Hi Sillygirl Thank you for your advice, I would like to get some Literature on this, or someone who has heard of this type of payment and know exactly what it is, when googling there is not a lot out there about it and seems to be from america. Wondering if it is a new thing and it that case is there not really any gguide line for it. It just seems strange that the bank was so insistent that it was not a continuous payments authority, when the loan store said it was. And that there was nothing they could do to stop a pre authorized payment. I want to get my facts straight before I go back to the bank and the loan store.
  2. Hi All Hoping some can help, I have a payday loan out with the Loan Store, I got into a bit of difficulty and was unable to keep up with my payments. Since then I have been having trouble. I have a bank account with Co operative Bank. I have stopped using them and my account is empty, and Loan store has their details. I do not have any over draft on this account. Yet Loan store have been able to still take amounts from this account, I have spoken with them and told them to stop as i do not have the money, and they are bringing me into unauthorized over draft, they have said that they have a continuous payment authority and they are within their rights to take it. I have read about these continuous payment authorities and know that they should stop taking it if i instruct them to. I also know my bank should stop them if I ask them to, I have had many conversations with the bank about this and they claim that they cannot stop the payments, I read the FSA's guidelines to the bank on the issue and was still told they could not stop it. What the bank is saying is that although it comes up as a continuous payment authority it is not. They say they could stop it if it was. What it is, is a Pre authorized payment which they cannot stop. So far the loan store has taken over 3 months , 1st month £35 - 2nd month £96 - 3rd £60, all in a unauthorized overdraft. I have never heard of a Pre authorized payment anyone have any ideas on this one. The Guy in the collections Department of the bank said it is a new thing and he has not seen many.

Hi All Quick question, I have a loan out with EDL for £2000 about 2 years ago or more, I have been paying them every month for what seems like forever, I have missed payments in the past, but in general I pay them. I never receive any type of statement off them at all, EVER. I was thinking about this recently. I have asked twice now for a full statement and and copy the loan agreement. The last being a week and a half ago I called and asked again. I was told that the agreement would take time as it come from head office so by the end of the month, but he could print a statement now and send it. this was almost 2 weeks ago. So what are my rights here. Can i refuse to pay until i receive these documents, I need some advice on how to proceed. Thank you
  4. Ok so I know payday loans are a blight on our society. At the moment i have a £100 payday loan off cap1finance with the huge interest of £39 per month, So i paid the interest last month and they have been texing me daily asking me if i wish to increase my credit by £50 So seeing that i already owe them £100 + £39 interest I would expect with a extra £50 i would be paying say £20 interest on that. So that would be a total of £209 by next payday if i increased it by £50, But no no no Here is what they want to do give me me the £50 pounds extra bundle that in with the £100 + £39 interest on my previous loan so the credit would be £189 then charge me interest on that so the total payable would be £262.71 WHAT A RIPOFF ON TOP OF WHAT ALREADY IS A RIPOFF IF YOU GET MY DRIFT So they want to charge me interest on the interest, does anyone know if this is even legal. Needless to say i refused this special offer.

Hello All Since my last post It would seem that T Mobile have resolved their commercial issues with Lyca mobile, or so I thought, About 3 weeks ago I noticed that I could call the number I was having problems with, so I assumed that every thing was now OK regarding the issue, until yesterday I got a courtesy call from T mobile asking me how I was blah blah trying to sell me boosters the usual stuff, and they told me how much I had spent outside my allowance, It seemed pretty high so I questioned it, and found out they have been charging me 25 a min to call this number. I complained to the lady on the phone said I was not informed of it, and if I call a mobile network from my phone i expect it to be free as my monthly plan states. She told me there was nothing she could do and that I could complain about it once I got the bill. So now I have ended up with £30 worth of costs to this number and was not warned about it before hand does not seem right.

You say no network can garuntee connectivity to every phone network, then they should not print this when advertising their price plans, Inclusive minutes and texts are from the UK to all UK mobiles and numbers starting with 01, 02 or 03 at any time. This doesn't cover Jersey, Guernsey and the Isle of Man. The following costs apply to call and messages outside of your allowance. That says to me that i can ring all mobiles, when in fact it is all UK mobiles except Lycamoile numbers beginning with 0740, maybe they should print this then there would have been less confusion.

