  1. Hi there Can't beleive the same thing happened to me last Friday (May 14th) Same sitauion, Active CCJ due to delayed payment from insurance company. The Claimants solicitors in my case also failed to tell the County Court. I just happened to get this info because I was refused a mortgage. I have just sent off a request to have the judgment set aside. I did the following: 1. got in touch with insurance company and after much being put on hold etc.. got the original claim handler to write me a letter to say payment was delayed on their part. they sent me a cheque for £75 to take the matter to court. 2. They also sent a chuque to the County Court to request a satisfaied cert. 3. I called the County Court (i am assuming this is Northyampton Bulk Centre). They told me the claimaints solicitors details. 4. I called the solicitors and asked for the file to be archived out to a) ask what date they received payment from my insurance compnay and b) to then FAX the County Court that payment was received so and so date. 5. They did this and i asked for an email copy of that fax. 6. I completed form N244. attached the following info; a) form b) Letter from insurance compnay way back telling me to send any correspondance to them c) letter from claimants sols that they received payment on which date d) letter and computer printout from Insurance company, what date payment left their account and letter to give reasons why the payment was late e) i enclosed copies of my Experian report which did not even list the CCJ and so i proved i was unaware f) i finally worte a letter to the judge (about 3 pages) telling exactly what happened. i have no idea if this will work, but just NOT MY FAULT!!! Why should i be punished so severely. I pay an insurance policy and paid the excess. So out of order. background to my case is that, i just sold my house and wanted to get a mortgage and was refused. so now what do i keep the offer (which is such a good offer) or what. does anyone know how long the court takes to set aside. so out of order and completely unaware. Call Credit was the agency that listed it otherwise i would have been sat here thinking why have i been refused. i have read other forums and people in this categoty (late insurance payouts) do get set aside but still fearful it might not. any wisdom on this thanks
  2. Hi everyone. I watched this depressing programme on BB1 last night about repossession. My situation may not be as bad as some, but i am increasingly being engulfed in a terryifying vision of the future. We have a mortgage, 145000. My husband started a business and we took out various loans up to the value of 25000, 13000 from the bank (unsecured) and 12000 from family. The business flopped and now we are just making ends meet. I am on mat leave from next week, baby due in early feb and so the full time salary will start to decrease. My husband is not earning that much. I'm just so terrified about what will happen. I have a child and this is the 2nd baby. When i go back to work, i will have to work part time as i don't think i can afford to pay the childcare. i just do not know what to to do. we are not behind on any payments for anything, but, i feel so depressed that i just want to run away so far. If i didn't have kids, i think i would have done so by now. The whole world is sufferring this crisis so actually there is no where to go My question is that if i started to get behind on payments, how can i access goverment help. Can i do so even on maternity leave. The goverment announced helpiong with mortage payments, would that option be available to someone like myself. i will not be able to work full time and have to work part time to look after the kids. please advise me Thanks
