  1. Hi everyone, I haven't done anything or heard anything regarding this since my last post and was just wondering if anyone has any further advice to offer on this please? Whilst I can see that 'no news is good news' and all the while they are doing nothing to pursue this debt I should possibly keep my head down, but I would really like to get these accounts cleared - by paying the lowest acceptable amounts of course! - and as both were unlawfully rescinded I don't want to wait till these go to court.............   3. Hi Sutera67, All the FLA did for my complaint was send me a copy of a letter I had already received from the company concerned several months before - an absolute waste of time and effort........... Good advice from dx and postggj! Landy x

Hi everyone, Quick update time - I wrote a further letter to Hitachi after their last letter in the hope they would relent rather than me take it to the FOS, but they ignored my recorded delivery correspondence. As my sig shows I then filed a complaint with the FOS at the end of August. So far only the standard acknowledgment has been received from them. Today a letter arrived from Hitachi offering a refund of all charges as well as the interest that was applied to the 'handling fee' but no interest on any of the charges or the interest on the handling fee interest (if you see what I mean!). Their cheque (which was enclosed) is approx £300 short of what would be refunded were the FOS to uphold and require them to pay back 8% statutory interest on top of all reclaimed amounts. I'm thinking I should write back accepting the cheque as part settlement - but not cash it obviously - and inform the FOS of this development. However, bearing in mind past experience with the FOS, I fear that their investigation will continue to drag on for the usual months/years and at the end of the day we may still not get an increased offer, so am almost inclined to accept what they have refunded............. Yes, that thought did occur to me - that it is just a way to lure you to call them with big discount offers..........but anyway I've given them the benefit of the doubt (for now anyway!) and done as harassed senior suggested. Will just have to wait and see how they respond - hopefully a good low F&F will be the outcome of this - will keep you all updated! Landy x

  7. Hi everyone OH has a loan with LTSB which he paid regularly for over 3 years before ill health caused him to change employment which resulted in a drop in income. Despite soldiering on for a while and despite our best efforts, he was then unable to keep up any type of repayments and the balance today stands at almost the same as he borrowed! At that point I discovered Cag and CCA'd LTSB. The agreement which came back was, according to those on the site who took a look - enforceable. As he had been mis-sold PPI we reclaimed that and only recently this complaint has been concluded to our satisfaction. In the meantime the account (with a fairly large - well over £5k - balance) has been passed around various DCAs - Robbers Way, Apex, AIC and most recently Wescot. Until recently I have successfully kept them at bay by means of the unresolved PPI dispute. Today a letter arrived from Nelson Guest Sols saying that Wescot acting on behalf of LTSB are prepared to offer a 70% reduction to clear the account and avoid further action. This is the first time any reduction has been offered on this account. As it happens we are getting close to making a F&F offer although we had recently SAR'd the loan account in an attempt to clarify if it had been sold - a general SAR to Lloyds had proved inconclusive. Trouble is their letter dates from a week ago - yet only arrived today - and the 'offer' expires on Sunday I realise they probably just want OH to call them - which he would not do - and obviously we would need to get everything in writing re: credit file marked 'fully satisfied' adverse data removed from CRAs, balance not to be sold on etc etc, but I would really like to get shot of this one and it seems too good an opportunity to miss......... I would greatly appreciate any views on how to proceed with this please! Many thanks, Landy x
  8. Wishing your daughter all the very best P1 - and very well done on the scholarship front! Our son has just graduated with a 2:1 and having originally been unhappy with his uni (despite getting into his first choice) he managed to survive the three years 200 miles away from home and hold his relationship with his GF together although they were over 100 miles apart.......(they've been together since his 16th birthday) that's true love for you Apart from anything else he's far more mature and able to cope with what the world throws at him that his Dad and I were at that age. We are very proud of him as you too will be when your daughter graduates in a few years time! Landy x

