  4. I understand that PPC's may be contracted. I lived in Brighton for a while .. jesus wept I got a PCN at 09.04 on a Sunday morning for £60. Parking is prohibited after 09.00 (I didn't as yet have my Residents Permit). In any case wouldn't any PCN or Notice to Owner be identified as such and follow the standard guidelines and detail the offence etc. This was clearly not the case. I as a driver have received numerous tickets (NTO's) at times and on numerous occassions I've argued that DYL were not clear i.e. under water etc. but that's another story. The fact remains that I understood clearly this was not a civil matter but Council/Police/Traffic Warden or PPC contracted by the Local Council. With the Official Bodies I had the right to defend and with satisfactory results in several cases. I never had debt collectors hassling me as a RK. The Notice to Owner (RK) didn't even stipulate the 'infraction' or 'Offence' .. it was merely an invoice. Ok if this is a PPC contracted by Local Council or whatever then fair play but if not then the DYL's cannot be enforced on private land nor can they require me to detail who the driver was. You know far more about this than me and I did ask advice but I'm not entirely sure what you're getting at at times. This is my lack of knowledge not your advice. Cheers
  5. I personally (nor the driver) were aware of any signage nor any change in policy re: use of PPC's to enforce arbitrary parking penalties. Correct no barriers, no charges & no time limit. Car was not parked on any access road but within the Car Park. As I say soon as I get a chance I'll get some photo's. Thanks

  7. The Yellow Lines were on Private land no doubt. Pics later when I get the chance again just for reference. I think I would need to confirm it was my vehicle as RK .. 6 months ago .. many friend/relations drive my car. Again oif asked assuming I knew I would be honest.
  8. A quick question .. should this matter proceed to court would I as the RK be obliged to state who the driver was at the date in question? Of course many people use the RK-ers car and this was 6 months ago. Caveat: I would not lie Anyway for posterity here's the generic DVLA reply .. *DVLA REPLY REMOVED*

  12. So I guess write to the BPA next to outline the PPC not adhering to the CoP. One other question are road markings LEGAL on private land i.e. Yellow lines?
  13. Ok a further snipper verbatim from the DVLA reply Can they use the word 'offence'? Shouldn't it be infraction or similar?
  14. Indeed especially as the private land in question is a free car park without time restrictions.
  15. Update which I'll quickly paraphrase for now due to time contraints ... Comments if you please. Can a private landowner seize a vehicle? I'm not comfortable scanning the whole document and posting (at this moment in time) but if any long standing member wishes to review the details I'll forward.
  16. Which PPC do you work for then Dominic Creamer The driver will go to court if papers arrive and will defend the case. The driver did not enter in to contract and the extortionate fee is not fair or reasonable damages. Oh and lets not forget that PPC did not adhere to BPA COP thus should not have access to DVLA via electronic means.
  17. Indeed but that could translate to court papers will be filed. It's all fair and well people saying ignore but ideally one should be prepared in the unlikely event. RK has a witness that the driver did not enter in to contract as no signs were visible/seen by either driver or passenger i.e. no signs were seen due to heavy rain/darkness nor yellow lines. Thanks
