  1. Well not specifically pay day loan but just as bad. Barclays bank charged me £22 for overdraft of up to £150 over limit, £4.35 overdrawn and I get charged for the privillage of this 5day allowance £22. Now that is not a bad little earner.
  2. Back home now and just catching up on the CAG website. Away from home the dongle is absolutely useless. Hope you all had a good christmas and not too stressful. To anyone who is interested I have not had a reply from MBNA and my cheque has not been cashed. I am not in arrears, owe only a small amount but have been well and truly stuffed by their charges in the past. I suppose the poor American Corporate Banks who have crippled the world by corruption, greed, mis management and harassment will try to rebalance the books but the levels they sink to is disgusting. Must be a way of outlawing some of their practices.
  3. Perhaps the county court judge has or his friends and relatives. A vast proportion of the amount owed can soon mount up with £25 per month late charges £25 over limit fee £20+ PPi and of course the excellent compounding interest charges of up to 35%. They are an American Bank over here who do not believe they have to comply with UK law. It was the Americans that caused the credit crunch in the first place by sub prime mortages and corrupt banking and insurance practices. MBNA are stinging people over here to counteract for losses made as a result of this world wide. A good friend of mine has payed out over £14K to MBNA and a couple of other credit card companies when their husband died of cancer last year. She was unaware of these cards had charges added and interest compounded over a year. She recieved threatening letters of house being possessed as the money they say must have been spent on her, To end the intimidation and threats she paid from her savings, Unfortunately I found out about this too late.

Scroll down to Template Letters (written in green) then you can select the appropriate template letter you require. There are many, so more than one may be applicable to you. There is one there on harassment also.
  5. Hello Lancelot Contacting you via telephone is solely done to extract some form of payment. In this instant your complaint will never get resolved. I do not know your history with MBNA ie how long you have had an account. Did you send your letters via recorded delivery and have you kept copies? Have you sent any communication via email. Have you requested A Suject access request and or true copy of the original terms and conditions? I would suggest you request a Copy of the original terms and conditions under the unfair trading terms and conditions and not the 1978 cca agreement. If you request the latter you will be just send thier current terms and conditions. After 14 days they will be in default and should not add further charges or pass the debt on to a collection agency. With regards to them passing the debt on to a collection agency, this will be around for approximately 10% of the debt owed, Not for the 35% being demanded from you. They have already extracted nearly £1100 from you in the past 6 months and I reckon on the amount you owed (estimate £5k )with the £2k they want from you that is a cute way of maximising their income. It may well be that if you requested an SAR and made a claim to them for unfair charges by comparison they would be out of pocket. Suggest look up a few topics on here ie UTTC's Harrasment OFT and your local trading standards. I am failry new to this myself but determined not to let the b......S get me down. So don't give up lancelot there are plnty of people in this position with many many more to follow.
  6. Credit Expert is run by experian. It is interesting to note that when you compare credit scores Credit Expert will give you a much higher score than either experian or Equifax. However, when applying for credit you will be assessed on your experian and equifax scores. I used to subscribe to Credit expert but stopped last year as the credit card I used expired. A point of interest here is that I had 4 or 5 defaults from CITI cards and all of a sudden these defaults vanished. I have no idea why. The only thing that I can think of is that the debtor can look up the amount of default charges made and consider the amount and whether it is worth claiming these charges back. Information just does not get deleted without reason. When applying for credit the agencies will charge you £2 each for a paper read out. These will detail your defaults etc. In this instance the paper copy should match the information on your Credit Expert, Experian and Equifax reports. I get a strange feeling however that this will not be the case. So the point I am trying to make is that I believe you are paying for a service which is witholding information. My Equifax and Experian scores never changed in 4 years. 2002 till 2003 I had quite a few default charges for late payments. Never missed a payment in the next 3 and a half years and my score was just the same. What the hell am I paying for?
  7. Am now in the throws of sending them an SAR. About 5 years ago they were constantly hitting me with over limit and late charge at £25 each per month. Interesting tofind out how much they have fleeced over the past 6 years. If you are late on a payment you become inundated with phone calls from them then Aegis. Out of interest rbos how long did it take for them to reply? A similar request for CITI took 70 days. MBNA SAR will be sent to them in the morning. With regards to stalling you I reckon its a case that they have your money with vast amounts of unfair charges and while they have that it can be used by them to either lend at a high rate or invest for an equally lucrative return.   8. Thankyou, time allowing I will continue to sub. I am compiling my LBA for CITI and a SAR for MBNA at this moment. That will leave Halifax and Barclays to deal with later.
