  1. Still no response to CPR. Response to Dispute letter was basically we don't agree and do not consider the account in dispute.

    What are your thoughts on the theshadows comments regarding the credit limit. I am not sure I could use the legibility angle because although small my copy seem OK.

    Hi, Sorry it is a bit confusing this is just the same as above only zoomed in. I guess it is front and back but now way of confirming for sure. If it is then I assume it is enforceable. The question is have they got the prescribed terms correct. Especially, regarding interest on the credit limit and cancellation rights.

    OK I will try and zoom in so you can see what's what. What about the cancellation right. Is it sufficient for them to just say what they have said. I am not aware of getting anything that detailed them in the way suggested. The three credit limits specified are 1,000, 3,000 and 5,000. No 1,500. From what I can remember I think this application was one of those fold in on itself ones. Can not be entirely sure since it was nearly 12 years ago.

    So it does. Missed it! My credit limit was 1,500 not one of those shown in the table. Found it on the info I got from my SAR.

    Interesting point about cancellation. Here is what it says on about that. "YOUR RIGHT TO CANCEL Once you have signed this agreement you will have for a short time the right to cancel it. Exact details of how and when you can do this will besent to you by post by the bank" There does not apear to be anything about a "credit limit" other than that in the table! I have no idea what my credit limit was? How could I find out?

    So, Got the results of my SAR and they seem to have located my application/CCA. Is it enforceable? [/url] I am really gutted, I was sure they did not have it!!

    No problem at all. Love seeing how other people are getting on and invariably these things help me as well. So far MBNA have not been ableto give me anything. Not even an application form. I did get the same thing as you from my Abbey CCA. I was told that was enforeable to. I scanned it and put it in another post you can search my post if you want to see. You might be interested because Abbey Credit Cards Are run by MBNA.

    **UPDATE** So, I had no choice but to send copy of drivers licence. However, I got a friend to witness it by signing across the front of the copy right over my signature. Anyway, still not response on my SAR nor on my dispute letter and nothing on on my CPR. Just got a letter on Saturday this time saying they are not obliged to send me a signed agreement. This comes after the original CCA request where they apologised for not being able to provide it. I shall give them another week to comply with the SAR at which time they will be nearly 1 month late. I am getting more and more convinced they do not have it!! I will need to check back to find out what to do next with them!

  12. Thanks, I had a quick look and it does seem to be similar. Do we not have a legal right to see the signed executed agreement? I can't believe their course of action is fair or legal??
  13. I was not intending to claim back charges, my account is generally cleanand I have not got into alot of trouble, yet! I was really just wanting to know if they have an enforceable agreement. Have they breached the their responsibilities. I know they should have a CCA on file for me. My letter specifically requested it. Yet they failed to provide it. I really woudl just like to know if they have a signed CCA.
  14. **UPDATE** Sent the CPR, Dispute letter and SAR. They have not ackowledged either the dispute letter or the CPR. However, I did get the information from my SAR. It appears all they have sent is raw electronic form of my statements which they have printed out. No signed executed agreement, no details of default sums nothing else. What do I do now? Is this further proof they do not have a signed agreement?

    I wanted to make sure they definately do not have a signed agreement so I SAR'd them and CPR's them. They have come back saying they need something with my signature on it before they process my SAR. What do I do? I was clear in my request that they should not need to confirm my identity because they were happy to send me statements etc... If I send a copy of my drivers license will they try and take my signature off it and manufacure a CCA? Thanks in advance
