  2. Thanks again Rory32 what if they obtain it from Orange and it has a clause about redemption fees? what do I do then? Also, is there an Act that I could quote when requesting the terms of the contract and a copy of the same?
  3. Hi All All I did to find out about the above company was do a search on Google and bingo, I came across this site! I have read many posts about this dca and feel confident that someone will help me. In or around March 2007, I terminated my broadband contract with Orange because the service was appalling, to say the least. Before terminating the contract however, I had been with them for a long time from when they were freeserve, and then wanadoo. I encountered such a poor service for a while and yet I was paying by monthly direct debit, I kept on telephoning their customer helpline almost every night at a 50p/min rate, and one day I was advised by a customer service person that if I renewed my contract, I would get better broadband speed as there had been improvements generally. I agreed to this but the following day I received an email headed "Your Orange Broadband - we've made the changes" however, tt went on to state my "new" broadband speed being 1.0 Meg, which was the exact speed I had when I was experiencing all the problems! I could not believe the chic! The problems continued and I continued to telephone them asking them to honour the contract which they failed to do. A couple of weeks later I just got fed up and joined Talktalk who have been brilliant. I telephoned Orange to request a mac code so my line could migrate to to the new providers and they mentioned they would be looking to charge me an early termination of contract fee. I just ignored it knowing they had breached the contract anyway. I did receive a letter demanding payment which I ignored. Last week I received a letter from Buchanan Clark & Wells demanding monies on behalf of thier client; Orange PCS Ltd. I very well know that this is not money rightly owed for services provided as I used to pay by direct debit, but money they think they are owed for my early termination of a "contract" which in my opinion was non-existant as they breached it from day one - evidence - I did print out the email Orange sent me confirming the "new" speed, which basically was the old speed! Orange have since closed my e-mail account but luckily I have that copy email. I hate to think that I have to waste my time dealing with this but I will as a matter of principle and am not willing to pay a penny to bcw! I've always been one to pay up when I know I am guilty but not this time. I am in fact quite angry about the whole thing! Could anyone please suggest appropriate content of letter that I can send to these timewasters? Perhaps quoting the law on good & services Act and anything else that might get them off my back! It is not a lot of money - only £171.54 but I will not pay it simply because I do not believe I owe it. Thanks
  4. unfortunately I havent got the terms of the contract because I dont think I was ever sent one anyway. You know what it's like with these phone/ broadband companies, - everything is done over the phone! Do you have any solid legal refs you think I should quote in my response letter to bcw?