  10. Thanks Dotty - you're probably right...........it's just me wanting closure and to avoid court action It does seem very odd that nothing has been heard from one of them for over 12 months, but maybe as they say 'no news is good news' !!!!!!!!! Landy x
  11. Hi Dotty! One was sold to Equidebt - last heard from approx 3 months ago. The other was sold to Apex - nothing heard from them for over a year. We have CCAs for both, but one looks like the T&Cs have been cut and pasted to reverse and the other was signature side only with no T&Cs at all. I don't want this to drag on until they become SB (some years to go yet!), but I'm not sure whether I should be offering them a very low F&F or what in the light of the UR - obviously I've made no mention of this as yet. This seems to have been on the back burner for so long now that I guess I'll have to have another thorough read of all the advice available from DiddyDicky etc as I'm struggling to remember what to do Good Luck with yours btw!   12. Hi everyone! Just a quick update - SAR received today - within time, just. I haven't been through it all as yet, but there are definitely no statements present..........however, these were provided previously by way of the FOS when investigating mis-sold PPI so don't think I'll bother pursuing those. The comms logs are present for both accounts and clearly show that in both cases the accounts were sold several days before the DN remedy date had arrived. Any further advice on how to proceed would be most useful as I would now like to get these issues resolved.   15. Hi Miranda - Welcome to CAG! Regarding LTSB, under a SAR I managed to get account statements going back 10 years and loan statements (but not the loan agreements themselves which I already had copies of) going back 9 years. LTSB said they no longer had copies of agreements for earlier loans (mid 1980s - late 1990s) and I've also tried CCAing these but to no avail. Not sure if anyone has had success getting really old docs through CPR requests as I guess they do actually destroy them at some point.............regarding the 9 year old PPI - how long ago did the agreement end? I ask this because they are legally obliged to keep the docs for 6 years after the agreement comes to an end. By the way, are you not going to explore the FOS route first?   17. Hi JGJ and dx! Apologies - I've not been around much lately...........yes, I did take a look at JGJ's figures and all seemed to be ok to me. Regarding off-setting refunds against loan accounts which are with CDR - somewhat strangely in my case LTSB offered ro refund the full amount as a cheque to me, so it is possible for this to happen. Mind you, having agreed this in advance they still wrote a letter saying they were crediting the refund to the account. I emailed the FOS who then contacted Lloyds who in turn admitted this was an error and the cheque duly arrived. I don't understand why they seem to have one rule for one customer and a different rule for another who is in an identical position I don't really know what to suggest JGJ as they have obviously already made up their minds to off-set the refund against the loan balance and I don't know if it's too late to prevent this............ Hi RV, I've been advised by pinky69 to send separate new SARs for my LTSB loans - he said that it could turn out that despite the constant referring to their 'client' these DCAs have actually purchased the accounts and are merely being economical with the truth, which he apparently discovered with one of his own accounts and was then able to negotiate a much lower settlement figure. I'm not saying that's the case with yours or mine, but I'm going to give it a try - worth another £10 I reckon, to discover who really owns the debt! It might be worth you doing the same..........   20. Hi everyone OH and I have two loans with LTSB dating from the mid 2000s. Due to circumstances beyond our control we ceased making repayments on them approximately two years ago. For the last 18 months we have been reclaiming mis-sold PPI on both loans which has now been refunded. Both loans have been CCA'd and both were found to be enforceable. They have both been farmed out to various DCAs for collection and have been doing the rounds for some time. I have done a SAR and the accounts have not been sold to the DCAs concerned. Not wishing to avoid repaying, and as we have been offered a small sum to clear these loans by a family member, I would like some advice as to the best way to go about this please. Previously one DCA offered a reduction of 40% for a final settlement on one loan, but more recently none of the DCAs involved have raised the subject of reduced settlement offers. I'm not sure whether to offer a low monthly repayment first or to go straight in with a low F&F. Either way, I'm hoping to avoid legal action being taken and as this money has been offered by a relative I would like to get this resolved asap. I was hoping that LTSB would eventually sell these on, but they seem to be showing no sign of doing this - although one loan was passed to it's second DCA who has gone awfully quiet and nothing has been heard from them for over 6 months - I'm not sure whether this is a good or bad sign There is so much conflicting advice regarding F&Fs that I'm getting a little confused by it all............. It seems my options are - a) do nothing and wait to be taken to court/accounts to be sold - but how long before this will happen? b) offer say £1.00 per month token payment (all we can afford from our own income) but then this would drag on for ever c) offer a low F&F - which they are most likely to refuse as both loans are still owned by LTSB and I understand lower offers are more likely to be accepted when the DCA actually owns the account Any advice would be great please! However, I still cannot find an easy way to bring up a list of all threads started by me - which was so straightforward before and now seems virtually impossible.............. Just like the previously referenced changes to ebay (which, whilst obviously being an improvement on the very first format, are a backward step I believe to how things were 2 or 3 years ago), I cannot see how this is an improvement personally. I'm sure (like ebay) I'll get used to it in time, but for now maybe I'll take a sabbatical and wait for the dust to settle before returning. Landy x