  9. I firmly believe a campaign is needed. I have fortunately have not had problems with debt collection agencies as have managed or to be more precise struggled to pay creditors. However I have had numerous nuisance phone calls at home on my mobile and my ex place of work which I left nearly 2 years ago. All calls have been of Asian origin.It is ironic that they will try to contact you 5 or 6 times a day at least. Yet you as the debtor cannot contact your creditor with regard to unfair charges and have to rely on sending them a letter and waiting months for a reply which does not comply with your request. Certain creditors believe they have the right to change terms and conditions as they see fit to bring in as much money as they can in the present economic climate. Nothing more than pure theft in reality. Banks have been bailed out by the tax payer but are doing nothing in real terms of alleviating real debt. There are no other organisations that can automatically fine you and debit your account directly. I have to work away from home much of the time now so am not in a position to head a major compaign.
  10. Barclays in their wisdom decided to transfer the OD on my business account and debit my current account with it due to them interpreting the account being dormant. I had a standing order in the business account and sent a new mandate for a lower amount. I was told (letter) that some accounts standing orders are not available so I left it at that. The account was in arrears by about 500 pounds at this point. To my surprise The buggers had been debiting my account with £35 each month for 6 months and adding interest, About £900 was debited to my current account, So a couple of times recently I have gone into my £150 reserve fee at £22 a time, can I claim for unfair charges even though the majority of the debt came from a business account
  11. Well done BAE an excellent result. I am fairly new to this site and have a problem with a couple of CC companies. Citi and halifax. However I was late with a payment for MBNA and really got hassled by phone for payment both by them and Aegis. I really got stung for charges from them a few years ago 2003/4. they were continually charging me £25 for going over limit defaulting not making the required payment and yet I had set a direct debit up with them. Plus interest at about 29% APR on charges. Will now send letter (hand written and photo copied) requesting S.A.R. I know it is the 40 day reply option but it is a start.

Phone calls from MBNA. 2 telephone calls on mob 7th 1 message on mob 6th I missed call on mob 7th 2 calls on house line 7th 1 message to contact Aegis [ didn't know who the bugger they were) I phoned MBNA on 7th paid now up till Feb 8th recieved letter from Aegis informing to contact them as instructedby MBNA I phoned Aegis this pm They are a company in India They do not have a registered address in the uk I was told they work on behalf of MBNA Their number is 0808 101 3404 If you wish to lodge a complaint about them I was told you need to contact MBNA
  14. I have a business account with Barclays Bank, it does not get used much. A direct debit goes out once a month. Recieved a letter from the marked without predjudice, We will be taking funds from your current account to remove the arrears on your business account on the 23rd of December 08 and closing the account. I recieved a bank statement this morning from Barclays Bank. They took £990.82 from my current account on the 23rd. In addition they have now added new charges on my business account of £156.00 (2nd Jan 09) I have phoned their customer services to be informed that yes it is their standard procedure to do this on accounts that they deem dormant. No the account according to them is not closed. I merely asked what status the accont was in. I requested an address where I could register a complaint. After a delay a Robert Stanford took over the call saying of policies with the 'Risk Centre". I again requested a complaints address and informed them I would be taking the matter up with the FOS. I now have an address for the complaints Freepost RTLA-CSUE-TCHC Head Office Customer Relations, Barclays Bank 1 Churchill Street London E14 5HP Will write them a letter and see what can be done. Advice anybody!