Hi All My friend has a loan out with logbookloans and has fallen behind in payments, I don't think the original loan was for much more than 3000, LBL are now demanding a payment of 300 by tuesday or they will take the car,my friend is going out of their mind with worry because they know they will not have the money, and does not want to lose the car. I have read alot here that they should hide the car. Even this scares them. What would be the procedure what would they say if they came to collect the car, and it was hidden what would LBL then do, and what should my friend do then, just not sure of their rights and the correct procrdure for all this. Any advice would be appreciated. Thanks

Hi All I have a T Mobile phone and am currently 3 months into a 24 month contract which includes 1000 mins talk and unlimited tex (combi 35) My friend just recently got a new sim and new number, he is with lycamobile. now his new number starts with 0740, and I have been unable contact him on my phone, yet i can receive calls and tex off him, and also he can receive calls from other friends who are with other networks orange etc, Now I raised this issue with T mobile and they looked into it and come back to me saying it was not technical and that i would not be able to cotact that number because they were having problems with the other network and quoted the problem being down to commercial issues. Now I said I had a problem with this as it is a good friend who i call reguarly, I said they must be breeching my contract and that i wanted to cancel it. They have said if i want to terminate it i would have to pay a termination fee of 640 pounds and that i did not have grounds to terminate it. Now the way i see it is I went into a contract of having 1000 mins to any uk network Lycamobile are a uk network and i cannot call it so they must be breaking the contract, so i should be able to cancel it without paying the termination fee. Any advice would be appreciated. Many Thanks

Hi All Here is a update on what happened with my case, I pleaded guilty like I said I would, and opted for the case to be heard in my abcense, I gave a written statement explaining basically what we have spoken about in this thread and this was the outcome. I got a £200 fine £50 for the original fine and £150 court costs. So thats that, It all turned out to be a very expensive mistake one that I will definatley not make again. So everyone be careful when you are sitting down on trains, sit on the wrong seat and it could end up costing you £200.

Is that not a bit of a contradiction though, if you see a train manager he will sell you a ticket if you do not have one, yet if you bump into a protection inspector 5 mins before this you will get a fine, its not very consistant. Obviously you should always purchase a ticket before you board a train that way you are covered, it just seems like a odd way of doing things.
  11. I have now filled out all the relevant paper paper, I am pleading guilty and asking that the case be heard in my absence, cannot afford to take the time off at work at the moment. I have sent a statment which will be read out in court stating my case, the case is being heard on the 25th of this month. I have explained that I mistakenly sat in first class and was sitting a matter of minuites and not the whole journey as stated in the charge, I have also explained that I offered to move as soon as it was brought to my attention and was not allowed to move as I was blocked off untill we reached purley where the conductor got off the train with and then issued the penelty. So it will now be in the hands of the judge or who ever will hear this case. I will give you all a update as soon as know.

Hi Danielr Firstly thanks for your suggestions, It was first class seats at the end of the carriage, there were no doors seperating it off, the only indication it was first class were the stickers on the windows, and I think there were signs on the wall at the end of the carriage, When the conducter asked to see my ticket, I was then told that I was in first class, I apologised said I had just sat down and did not relalise, I went to stand up and offer to move the conducter then stood in front of me so i could not get out of my seat, they were the type of seats that sit 4 round the table 2 on each side, so my exit out of these seats was blocked. Also the conducter had my monthly ticket in their hand and would not give that back. I was told I would be getteing a penalty fine for my offence and I would have to pay £20, when I refused to pay I was even threatened that they would keep my monthly ticket if I did not pay. I told them that they could not do that (do not know if they can) and it was not mentioned again. I posted on this forum to see if anyone had been through some thing similar and beat it. things have gone a little bit off subject here and maybe a little bit heated, but it is a opinion forum and every one is entitled to their opinion. I do feel it is a little bit harsh for it to have gone this far for some thing to me that seems quite trivial, but do accept that i made a mistake in sitting in the wrong section, should the punishment be so harsh for that offence, I do not think so, I think a penalty should be saved for people travelling with out any ticket, but that is just my opinion. The way I'm looking at it is they are looking for £105 now, as much as I want to fight it, the further it goes the more expensive it could get, with court costs, costs if i want the conducter to show up in court and be questioned, and from the advice I have got on this site I will probably lose, and I just cannot afford for this to get more expensive. I'm just going to have to plead guilty pay the £105 if it is awarded by the judge and put it behind me.

The seats are exactly the same, they do not have white cloths on the head rests there were no doors seperating it off, they do have stickers on the windows but I did not notice them at the time, like I said before I would have noticed eventually and I would have moved but I was not given that chance, I did not pay the £20 penalty charge because I object to paying £20 for sitting in the wrong seat for 3 mins.
