  1. Would this apply to loans over £25000 which where taken out prior to 2008. We took out a secured loan in April 2007 for over £25000 and have never received a statementK

Sorry it's taken so long for an update, been busy at work.I am so angry with Nat West/Shakespeares.We put the N244 into court on the Monday morning 20th and we got an hearing date for 24th (which was good as I was off work that day). 5pm that same day I got a letter via e-mail from Shakespeares saying that the eviction had been withdrawn and we needed to confirm that we would be cancelling the hearing by 4pm on Wednesday. Another trip to the courts on Tuesday to cancel but they could not confirm if we would get the £40 back. Been told since that we won't as the only way a refund is given is if we are on benefits. Relieved that the eviction was cancelled but I wish they had done it sooner. I suspect it was once they received a copy of our witness statement as their letter stated that we had an hearing scheduledK

  4. We missed a couple of payments as my husband was off work ill (high blood pressure) and he doesn't get paid when he's off plus they changed his hours at work. Everything is back ok now so we won't have any more problems Yes it was the same one last august

  8. I've still got the budget sheet from July as nothing has changed from that. Yes i can be on line later Think the arrears are approx £7000 with 18 years left on the mortgage
  9. Just the payment arrangement under the suspended order not the whole arrears which they are saying the want
  10. Yes, i did them via on-line banking so I can get a print out. Nat West have also confirmed that the payments have been received when we telephoned them last week
  11. We put that we are now in receipt of the monthly pension (we attached a copy of the letter from the pension co to confirm this) and also what payments would have been made to bring the account up to date
  12. I haven't amended any statements yet. The one for July was not used as they had cancelled the eviction before we could lodge the forms in court. We are up to date with payments but that doesn't seem to matter to them. We are getting an extra £120 per month as my husband as taken a pension early - he his still in full time work though and his hours have been slightly increased so we can definately keep up with payments. We are paying an extra £75 per month off the arrears - this is around £30 more that what would stand under the Norgan ruling.
  13. We have a suspended order with Nat West. We fell behind with the payments in March and received an eviction notice for the beginning of July. We completed an N244 form but when we went to the courts to hand it in we where told the eviction had been cancelled. We didn't received any notificate of this and it took quite a few emails to Nat West's solicitors to get a response - we finally got a copy of a letter saying it was cancelled because of the computer problems that Nat West had been having at the end of June. We caught up with the payments at the beginning of July and also made the monthly payment as normal at the end of July, the next is due the 28th August which will be paid on 24th. On 6th August we received a letter stating that they are going for an eviction, we have the date of 31st August. We telehoned Nat West only for a very automated response - "we missed a payment in April, they will not listen to the fact that we are now up to date.I cannot get any response from emailing their solicitors only that they are contacting their clients. We now have another lette rfrom the solicitors stating that they have not had a response from us about clearing the arrears (the full amount or nothing). This is since the telephone call to nat west and e-mails to the solicitors. I know that we missed some payments but surely they should take into account that all payments are now up to date. I am going to complete a N244 form and take this to court tomorrow I just need a bit of help in wording the statement to attach Thanks

I'm one of the unlucky ones to have a FP secured loan.Northing but problems with them, suspended evictions, no communication from them whatsoever unless they want our house.It's a £41000 loan so it's not regulated but surely they have some duty under the Treating Customers Fairly rules.I've never received a statement from them (the only one we got was from the solicitors in their statement to eviction), I initially only applied for £30000 but I couldn't have that but I could have £41000 which paid off another debt although that would be paid off by now.I really feel like going for mis-selling (I've already been successfull with the PPI policy) but I don't know what angle to go from.As it's unregulated would they still need to use the affordabity ruling - they added my annual bonus payment from work into my salary figure although this bonus is never guaranteed (I'm sure it was the only way that our joint salary would be enough to get the loan)Anybody any ideas or been through similarK

Husband went to court this morning, I couldn't make it as needed in work.He said rep for FP really pulled out all the stops even down to saying we had the witness statement professionally done and that at the currently payment the arrears would not be paid off by the end of the loan and we had already had the PPI refund put against them.The judge pointed out that if we paid the £1128 then yes the arrears would be paid off by the end of the loan and also noted that the account was still under review at the FOS (I put this in the witness statement as I had an e-mail from the FOS confirming this).Husband said judge wasn't really taking any nonsense from FP.Anyway, eviction suspended on that we pay the £1128 by 4pm on Friday (I've already done this via faster payment this morning) and the next payment payment is due at the end of SeptemberThanks for all your helpK
