  4. Just after some quick advice if poss. I purchased a fridge freezer from family vision 13 months ago. The fridge developed a fault where it stopped chilling. And after a little research we discovered that this a common fault with this model and it nearly always happens when it is 13 months old. As it is out of 12 months family vision advised that it would be hotpoint calling to us and not one of their own guys. They made the call for me with hotpoint to raise the fault and advised me that someone from hotpoint would be in touch. Which they did the next day. After being told that I would have to wait a week for an engineer to visit. I raised the issue about this common fault. And was told that. They are aware of it but it was only in the earlier model and has been sorted. I advised them that they were Wrong and the exact same issue had happened on my fridge Engineer turned up and confirmed my suspicion also advising me that it was the third fridge of this model he had found this week with the same fault. So he had to order a new door which would take a week to arrive leaving me with no fridge for 2 weeks Family vision would not give me a loaner as they state that they ave done everything in the contract to fix the issue as quickly as poss. But they also claim that I have to pay for the 2 weeks that I could not use the fridge. Surely ths ain't right is it???
  5. Hi all Just to update you I managed ti get back just over half of what they had charged me. But they wouldn't refund in cash instead applying it as a credit on my fees account!! Whatever that is As my mortgage is up ti date there was no way for me to get access to the money as it would be used to pay fees if j fell into arrears. So all I did us not pay the mortgage for 3 months then persuaded them to take the arrears out of my fees balance Sorted.
  6. things have changed, however when we are scheduled to work the weekend and we have holiday booked we are not replaced, therfore i dont see that its a valid point that they must have a team manager on at the weekend. ! sounds like im fighting a losing battle anyway lol
  7. I never quoted any legislation. I the reasons that were given were · That he could not justify having 2 team managers on shift at the same time (our shifts would cross over for 4 hours per day) (although we did before when there was 1 extra member of staff on the floor) · He says that there must always been a duty manager or senior agent on the floor (there are always other senior agents and duty managers on the floor but they work on different contracts however the knowledge or our contract is enough to get through and we are always on call anyway so just a phone call always if the guys need help. In my opinion I believe I put a good case forward outlining the pros and cons of the shift change and the business would definatly benefit from the change of hours but he seems to disagree. I have till now tried to keep it as informal as possible as I know my boss personally and we get on rather well,
  8. the other manager has now moved on and been replaced with someone else who is more than happy to change the hours, but its up to the boss and the boss says no
  9. Apologies but this may be a little long winded. I have recently submitted a request to change my shift pattern at work back to what they used to be. When I received the job offer over the phone I was told “Mon-Fri 9-5” When I started working I was advised that this would be the hours during my training period and that my actual hours were to be a 2 week rotational shift with my fellow team manager. I would work mon-fri 6am – 14:30 one week then Mon-Fri 10:30-19:00 the next with alternating Saturdays. This was not a problem and I accepted it as such. A few months later my felloe manager submitted a request for us to go on a 4 on – 4 off pattern doing 12 hours shifts on a rotational 5 weeks pattern, After a lot of thought and consideration I accepting these new shifts and the appeal of having the 4 days off was nice. Since that time my wife has had another baby and is about to return to work part time doing weekends only. I have submitted the new request to my boss to revert to my original hours as this would enable me to look after our children at the weekend. This was rejected today which I agree are possibly legitimate reasons (this was confirmed to me verbally and not a written reply) I just wondered if there is anything at all I can do about this, When I signed my contract of employment, it did not contain my hours of work. But states on page 1. “Hours are as agreed with your manager attached” and on the summary page it states that “your normal hours of work are as stated on page 1” I just wanted to know if there is anything I can do. It is difficult as I feel I may need to resign n the new year to find alternative employment but this is something I do not wish to do. Many thanks for you help in advance
  10. hi thanks for the replys i am no longer in arrears and have not been for well over a year. and since i was in arreaers at the beginning i did in fact actually pay some of them within my monthly payments but since the mortgage was capitalised i have not been in arrears since

  12. Apologies for delay. I have had a response from GE which us not much different from the first. They refuse ti uphold the complaint but have offered to refund 4 lots of fees more. But will only take them off my mortgage balance. Still.
  13. It's been 4 weeks sine they received the letter and still no contact. Called them today to get confirmation that it was being dealt with and apparently someone will call me in 24-48 hours to discuss.

  19. but that doesnt make sense DX, i have paid money from my pocket to which something should not have therfore i am entitled to my own money back, surely thats correct? even if i was only paid the proportion that i paid directly and not the ammount they capitalised?
  20. do you know if i can get the money paid to me rather than back onto my mortgage, they say the fees were not paid out of my pocket because they were capitalised, but i was paying some of them because i was paying quite abit more on my mortgage at the beginning,
  21. santander also advised me that i can not put a stop to continuous card payments, i was getting stung by wonga back last year (through no fault of my own) and the bank racked up over £500 of fees. i got so sick and tired of arguing the point i have just told themto stick it and opened another bank account, i hate dealing with santander they are awfull
  22. ok finnaly getting somewhere this end now. i have also added another direct debit charge of £20 which i missed off somehow, need to add £23.64 to the claim. the default notice charge was £35 on 22/04/2008 solicitors fees are 21/07/2008 solicitors interim legal fees £276.38, consisting of £145 (issue summons) £25.38 vat, summons fee £100 and search fee £3 office copies £3 total =276.38 28/07/2008 solicitors interim legal fees £23.50, consisting off £20 (notice to occupiers) £3.50 vat = £23.50 08/09/2008 solicitors interim legal fees £144.00 consistoing of £70 (serving affidavit) £50 (instructing agent) £21 vat £3 (office copies) total =£144.00 20/09/2008 solicitors interim legal fees £123.38 consisting of £30 (report on court hearing) £5.25 vat £88.13 (agents fees) total = £123.38 total cost for solicitors is £567.26. i quiried these costs some time ago and they sent me copies of the reciepts from their solicitors. all of that added up calculates to the total fees they stipulated in the letter, £2,222.26. includign all the fees i am claiming back my wife is of the oppinion that we neber had letters from the solicitrs just court letters. is this the correct info or do you require more?
  23. Sorry for the delay We have hunted high and low for the letters All we se to have are the actuall court ones when they tried to take possession. I have got a copy of some of their solicitors receipts because I queried that before. There is a lot of solicitors costs which have been charged. What I'll do is get it all added up and repost after work tomorrow evening of that's ok. Massive day in the office tomorrow so need mi beauty sleep. Many thanks Grant