  15. Oh I forgot to mention. Had loads of messages and calls via mob and home phone over past day and a half in all 6, furthemore recieved one after payment made. I also recieved a text on mob from aegis to contact them immediately. Did not know who the bugger Aegis is. Phoned them 20 or 30 or so times and it was either engaged or caller has hung up. Now I know who they are I reckon as the telephone number is the same as that in a few posts above (courtesy fleeced by RBOS
  16. Hi all am new to this site. I gather lots of us are experiencing problems with the hike in interest rates or to be more precise the removal of introductory rates. My major problem is with CITI cards but have experienced similar with MBNA a while ago. Looking at CITI's latest terms and conditions they state under a particular section that if there is a serious breach and/or repeatedly not making payments they may remove any introductory rate among other things and replace it with their standard variable rate. I do not have a recent copy of t's and c's from MBNA but reckon it would be about the same. I was late on making 2 payments in 6 months. My rate went from a very reasonable 5.8% to a crippling 32.9% I pay by direct debit so my payments have gone from £230 to just under £400 a month. Interest now is about the £290 a month instead of the approx £45. When I spoke to one of our Indian colleagues to request a return to the Introductory rate I was told no. It was because it happened twice in 6 months. Also because I had been a customer since 1999. When a payment is made late your account is automatically debited with late payment fee which is a charge for the default. They are then charging you again because that is effectively what it is via the change in interest rates. The rate is far higher than the standard rate Apr which is shown to advertise their cards. Also I noted the word repeatedly!. If I do something once it is a one off, If I do it again it becomes repeated if I do it again after this it becomes repeatedly and repeatedly is not twice ( with me on this?) So by the wording they must surely be in breach if you have only defaulted twice as it does not constitute repeatedly. Also How the hell do they arrive at these figures of 30% plus apr. Who dreams up these. If you make a late payment and are consequently stung by this inrease in Apr it is damn costly and they keep this well hiiden when enticing you thes loans and balance transfers. They need to be outlawed somehow. I have a copy of CITi's latest T,s and C's and when I looked on Citi cards website and looked up tems and conditions there was not one mention of increasing interest rates to these extortionate levels or otherwise. They appear to me to be deceptive to say the least' They clearly dont have a conscience either. What can be done to stop this as many more people will fall into this trap!
  17. Hi fellow Caggers, MBNA very keen to contact by phone. I paid a payment via using my mobile phone several months ago. I recieved 2 text messages and 2 telephone calls on my mob in past day and a half requesting payment. in addition to this 2 calls on my home tel no. I paid more than they had requested ie £150 instead of the £70 they requested. Telephone call half hour after after payment made requesting payment of £70 from an Indian call centre.. Could not understand their name. Politely told them they need to update record as payment just made. Will send a Subject Access Request to them. Had a problem with them 2003/4 just kept hammering me £25 charges for over limit fees over a 5 or 6 month period even though had a direct debit set up. Paid account off over a few months and unbeknown to me they were still subtracting £255 per month. Reimbursed me eventually. A question to the wise out there! Is it possible for me to claim the unlawful charges plus the contractural rate of interest which I estimate was about 26% at the time. Glad I came across this site. Only problem being it does not appear I can set up a new thread or get a cagger web mail address. Everytime I enter my email address it says it says I cannot use it as another user already has it. Probably need a little advice on that. I am trying to set a new thread up for SCHITI cards as they have removed my promotional interest rate. 9 years with them and have ever only had 3 late payments. Last 2 in 6 months rate gone from 5.8% Apr to 32.9%. Taken Enrons advice and will write to them with a request to return to prom rate as not working at the moment. Thanks Enron for the advice
  18. Hello all you Caggers out there. It is great to be able to post a reply as before I had difficulties ( still dont know why) I like many unfortunate individuals are experiencing problems with CITI cards. Basically I was late on making a payment twice in 6 months. I have had an account with them since 1999. Working away from home long hours,being single and running my own recently started company very difficult to get to a bank or even telephone a payment working over 70 hours a week and that dont include travelling. My October statement rocked me somewhat as my interest rate charge had gone from a very reasonable 5.8% APR to a mind numbing 31.9% APR. In real terms interest of about £45 to £50 per month had risen to £293. I telephoned the CITI customer service number and spoke to an Indian sounding gentlemen. I set up direct debit but would they return the interest rate. No! When I enquired why I was told it was because I had been a customer since 1999. Interest rate on November statement gone to 32.9%. December 4th sent letter politely requesting SAR at Salford address. Today I phoned them for the 3rd time to ask if they have recieved my letter. Their answer was no. Waiting for my bank statement to see if £10 cheque cashed. If not will send letter special delivery. Interestingly a friend of mine has recieved via the post CITI's New Terms and conditions effective from 2nd December. I didn't. A few changes there. Basically miss a payment and they will remove any introductory interest rate. Once removed it cannot according to their new t and c's be reinstated. Had a look on their website for their credit card info. Very little there on terms and conditions regarding effects of late payments. Some strange rules there! Enough of me rambling on. Will do what ever it takes to get the result I need. Learned a great deal from this site! so thankyou to all those who have posted. They appear to me to be very devious indeed.
