress, my mistake, its not the contractual interest but the interest on charges yes. What I am confused about though is 1) Can I claim back interest on a charge where the charge was applied when I was within my agreed overdraft limit (not an interest-free limit) and 2) There are varying interest rates, from month to month. Do I calculate the interest rate for that month, eg. 0.546% or multiply that by 12, which gives me the interest for the year (6.552%) ?
  10. Can someone please help me with the above ^^^ !?!?! I understand it is the contractual interest I need to be claiming back - but these amounts are varying from month to month and the spreadsheets by vampiress are very difficult to understand. I was looking at the advanced spreadsheet and there is not a lot of information as to how to go by it... please help me out!
  11. Hi I have read and read and the more I look at these calculation spreadsheets, the more confused I get. This is what I want to do - I want to claim back all unfair bank charges from Nationwide and the interest I paid on those charges. Now the charges run over a year and a half, and some at varying rates of interest. So how do I go about calculating the interest? I want to be as accurate as possible, to get the most amount of money from Nationwide. Now another thing is lets say the bank has charged me £25. The new rules state that anything over £12 is unfair so am I claiming back £25 or £13 (£25 - £12) ? Thank you.
  12. Thank you for this information. I have got a subject access request from the bank, and this has allowed me to see all the charges they have made. I have calculated this to be around £580 but have yet to add interest to that figure.
  13. I'm currently claiming a lot of money from 2002 - 2004. If you look at your bank statements - at the end of the statement, they have an additional page with all the charges: For example: 26th Feb '02 - £25 as Unpaid cheque fee Then, at the bottom of that very page they tell you that the aforementioned amount will be debited from your account 21 days later. So 21 days later, they take the money from your account. Now, when you write to them, detailing charges, do you mention the date they notified your of the charge (i.e. the date the charge was put on) or the date they debited the money from your account? Furthermore, if a notice of 21 days has been given on their behalf, is it still plausible to claim back interest charged 21 days later - as they have already warned you, and you have had the time to make sure you credit your account by the required amount. Any advice and help on this matter is greatly appreciated. B.
